Not sure if it's mod. Passing though water surface should be impossible wihtout cheating. But once you already are below water surface game engine doesn't try to drown you or halt your engine anymore and you can play the same way as on dry land. You can use heavy car cheat to get below water and then come out of car and have some fun - for example get wanted level and watch how cops follow you into water.

The helicopter underwater is most likely a cheat and could be a mod but no you can't naturally do that in the game.
