Is it a good idea for my immigration lawyer to recommend my husband who married me (a US citizen) within 90 days of arrival with K1 visa to apply AOS AFTER expiration of 90 days of K1 visa validity because discovery of syphilis and we are working on the treatment which it will itself could last longer than the validity of 90days I order to get a negative result? PS he got discovered after his exam outside the us while applying his K1 and went through the process of penicillin treatment with viral count being cut in half after the blood test in the US?

Hello! It depends on whether the embassy is backlogged or not and if they completed their background check on you. So, it could be anywhere from a week to a couple months.

Because U.S. Immigration law has not updated that requirement yet. If it is still required by immigration, then you will need to take the vaccine unfortunately.

You can either move the appointment back or go to the appointment without the medical exam and they will request it later. Some embassies require you to move the appointment date if you do not have all required documents so you will need to contact the specific embassy.
