I was a cop in CA a few years before that and it was common practice to just toss the weed (user amounts, joints) out on the ground. It just wasn't worth doing the paperwork unless there was some other real crime involved... but for traffic stops and stuff like that, nah. So I never believed that Harris locked up thousands of people for pot because cops in CA just weren't arresting that many people for pot.

For me, I thought it should be legalized in 1980's. The DA choose which cases to go after. They manage prosecutors directly by removing or replacing them on cases and they indirectly manage cop activity through their general stance on issues for cops under their jurisdiction. The scale is inflated for propaganda but it's definitely under their power to influence policies at least in the negative. They have complete power to refuse to pursue charges against someone regardless of what the prosecutor says.

A prosecutor does not write the laws. He or she enforces them. If weed is illegal. The prosecutor has no choice. Now they may have some discretion on how they prosecute someone. I don’t smoke weed, but I believe it should be legal, as in smoked at your home. The other day I was shopping and I smelled pot in the parking lot. The driver was getting high while waiting for his girlfriend. I have no problem if he gets busted and goes to jail. The same for someone drinking booze. Getting high while driving is dangerous and you are a jerk for doing so.
