38:00 Sorry, I thought SCOTUS had specifically struck this down in Bruen and that the standard now (even if lower courts refuse to abide by it) is that any new gun laws are filtered through text, history, and tradition. If the 2nd Amendment is implicated at the textual level, the law can't stand. After all the amendment carries that unqualified command. If the test moves to the historical/traditional teir, the burden is on the government to provide a historical analog law that supports the legislation. In a historical analog, the how/why need to match, otherwise the new law doesn't hold up. Under the Bruen Standard, there really aren't many viable gun laws left and most are on borrowed time.

In a lot of ways, the fact that there’s not enough support for a handgun ban is not news. As far back as the 1980s, Josh Sugarman of the VPC (which has always advocated for a handgun ban) admitted that banning handguns was politically impossible in the U.S. This is one of the main reasons that the gun control movement switched its focus to assault weapons around that time - only problem is, AR-15s have now achieved almost the same level of public acceptance that handguns had achieved 40+ years ago. A majority may still support banning them, but that majority keeps getting slimmer. BTW, anyone who’s ever visited old school message boards like Democratic Underground knows that it’s not uncommon for members to post about the firearms that they own.

Two points about polls. The first is how the questions are worded. For example : There are tens of millions of of semi-automatic rifles in circulation and rifles of all types are only used in 3% of gun crimes, do you think semi-automatic rifles should be confiscated? The other point is that there are certain subjects that have society biases and people don't respond truthfully. That certainly could include admitting you watch porn or in this case own a firearm.

Supreme Court decisions can change, especially if we the people were to elect someone that said they'd pack the Court to get the results they want. Fortunately that didn't happen... yet.

@@PlazmaZ5 Not always - the Dobbs decision being the most infamous recent example. That one surprised me because a general principle of a liberal democratic republic like ours is that once tens of millions of people are affected by a ban on something, they become a politically significant constituency that can make or break election cycles. AR-15 owners are now the same way.
