Bob is not an expert witness, I'm not sure why the court is allowing all of these eleborate hypotheticals. If other witnesses testified to particular facts the state can argue them during closing. But forcing Bob to assume those facts is giving undue credence to those disputed facts.

Bob is an expert on Bob he can be asked on hypotheticals when they are supported by circumstantial and physical evidence, the questions are probative and therefore fair game since he put himself on the witness stand. Had he not testified the prosecutor would have no way to get it in except in his closing. So Bob is his own worst enemy.

On direct this opened up … they gave hypotheticals … it’s all on the table for cross now & it’s a brilliant tactic when dealing with a narcissist. They love to say all they know about a “supposed” situation, Bob is sharp though, he’s learning to keep his mouth quieter. I’m guessing his attorneys after the first day of cross got on him about that.

he's being constantly asked hypotheticals or to "assume" things because he's constantly pretending not to remember things he said days, weeks or months ago or things he saw testified in this trial. the questions are convoluted but they keep him from getting out of answering anything by saying he doesn't remember.

Oops, Durst asked Susan to call the school but they didn't know the correct number or person to call so she called the dean. Kathy would've known the correct person and number to call. Unfortunately Susan was loyal to the wrong person, tried to blackmail Durst for money saying the NY detectives were coming to see her and it cost her life.

Yeah after the trial. The defense made a deal with prosecutors to keep him from testifying that's why they admitted to all those other issues because if he testified Bob would be dead.

@@lindyhawthorne2164 Well if you pay attention to the arguments before the judge especially in the pre-trial preliminary they say that they have reach understanding that Jarecky will not be called and they keep referring to that agreement when they say Bob admitted to shopping at that store after his wifes death. The only reason for him to admit that is because Jarecky was told that and would testify to that and to Bob real view about his movie and much more.

Don't forget were referring to 1982. No cell phones (what we had were equivalent to suitcases), no internet, limited surveillance abilities, etc. Makes me realize that we lived as barbarians. Also, I may be wrong but my interpretation of the hearsay rule is if the statement goes to the truth of the matter that has already been corroborated then it is admissable. Again, I may be wrong about that.

I can see why one would think that. I don’t agree but only because I think he has done his research on Durst. This is the way to deal with a narcissist…just like Juan Martinez with Jodi Arias. To deal with him in a different way would be devastating to the case because of how “smart” Durst is. I believe this prosecutor has gotten so much more information out of him from dealing with him in this way, IMO.

Durst has a fantastic memory - he's proven how good his memory is by correcting Lewin multiple times when Lewin said a wrong date or didn't give a specific date.

Lewin definitely has an unusual style. He’s eccentric & can be annoying at times. BUT, simply put, he’s the best. He’s developed a niche in his field & is considered one of the best cold case prosecutors in the country. What he’s known for is his extensive, excruciatingly detailed prep for witnesses on the stand. And then there’s the fact that he’s never lost a trial. Not once.

To the badgering part, I believe this is technically the objection: California Evidence Code 765(a): The court shall exercise reasonable control over the mode of interrogation of a witness so as to make interrogation as rapid, as distinct, and as effective for the ascertainment of the truth, as may be, and to protect the witness from undue harassment or embarrassment.
