If I remember a device malfunctions the wearer is immediately contacted to let them know. My grandson had to wear a device and we immediately knew there was a problem. This 11 hour and 9 hour interruption does not make sense to me.

Sounds weird to me too. I had a friend on an ankle monitor and when it wasn't charged for 30 minutes his parole officer would show up. He had to know it was off , either by some light or beep and since it tests every 30 minutes you think he would notice. People find ways around things all the time though and that highlights how severe the addiction is.

The way this played put, I think that was the fairest thing. I'm sure these things are generally reliable, but nothing is 100% If anyone tried to tell me it's IMPOSSIBLE for one of these to register a false tamper for several hours I'd laugh in their face. The fact he never got a positive ping on his BAC is why I think this was appropriate. Did he slip it off for 9 hours to sneak a beer? Probably if we're being real, but with the totality of circumstances an electronic malfunction is definitely plausible. Swap it for a different unit and send him back. If it happens again then it's definitely on him.

Ngl he seems to be letting way too many people walk away lately. Sends a bad message when someone gets to go home on a scram and still can't follow those rules they need to go to jail. If I had a scram on my ankle and I noticed something was wrong I'd be calling my defense lawyer, saying somethings wrong and I need a witness.

Let's take a note of how much damage and destruction alcohol causes. And alcohol is legal. Compare that to all other illegal drugs combined and it's not even close. Alcohol needs to be managed better or all drugs made legal.

Got to love this Judge. He reminds me of a certain Judge Pickles (RIP) over here in Britain. He was hearing a multiple burglar case, and this guy was claiming, with no evidence, to only doing it because he heard voices. He's found guilty, and now we have sentencing. Judge Pickles gives him a five year suspended sentence. The guys punching the air, thinking he's won the lottery. Judge Pickles then sentences the voices to serve the five years! "TAKE HIM DOWN." He was also doing a trial for murder, where the accused was fing and blinding at the Judge. At sentencing he put a black hankerchief on his head, before it was abolished a judge would place a black cloth on their heads to pass the death sentence. The now convicted felon saw the black cloth and literally evacuated his bowels and bladder. The Judge then removed the hankerchief, and blew his nose like nothing was amiss.

I’ve noticed for whatever reason those machines are very inconsistent their with the violations. Here when your on a scram or gps monitor a tamper tbata 11 hours or 8 hours like it’s stated here. The machine actually runs through a violation report it self so it narrows down what can cause jt. And also we have monitors that are as big and look like Apple Watch’s and they are almost as a smart monitor lol

"I have hundreds of people with these devices and they never have these issues." That's a lie. First, a lot of them do complain about these issues and the judge just doesn't believe them. Second, people are constantly being called in to have their devices fixed or replaced because of issues. Lastly, it's already on record that this device has had an issue. What the judge needs to do is force the prosecutor to prove it wasn't a technical issue with the device. Was the defendant called in to have the device checked? Was the device checked? If not, the prosecution has no evidence.

I wonder if you sleep on this SCRAM device a weird way and it breaks contact if that would do it. It seems like it was sleepytime when the violations happen. I’ve fallen asleep with my Apple Watch and the sensor wasn’t touching my arm any wouldn’t track properly. In the long run who knows and I have no knowledge about these devices but it seems plausible to me.

Does the device not have an alarm that sounds to let the wearer know it has lost contact with the skin? If it doesn't it should. Otherwise the wearing can claim they have no idea why it appears to have been tampered with.

Nope. Felony is felony. Reciprocal interstate accountability. It's not like (as he said) the person was in Abu Dhabi or Eastern European or Asian or Carribean or ANY OTHER COUNTRY. Felony in one state has impact in others when you're ON THE RUN AND ON FREAKING BOND

The lawyer's argument was that, in Texas, this matter would always have remained a strictly civil matter between two parties who would have had to battle it out in court between themselves. According to the lawyer, In Louisiana the law is different, allowing the one party to make it a criminal case against the other. What the lawyer was trying to represent to the judge was that as felony cases go, the one picked up by his client was a minor one.

Well the 14th is here and nothing has changed to my husband's case I didn't get to meet with thed.a. like I wanted to. I guess it's over. He is stuck with a resist arrest search or transport charge forever. It was the principal and the fact of the ofdicer violently pulled him feom our vehicle for speech. That's it nothing more and nothing less. So apparently, in Denison, tx, which is grayson County, this shit is legal to violate your constitutional rights. Over a bogus not signaling 100ft before the turn. I give up!!

I think I misunderstood the 1st case. I dunno for what he was MIA for 5years. Apart from that I think he was defendable. The judge doesn't like DWI, but one could argue that he got one case in the other state that's being proceeded, and DWI pick up was where he crashed to avoid accident and endangering more people, what was his alcohol level? I'm kinda surprised that it wasn't argued DWI and felony are dubious arguments wasn't tried better. There are usually questions about strength of odour and sobriety tests.
