Dialysis Access and Fistula Procedure

Should a vascular surgeon be sued if a fistula port is placed in 3 inches too deep and cannot be used after placement?

My brother has this. It's clotted 2x. Now they can't use it. He has a temporary port in his neck in the hospital, then let him go home. The nephrologist said they should not have let him go home with it. 4 days later hey put another temporary one in his chest while we figure out the best route at this point. My brother said those needles hurt so bad on his arm when they do the dialysis. I would not recommend this if you have a choice.
