Problem is, nobody who wants to can. Corporations benefit from the easily-abused DMCA system, and those who are affected don’t have the resources to fight back against fraudulent claims or KZbin itself.

The problem isn’t the DMCA system, the problem are the copyright infringement laws. Laws that legally would make even doing a review of a show without any images be considered a copyright infringement. The dmca system is sadly the best option at the moment unless people can find a way to change copyright laws with lets be real will only happen when the end of the world happens

I see this as KZbin being partially culpable since they have known for this potential exploit & still allow it to be abused. The victims that got it the worst were the other content creators being DMCAed fraudulently & then won't get any compensation. Lord Nazo seems very immature but should have to repay the loss of incomes to the other content creators &/or go to jail with a no internet restriction.

Unfortunately, unless Bungie themselves give out the money they get from their case. The other content creators either have to do their own lawsuit or try to join Bungie in their case which I'm not sure if they actually can. That is just the way it works in court.

Firstly you don't know me, I've never played a game made by bungie and don't really care about them. I also generally dislike destiny for its Grindy nature and microtransactions infested aspects. Atleast this time you made some points about why you dislike bungie: "that they were DMCA claiming fans". I won't claim to know about the situation aside from the occasional yongyea mention because once again I don't care for destiny. From what I understood Bungie was DMCA claiming osts (something I am all too familiar with from Nintendo), this bad actor got striked but was arrogant and decided to dish out massive amounts of copyright strikes against innocent KZbinrs. Firstly in the order of the worst actors: 1) KZbin comes first, this is a site wide issue and countless people are affected because of their incompetence. What they're doing is absolutely horrible and I hope bungie launches a big lawsuit on KZbin. 2) The bad actor themselves, what they did was illegal. They willfully harmed multiple people's careers, endangered the entire game's image, lied and manipulated all in their crusade of pride. They get no sympathy for me (although I do wish KZbin was sued for a few billions) 3) Bungie themselves taking down ost ripped from the game (i.e non-transformative content) is not illegal but it's a dick move I'll agree. They have since then said it was fine to archive those osts (atleast that's what I heard from yongyea). So generally while I'll agree Bungie's no Saint they didn't do anything illegal, just a dick move that they have since backed away from. Really the worst actor here is KZbin themselves

The guy is obviously wrong and deserves some kind of punishment, but do you know who else is at fault? youtube, with their faulty algorithm or whatever they use to verify take down accusations. Nowadays, many people can be falsely accused while "others" can say and do whatever and never be punished.

I agree 100% with you. But, I also wish people would pull away from the " you do one thing lets wreck you forever" I know this person is not going to have to pay that amount but I also know it's going to be a stupidly high amount in court fees/ settlement, etc. What this person did was stupid but I don't think they should get ruined for it. This person is going to be finally ruined fighting this, I don't think that's right.

Negative. KZbin having a garbage system does not excuse someone from maliciously sabotaging a company, all of the people who trusted him, and anyone else in the crosshairs. That's called enablement. The ONLY PERSON at fault here is Nazo. Plain and simple.

I'm not ok with what the person did, but more often than not it feels like punishments don't fit the crimes due to the financial burden people face. It's not unique to thisperson. But, I look forward to seeing how this places out as I'm sure they will settle out of court.

What's the most baffling isn't what he did, but how easily he did it, which goes to show utterly broken YT copyright system is. If it was a proper system, none of this would even be possible and making everyone aware of it is going to force a change. So there's some positive aspect in this whole mess.

I mean Bungie did rip into KZbin something fierce in the court filings. Not sure if there’s a corporate damages thing or something for Bungie to look at to go after KZbin but I’m sure they had their lawyers check (or will once this case is resolved).

It’s not a KZbin problem, it’s a DMCA problem. You can check the DMCA policies of GitLabs and other sites, they are similar. In fact, if they didn’t act the way they do now, KZbin would be breaking DMCA law themselves. KZbin know their DMCA rules are shit, but legally they can’t do anything about it. The DMCA Laws are out dated and need to be updated.

@@Jagrofes It is half anf half. There are certain parts in DMCA requires lots of compliance costs for KZbin (Google). Instead of hiring more people to monitor DMCA content, Google hires less and shifts the burden to the public. They make DMCA become a war between copyright owners and content users, and just sit still doing nothing helpful.

It gets even more petty when you learn that the reason Lord Nazo's videos were getting taken down is because they were based off the soundtrack versions of the music that you would buy from Bungie's official website, so he was essentially uploading paid content on his channel. The other music channels were fine because they were based off recording the in-game audio that played and uploading that, rather than the paid soundtrack versions of the music.

Bungie needs to sue KZbin for allowing this to happen. The only way YT will ever shape up is if they're forced to and a costly lawsuit is the only way to force them. Force them to verify the claimant is actually who they say they are; they already require legal ID to watch "mature" content so they clearly have that capability. If the claimant is not who they say they are, kick them off the platform.

@@darthplagueis13 Lawsuits (especially in civil law) take years to fully pan out. Give it some time. That said, going after KZbin directly likely isn't the right move. Bungie needs to bring this up with the government. The real problem in all this is the Digital Millennium Copyright Act, which is so extremely out-of-date that it allows platforms to protect content thieves from the rightful owners.

I've had to file formal DMCA takedown notices when my work was minted as NFTs without my authorization, and one of the aspects of doing so is saying you acknowledge that false filing a DMCA is legally considered perjury. This guy is an idiot and deserves everything that's coming to him along with KZbin needing to be held partially responsible for being so negligent in how they handle DMCAs. When I filed for my artwork I HAD to supply a URL to where I had previously uploaded the works in question in order to prove that they were mine. The fact that KZbin allows you to just... not do that part... is asinine.

Technically, you could own the copyright to something that you never posted anywhere previously. So, the website requiring you to provide a URL where you had previously uploaded the works in question is actually creating a scenario whereby they could erroneously deny a legitimate copyright claim and thereby jeopardize their own Safe Harbor status under DMCA. If they were to deny your claim on the basis of you not being able to supply a URL where you had previously uploaded the work in question, then they could be held liable by you for damages down the line if they were to ignore your Takedown Request. Just as an example of how something like this might theoretically occur, say it was a piece of art that you had been working on for some time. Lets say that you are hypothetically student at a University and you want to use a particular editing program that you don't have on your personal computer or that does not run well on your personal computer, so you go work on it on a computer in one of the Computer Labs provided by the University. Say you save the file to that computer and leave it there, copying it to a thumb drive, but leaving a copy on that computer. Now, lets say that someone else at the University goes to that Computer Lab, finds the artwork, decides that it looks cool and decides to steal it to mint as an NFT. The fact that you have never posted this artwork publicly does not make it any less your intellectual property. There are too many scenarios where corner cases like this can exist, and KZbin does not want to open themselves up to potentially having their Safe Harbor status challenged. So, they are going to handle it in the most conservative manner imaginable. They are going to treat every claim as valid and ask for only the bare minimum information about that claim. They have procedures for content creators to submit counter-claims, and if there is further dispute after a counter-claim is submitted then it is not KZbin's place to decided which party is in the right. If the Claimant and Uploader are in disagreement about whether or not a given Copyright Claim is valid, then the matter must go to Court. KZbin doesn't get to decide who is correct. A Judge/Jury must decide. KZbin does not need to do anything more than that. If there is a dispute about whether or not a claim is valid, then the place for that to be handled is in court. Does that suck given that many content creators may not be able to afford to take that to court? Yeah. But, the alternative creates a scenario whereby KZbin might not exist at all.

With recent events with Act Man and Quantum TV (the bastard copyright abuser), KZbin has proven to us that they support copyright abusers. I'm glad that companies like Bungie exist. I know Bungie is far from perfect, but at the very least they're just as sick and tired of copyright abuse on KZbin just as the rest of us.

Bungie is far too small compared to Google for that to happen. If Google shuts them down in some sectors of their business, since Google owns way too much IPs/Platforms, it will hurt Bungie in the long run even if they win the lawsuit.

KZbin is literally following the DMCA law, the law is the problem. If you look it up, it states that it has to be complied immediately and you don't have to submit proof of ownership to request a DMCA. Literally anyone can post a DMCA claim on any website, and they have to comply, but if you post a false claim you can be sued.

If they do not do it, the perpetrator will. Because KZbin had no security to speak of. It was an open door. He is even able to say, that they made it possible in the first place. He just "suggested" they take the channels down. They should have known that he did not own the rights.... If there's any reason to fix their copyright system, this would be it. Companies suing KZbinr's for abusing the copyright system and getting away with it paints KZbin in a really bad light, and it's not going to look good for potential advertisers. Lord Nazo isn't going to jail. He broke no laws. He is being sued for causing damages. It is a bit different. The thing is, I'm surprised by the content of the lawsuit itself. First, this Lord Nazo is a small time player. It is unlikely that he has the deep pockets to pay the 7.3 million being claimed. Also, proving the 7.3 million in damages is going to be difficult. Then the question of why KZbin isn't included as a defendent party comes into question. The party that actually caused the damages was KZbin, not Lord Nazo. That would actually be a valid defense if KZbin isn't included. Usually all of the bad actors get looped into a lawsuit, and the defendants are all responsible for the settlement. Basically if the lawsuit succeeded and Bungie received money KZbin and Lord Nazo would negotiate to see how much of the settlement each party would pay. Since KZbin has the deeper pockets and is fundamentally the one that actually caused the losses, they would pay the majority of the settlement. If KZbin gets looped into the lawsuit. Taking on just Lord Nazo means you're draining him of financial resources. Just the legal fees to fight this will hurt him immensely. It is much more likely for him to lose this case than if KZbin was added because KZbin can afford to fight this case for as long as they wish to. Or KZbin could just settle the case out of court because it will be less embarrassing. Then KZbin can sue Lord Nazo and cite Bungie's lawsuit as the damages.

Meh. Not really. I'm gonna rant here because I have some things to say about it. Firstly, there's KZbin who's at fault for the copyright system. Secondly, Bungie is at fault, even if this guy was an utter twat about it. Why copyright the music? They're not selling songs, they're selling games and expansions. Music being reuploaded onto the platform does not hurt Bungie in anyway I can see, and the problem with Destiny 2 is it vaults content. Some of the songs that get reuploaded cannot be found in the game anymore. So I do think it's incredibly bad of them to do that. Thirdly: and this is an admittedly messy thing to think about... the legal way of doing things is completely impractical. In 99% of the time, achieving nothing. One person being able to do damage to a company CAN be valid in my opinion. Even at the cost of innocent bystanders. Now, before people get all pissy, I'm not saying this guy was right or even that I want vigilantes breaking stuff on the internet. But, if someone was to break things at youtube (even at the cost of content creators) in response to the Actman situation, I'd be completely onboard. If the person is competent, and situation justified, stuff like this may be our only way of forcing companies to acknowledge their own consumers. Otherwise, large corporations like Google are basically untouchable.

@@pagatryx5451 I want to clarify a few things. Bungie does sell their music. Bungie has a Bungie Store website with all of their soundtracks for sale. Lord Nazo was buying the soundtracks from there, looping them, and then reuploading them to KZbin. Because the soundtracks Bungie do release aren't always complete and in fact are missing a ton of music, some people extract music from the game files and upload those for archival reasons because of the Destiny Content Vault. Nazo did not do this. Because Nazo re-uploaded the versions of the music Bungie sold and not the in-game extended/unreleased versions he was struck by Bungie. Nazo didn't believe he was really struck by Bungie but thought it was someone posing as Bungie. So to bring attention to this "imposter" Nazo himself became an imposter and struck videos himself while posing as Bungie. Problem is Nazo's videos were really struck down by Bungie. Not a fraud. All of this would've been avoided if Nazo knew the one that striked his channel was indeed Bungie.

@@pagatryx5451 No, one thing bungie does really well is copyright stuff, they allow you to use all sorts of their stuff as well as their API, looking online you can find all sorts of custom destiny merch as well as allowing you to use their soundtracks for videos, this is also why stuff like the archival mind channel was used to upload archived music without bungie knocking them down because it was both unique ingame music not in the official ost as well as it being an extended cut

This is more proof as to why those filing copyright claims should have to show proof that they own the content and show evidence that it's an actual violation of copyright law (i.e. not fair use, etc.) and KZbin should verify there is a violation before a copyright strike is issued. It is all to easy for people and companies to abuse the copyright claims system.

I hate Copyright strikes. There's no punishment for a false filing. It's also very easy to file and disadvantageous for the defendant who has to provide their real name and address to appeal (Although I believe a Lawyer can file on your behalf) while the plantiff doesn't. If he refuses to pay, he gets the debt forcefully collected from him. If he doesn't have to assets to cover the debt, he has to declare bancruptcy. If he doesn't comply with the law a court can as an ultima ratio hold him in contempt and throw him behind bars until he complys. Not sure what you mean with "rataliates in a self-destructive way". But that might realy quickly reach a point where he would then also face criminal charges.

Morally? Absolutely. KZbin has a responsibility to make sure their legal contracts are met. Legally? As long as youtube continues to say "but we don't agree with what he did, and it wasn't our staff" they can pay their way out of any contemporary judge. On the one hand if Bungie was never providing their music to begin with at the time of sending those strikes, then it was unjust of them to strike Nazo for making it accessible. On the other hand, what a selfish POS to strike other Destiny music channels, which makes it clear he's not upset about the music not being available, just upset his specific uploads of the music got struck. Either way, KZbin is far more at fault than anyone else, as always.

That's the thing - the stuff they took down from Nazo was literally just audio tracks that were ripped from the OST albums that Bungie sell on their store and then repeated many times and uploaded as an "Extended Mix". The stuff Bungie didn't go after from some of the other creators were the real extended versions - the 10 or 15 minute in game versions of those tracks that were shortened to 3 minutes for the OST album. Nazo played the victim because his stuff got taken down legitimately. Then he attacked his friends, other, larger creators who he was clearly envious of, and Bungie themselves.

This situation reminds me of the Clone Wars episode with Slick betraying the Republic forces. Acting like he was helping by keeping his brothers from being enslaved by Jedi (which is true to a large degree) but also causing them to suffer and die for the rest of the campaign on Christophsis while thinking he was doing something good. Have no idea why this was my first thing to think of a similar situation but it did.

At first look, the ruse was a good one from Nazo. They made it look legitimate enough that the community was upset with Bungie. Then Bungie went to bat for those that this clown hurt, and now I see that the whole community is on their side in a big way. This just months after they won a $15m settlement against a company that sold cheats for Destiny 2 as well. Bungie is all in on it's community. They know they have something special. The community sees that with actions like this. That's not to say they're perfect and that every decision is best for the community, but it's a damn sight more than most do.

The problem isn't necessarily that KZbin's system is broke, rather it's the copyright law itself that is broken. In order for KZbin to keep its "safe harbor", they have to comply with every takedown they receive. If they refuse, they can open themselves up to the liability of the copyright infringement. Also, there are millions of youtube users and creators, and there simply isn't manpower to evaluate every single claim for accuracy because each one would be an hours (or days) long investigation.

I very much doubt that the law requires them to accept claims from unveryfied sources. I'm also not convinced that setting up some sort of (semi-) automated system for veryfication is realy unfeasible for a company with the kind of IT ressources Google has access to.

This isn't unique to YT either, it applies to any website hosting content. And again, even IF verification was feasible, if KZbin is wrong then they risk liability from the copyright holder

@@ijl7514 I don't speak legaleese, but I haven't found any paragraf stating "...must accept copyright claims from any random, unveryfied yahoo claiming to be the copyright holder" i did find this: "3 Elements of Notification (A)To be effective under this subsection, a notification of claimed infringement must be a written communication provided to the designated agent of a service provider that includes substantially the following: (i) A physical or electronic signature of *a person authorized* to act on behalf of the owner of an exclusive right that is allegedly infringed." Since the law requires the person submiting the claim to identify themselfs as authorized to act in this role, my common sense tells me that this implys a right - if not an outright duty - of the recipent to verify the the identity of the claimant. If however, you are correct and the law does indeed require YT to accept claims from unveryfied sources, then the law is retarded and everyone who wrote it and/or voted for it should be beaten green and blue with the stupid stick...
