There were huge issues with the EGR system on the Gen2 engines. What makes this system better? You two discussed the physical change but not how or why it will eliminate the previous issues with Gen2.

The egr is downstream of the dpf so it won't clog the intake

It wont, not entirely. FCA Added a low pressure egr loop which is after the DPF so you get cleaner exhaust to recirculate. This would be a massive improvement if not for the fact that the High Pressure loop which is right off the exhaust manifold is still there, this is what sucks up all the soot and grenades your engine. Seems like they only did half the steps needed to fix the sooting issue. Guess we will still have to "bulletproof" our emission systems for now...
