The emergency was a a great relief the common man as the corrupt authorities trembled and work properly. No doubt it made the rich and the corrupt in the country the enemy of Indira. That lead the court and pro rich leaders to turn against her & her defeat.

Neither Judiciary nor Legislature should be more powerful than the other. There should be balance of power between all 3 organs of government to ensure smooth checks and balances. If one is more powerful than the other then there's no mechanism left for checks and balances.

They are both extremely authoritarian. The current government is probably against declaring emergency themselves, mostly because they have been crying about it for a generation. However, you don't need emergency when you can browbeat someone into not working using the ED and other such methods. Also, apparently every person who didn't like PM Gandhi was a CIA stooge.
