In the UK a paralegal can work independently . A client can call you direct and they can introduce you to the barister. And are licencened to do small cases independently
@YorbaTheYounger4 жыл бұрын
In Washington state, USA they have Legal Technician licensing. They can open an office of their own and can offer assistance with certain kinds of cases.
@iggybarrato90094 жыл бұрын
Rohan Doughlas, which is the licencing body in the UK?
@rohdoug4 жыл бұрын
@@iggybarrato9009 there are no license, Only code of conduct to be sign by is required. As long as you are trained and a lawyer can employ you under supervision. I understand the government change the laws to allow the paralegal to offer some services directly to the client. There are no regulatory body for paralegals. Because the government does not regulate the industry. However, ‘The Institute of Paralegals (IoP) is the only government recognised professional body for the paralegal sector in England and Wales.’ And you have to join a professional body like this one? I am not sure. But if you done a bad job the SRA can strike you off. In England and Wales you can represent the client at small claim in small court. You can help them fill out forms etc but not give legal adviser, ‘The Legal Services Board (LSB) is the oversight regulator for legal service approved regulators under the Legal Services Act 2007. The LSB currently has nine approved regulators to include the SRA for Solicitors, The Bar Standards Board for Barristers, CILEx regulation for legal executives and six others.’ More..theiop.org/professional-paralegal-register-regulation/

"ignorance of the law is no excuse" everyone is expected to know and understand every rule, code, bylaw, ordinance, statute, regulation, meanwhile no lawyer, paralegal, judge, attorney, know how many statutes codes or regulations there is, they aren't taught in law school 20 million codes and regulations, if they attempt to teach you every statute and subsection in the US Code no one would ever graduate, yet the layman is expected to know all of it, while juggling a job, family life, and between paying bills, buy corpus juris secundom, American juris prudence, words and phrases, pleadings and practices, which cost God knows how many fortunes some costing upwards of 10k each, not to mention access to lexis nexis case laws, subscription is over $350 month probably, then shepardise those cases, all while staying on top of the very rare repeal and the ever present new statute, and the 10,000 new regulations everyday coming down the pike, while they change the code all the time and reword or altar definitions, it becomes painfully obvious that "ignorance of the legal is an excuse" either the game is rigged to be impossible for the average man understanding or "ignorance of the law is no excuse" means something else, they never mention what type of law is no excuse to ignore, there is family law, contract law, corporate law, admiralty law, maritime law, criminal law, bankruptcy law, private law, probate law, banking law, estate and trust law, law of the land, martial law, God's law, law of physics, gravity, natural law, constitutional law, rule of law, something else must be going on because this is impossible for any layman, is it ethical to use 20 million codes to create obligations on the layman who is never even taught what a contract is (or 5 elements of a contract) in public schools?, I think you know my answer without saying, so what is really going on, it's it the gate keepers withholding the keys to knowledge while everyone is expected to understand the secrets locked within? Is it just job security for lawyers, judges and clerks? does any of this crap even apply to man? Anyone who takes the time to understand this by the time they are old and wasted their whole life understanding some garbage antiquated legal system they will never have a chance to use it because the pharmaceutical companies who kill them off as quickly as possible, and that's if they take doctors "advice", I'm sure my comment will probably be blocked and I'm just wasting my time, but my closing statement is a quote from tacitus - "the more corrupt the state the more numerous it's laws"
@biglosergiraffe8 жыл бұрын
Good read. I always thought the same thing. Majority of those who break the law are uneducated, and even if they were educated, they wouldn't know a thing about law. So you are correct, how can ignorance not be a an excuse when the average layman knows 10-20 of your most basic laws out of millions. And only because they are popular in a sense that the layman's reasons for knowing are due to the consequences rendered, such as a speeding ticket, or life for murder.

+Thomas S a statute is a legislated rule of a society given the force of law, a society is a number of people joined by mutual consent to debate, deliberate, and act for a common goal, what we have is a legal society with private members who do carry membership cards and pay dues, yet they presume this private rules apply to everyone, and most people to along with that presumption because of ignorance, It's a secret society that everyone is part of and no one knows it, because it's a trade secret

Unfortunately the five and dime type of crimes pay the highest incarceration for the million dollar offenders (many being “Officers of the Court”) who are often un-prosecuted and their crime is shared by many who indulge and divide in a “pot of gold” they’ve stolen from an unsuspecting and innocent victim. The minority, the poorer and so often juveniles in a succession are stolen from. I have seen the crooked side, I pray for justice and in that prayer I pray for a righteous honest lawyer, but it seems they are bound by the same crime.

I have a question about degree (in this case it is a minor in paralegal studies 30 hours) or a paralegal studies technical certificate (21 hours, a year in time span ) which would be better for me to pursue? it will be coupled with a Bachelor's degree in foreign languages.

learning is a lifestyle I personally would not pursue a degree in legal studies. That would be a waste of time. I would keep watching the videos in this channel and eventually see if I could volunteer for a lawyer even for a few hours a week.

In Canada (Ontario at least) a paralegal can work independently and represent clients in limited functions. In the province of Ontario, paralegals can represent clients in Small Claims Court (civil suits worth less than $25,000), in criminal cases in the Ontario Court of Justice under the Provincial Offences where the maximum penalty is no longer than 6 months in prison, and before administrative tribunals, such as the Landlord and Tenant Board (LTB).

@davidjaroszewski9715 жыл бұрын
Hi Lisa. It all depends on the attorney you are working for. Some attorneys are wonderful to work for and with; they treat you as an important part of their practice. Others can be intolerable jerks. Remember that at a job interview the applicant is evaluating the potential boss/supervisor too. Networking with other paralegals can give you some great intel on job leads and potential employers. Seek out paralegal organizations in your community or state. Good luck!

Paralegals are NOW able to practice in court without an attorney in some states. Other paralegals are unable to practice law because only they are NOT attorneys and do not give legal advise. Paralegals do give suggestions and recommendations. Therefore, paralegals practice advocating. The ABA is unlawful and contrast to the Constitution. Therefore unconstitutional. This is all antiquated bs. Especially when the BAR is unconditional and BAR members are committing crimes against the people, the fourth branch of government. This is misunderstood.
