Delegation of Taxing Power......

Hello. The Devi Das judgment held that the the provision empowering the government to levy a tax at whatever rate it deemed fit was unconstitutional. Through this provision the legislature had effaced itself of its direct function of determining the rate. However the provision was validated retrospectively by the legislature by saying that the maximum rate of tax cannot exceed a certain percentage. This retrospective validation was upheld by the SC.

Delegated Legislation has no power to impose tax, so what should I send?? This power is with the Central Government and in some cases State Government also.
