It's interesting actually, I'm from the Uk and where I live I see little to no unlicensed products. It does make me question how these products are being distributed to different parts of the world. Maybe over here just has better control of what products stay on the shelves. The only time I've ever come across any products like the ones in this video is at a market and since they travel it's hard to control what stock is being sold. It makes me curious to know how unlicensed products are actually distributed and controlled in the U.K.

The knockoff market is huge in Oz because real toy prices here are some of the highest in the world. That gives those selling clone toys a good lever on a big price. And one thing I have noticed is the price of clone / copy toys has been really rising.

Yeah I totally agree! I live in Oz too and I find especially the legos to be super expensive. For what you get it is really pricey. So are MLP, Shopkins, Barbie and Lori dolls. Even when the are on sale they are still expensive. Why is that...hmm....

According to the u.s patent office, if you change an item by 20% its considered a new product. Now while I would say on that bases, if train and car products do that, they, at least in the US, are legal. I don't think its right, morally its wrong, and I would never defend this carp in court, but if I had to, I would make that argument. As for the packaging, sometimes the packaging is copyrighted, sometimes its not. Like coca-cola. The font is not copywritten, so anyone can use it. But I'm not sure if Thomas and friends or hot wheels is. Seeing as both are owned by Mattel, I would assume, assume not guarntee, that they are copywritten. However if they were trademarked, then trademarks expire, and that can cause some issues. Either way, ill say it as it is. Its knock off, they hope people buy it cause the packaging and the actual product resembles that of Thomas and friends and Hot wheels. Its legally borderline okay, but its morally wrong! Thanks Leo!

Thanks. One does wonder if Mattel chase down any knockoff or clone products. Personally i'm seeing more and more variation with dark side Thomas sets. But I have not yet seen a clone of classic Trackmaster or Trackmaster 2. Thats been curious to see. Take N Play did get ripped off (characters and not playsets) and Thomas Adventures is certainly being ripped off.

In legal case, not really. Because those products have a direct likeness to the licensed products. And that's a trademark infringement. Sadly Universal Studios and Disney can't have these places shut down at the source. However they can and should pull these toys from major retailers and online merchants. But they won't unless a major incident happens. Like with those stupid spinner things.
