Yes, These hardly break news n the general population In all countries are in the dark, n the governments doing overly too little to for the indigenous native people of their country's rights. N many countries were founded as a nation from the genocide of the native people that lives there before they came.

So…this is ok, but Blk American children have to be subjected to adoption by colonizers? These “5 dollar natives” don’t complain when they lie down with colonizers. Why complain now? The res is a horrible place to raise a child. (And before you get slick: so are ghettoes, but at least the ghettoes produce some artistic and athletic diamonds. What has the res produced, except casinos, moonshine, and meth?)

I hope this is only the beginning of Justice for our Native brothers and sisters. From my research of history what was done to Native American peoples was absolutely systematic genocide. All the broken treaties, stealing of land with resources and relocations to barren lands was and is inexcusable.

One thing that separate from these cases, is that Native Americans have treaties with United States government. And Native American tribal members in federally recognized tribes have certain protections of Rights. I'm in enrolled tribal member myself, and my status is similar to that of dual citizenship. Being enrolled Native American is more of a political status than it is a race. And that is what the Brackeens did not understand

I honestly would like to see foster and adoptions reduced to 0%, not just Native Americans, all children. Fix the societal ill that cause familial breakdown. Invest in good education , good paying jobs with benifits, comprehensive affordable healthcare, comprehensive sexual education so there are no unwanted children, relationship skills and support systems, affodable housing, affordable healthy food, clean and healthy environments. But unfortunately, as Ms Nagle, alluded to, private for-profit 'adoption' agencies and private corporation have finacial agendas hidden behind privacy. The adoption industry in the USA is $24.7 billion this year. That isn't noble, that selling humans for profit. That is the definition of human trafficking

In some way; Could these arguments apply to African American children? That last part sounds like a possibility. I was taken from family and never returned. I was at the time a baby. Basically raised by Caucasians. My family never got a chance to "fight" for my "rights" Can this ruling possibly help other families in these cases going forward? This ruling protects Native Families from government involvements in families. Its like solidifying their rights as citizens and a separate nation within a nation. Could the African American Descendants of Slaves make a claim of sorts to, protect their families? A stolen "nation" within a nation? Our families have no such "protections"
@paulmentzer7658
@paulmentzer7658 Жыл бұрын
This based on the third paragraph of Article, 1, Section 3 of the US Constitution: " The Congress shall have Power.... To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;" Thus the language used in the opinion for the Court has long view "Commerce" to be almost anything people do. i.e. including adopting children. In simple terms this should not affect the adoption of non First Americans for they do not come under that paragraph. On the other hand it can be used as an example of Equal Protection to cover African Americans but I suspect the Court will NOT do that for African Americans are NOT mentioned in that paragraph and the post Civil War Amendments only state African Americans were to be treated the same as whites.

Unfortunately, your ancestors were brought over here, not as a Nation already belonging here, of course, making the descendants of black people, simply belonging to the settler colony. You, just like the white folks from Europe, are colonial settlers, despite, your ancestors having been brought over to our lands, as slaves. American Indians belong to inherit sovereign Nations, that pre-date the settler colonial invasion by thousands of years. We should have NEVER been FORCED to join the settler colony in the first place. They FORCE us to be colonial citizens with dual citizenship in the name of Jesus and his doctrine of "discovery". We belong to our sovereign nations, NOT the settler colonial USA or Canada (and other settler colonies.) Black folks, just like ANY ethnic group here, do not belong to a sovereign, other than the settler colony. Meaning you will always only be "US citizens" here, on the lands of the Indian nations.

Policies do nothing in the day to day life of the people. I spent 20 years of my career in and around the court system and was the Office of Public Defense Social Worker involved in CPS Dependency court proceedings. I watched indigenous families face accusations by US governing bodies in not just the dependency court but also other court proceedings and oversight bodies. In each and every case resulting in the indigenous entanglement with the court system, US accountability NEVER rose to the acknowledgment of the ongoing generational trauma that is foundationally maintained through through an elitist stance in the judgment of the issues plaguing the Native American population. The contextual reality affecting familial and interpersonal dynamics of the people has been forever altered by the US genocide and segregationist policies imposed over 120 years ago. ICWA was and is an impotent response to a human atrocity still resonating in the hearts of the Native American people who were and are forced to learn the inevitable effect of meaningless US promises. Make no mistake, the trauma and genocide continues through the stressors imposed by agreements the elite of this nation make with about as much follow-through as the treaties that began this obliteration of Native American customs and ways.

Not really. Under the Articles of Confederation, states had the right to regulate Indian affairs, and this led to a host of problems. So, one of the reforms in the US Constitution was to restrict the regulation of Indian nations to the federal government (apart from the tribal governments, of course). So, the justices aren't making a broader argument about race; they are saying that the tribes have certain protections under the Constitution and Congress had the authority to make a law protecting Indians from interference by state governments.

I just happen to be Pocohontos and Ida. It did not just happen yesterday. My sovereignty was violated last night when Lying Larry had the DMPD and that girl and gay cowboy stole my bag with my laundry in it.

First off, native people aren't from India, never have been...2nd, how does the supreme court have authority over sovereign native nations?

The United States Supreme Court is providing legal representation, to those who don't. The United States Supreme Court understands, that minorities don't always have legal representation.

First off there is no country called India in any place in history. They were called Indian because natives were black skin

We know we're from here, relative. We need no reminder. We are known as Indians, regardless...... It's a long Genocidal, oppressive story. The settler colonial "supreme court" your terrorist organization holds, believes it's authority comes from their false god whom they call "Jesus Christ." They use his doctrine of "discovery" to claim it.

If corporate lawyers are representing nonnative clients then that means they are following ambulances, which would never want A.I. to input legal library correctly into AI data banks, so the outcome could take in consideration real laws, constitutional, state--historical set up, rather than monies convoluted self interest.

You would be shocked to know how many Native Americans go missing, especially women and girls. There are thousands and thousands of missing and murdered Native American women and girls and no one bothers looking into the crimes or looking for them. The US acts like they care, but they still don't.

They are not running away. They are being stolen, murdered and or sold into the sex trade.... No. The answer to your question is no, no one cares.

What about the kids who are being abused?! Have you seen some of that stuff?! Dude, some people are real messed up and to say, "no, we won't tell you how to raise your kids," is just wiping your hands clean of the problems and saves some money.
@Warrior_Resisting_Colonialism

This doesn't change the fact that some people are unfit to have children and abuse them and as a result have them taken away. They are still removed and taken to saftey. Since Indian children belong to sovereign nations pre-dating the settler colony of the US, they Indian children REMAIN within our own nations, not forcefully removed to live with white settlers where they wont be raised with their culture. What the Indian child welfare act is, is the Indian children cannot be forcefully removed from Indian nations. Because we are not a race of people, but people belonging to our own sovereign nations, no one holds the authority to remove our children from our nations. The harmful act here, is that the settler colony of the USA, believes it holds the authority to decide whether or not they can take our children. They believe and maintain that a god named "Jesus" has granted them this authority to rule over Indian nations.

Quit taking away their children and abusing them and destroying their families and cultures, then blaming them for the fallout. All the money and support and resources and services that get funneled into foster care - funnel it into supporting indigenous families to heal their trauma and parent their children and raise a strong, healthy generation. Hurting a community until they hurt themselves, then hurting them more as punishment is sick.

I was adopted. The emotional, mental, physical and verbal abuse started on the first day. Waiting to have my adoption nullified. To be emancipated. I am not disputing the legal system/judge's decision to have me removed from the first group of people. Nor do I want that custody or authority to be given back to my biological relatives or their relatives. I am in need of a lawyer to represent me. I am okay with going to the United States Supreme Court. This is as important as: Brown vs The Board of Education. ____ Needed Federal Legislation. Adoption Nullification Act: Allowing adopted people to have their adoption nullified. To be emancipated. Regardless of their age. This would be an Ammendment to the Emancipation Proclamation. ____ Had there been federal legislation, I would have had my adoption nullified decades ago. And wouldn't have had to post this information.
