Same here. My husband just a left a job making 60K a year (CNC Programmer/Machnisist) on 40 hours a week (with overtime pay in the past until they got slow). He interviewed a man at a company in Florence, AL to be a CNC Programmer /Machinist) and when the man (the Plant Manager) asked him what his current pay was he told him $60k per year at 40 hrs. The man then left the room and came back a few minutes later and said "I can do $60"..... So my husband left his job and went to work at this company only to find out that he was being worked 53 hours a week including Saturdays ON A SALARIED position with no overtime! This manager NEVER mentioned the word "salary" during the interview! So now my husband is basically working nearly double the amount he worked at his former job WITH NO OVERTIME COMPENSATION! THIS IS ILLEGAL ACCORDING TO FLSA in Alabama! With the overtime comp he should be making 89K per year! Plus his former job was in Tennessee so there was no state tax taken from his check. Alabama has a state tax so he's actually making LESS money and working nearly double the hours! This place is called DIE TECH, INC. They are dishonest scheming SNAKES! My husband cannot even get time to go look for another job now because all his time is STOLEN BY THESE EVIL VULTURES. I pray that God will CURSE THEM for what they have done to us@!

@@reesedaniel5835 The way it really should work is to have a contract and maybe have that contract reviewed by a lawyer. Then accept the contract. Unfortunately, they want everybody to work full time, long-term, at-will with no contract negotiation other than pay. I don't believe in passing protections for people unless there is some violation of rights, but the more I learn about employment I believe a totally free market case could be made for requirements of contract law when certain circumstances are in place which could be deemed to be coercive and fraudulent.

My employer randomly lowered my wage from 11 an hour to 10. I was never told about it all and it seems it only happened to me. My manager didn't know why so she filled out a request to corporate to raise it back but they never did and I still never heard anything. I've worked over 300 hours since it was lowered, could I legally be entitled to backpay? If it's relevant, I am in Utah

I've had an employer add to my job responsibilities, things that are responsibility of a higher pay grade/title and hasn't adjusted my pay or promoted me, but instead promoted employees who haven't been with the company as long nor brought in the money or client satisfaction that I have, nor did they have the years of experience in the industry that I have. But they all worked with management previously elsewhere. Employers, it's cheaper to promote than replace.

My employer is making us "drop tips" at the end of every shift and we do not get them all back until the end of the week. Our tips are said to be held and possibly used to recover drawer shortages....etc We are being told we will be punished for not dropping our hard earned tips at the end of the shift but for some employees, they rely on this money for gas to get to and from work, etc... I am under the impression from what I read but cant find much about it that it is illegal for an employer to withhold earned tips for ANY reason including shortages. Honesty I think our managers have us do this so they can dip here and there in everyones dropped bags and take a little bit extra home for themselves at the end of the week. Splitting them is always done behind closed doors. I dont think we should be punished for taking home OUR tips at the end of the day. Is this situation illegal?

I think one of the worst things about Florida is how employers expect living wage job performance and commitment, for such little compensation, I've often wondered is this because employers take advantage of the fact that Florida is very transient, and or because there's a big population of working retired elderly who don't rely solely on job income🤔🤔🤔🤔

Im in a similar boat. I signed a work contract in 2017 that states i qualify for a 5% bonus for every job i bring over 45% profit. Never seen any money for year 2018 and 2019, i just left my employer and will have someone look at my contract to see if i can collect

I'm an non exempt worker who only gets paid after finishing a job( painting an apartment for example) however, its been over a week and I haven't been paid for 3 hard labor jobs, nothing at all. I worked for a call center, and so I had a customer that refused to let me transfer her and so she then asked for a supervisor and so I got one on the line and the "supervisor" refused to take the call and got me into trouble and later that night (the agent) she messaged me on facebook and threaten to get me fired she also got one of the head bosses involved so he started picking and choosing what I did wrong a lot of it was my voice was raspy. Also then one of the actual supervisors on the floor kept giving me wrong information so I ended up getting fired and now I am unemployed and can't get another job. The head boss took the "supervisor" side. Also we was poorly trained. And I tried millions of times telling my manager why I wear jeans sometimes is because I need money to do laundry. A few times I got in trouble for computer messing up and making me clock in late and I got in trouble with the system issues.

My friend was a trucker in Indiana and he was told before he signed up for the job that if his truck broke down and he was stranded waiting to get picked up hours after his shift that he would get paid hourly something around $21 for that time he goes over (he is salary). This happens one time and he has to stay 5 hours over to get picked up while he’s stranded. At the end of the week he’s thinking he’s getting some extra on top of his regular pay. His paycheck comes in and it’s no different. He basically finds that they built cushion into his salary wage which ended up eating his bonus. He also found that they had about $900 of cushion for this, which means realistically he can’t ever get a bonus pay if he breaks down. I don’t know if this is illegal but it’s certainly shady and should be illegal.

So I’ve got an interesting scenario. I work in transportation. I have a CDL and drive a motorcoach bus. My entire schedule/route is in state and less than 150 miles. My employer does not pay overtime because they claim a weird federal law that they do not have to pay overtime. From what I have read and the law states that that applies to drivers who drive over state lines. After asking some questions of fellow employees they have never crossed state lines in 5+ years. But unfortunately most of the people are simple minded and do not ask questions. Are we getting ripped off?

I work out I’m the oilfields so I’m limited to where I can take my meal breaks to my rig. Anyway my company started separating our meal pay from our hourly pay in order to do away to us hitting double time. A scheme by a former employer here in NC was to stagger the payroll period. A work week ran Mon to Sun. But the payroll week ran Fri to Thur. My first week I worked 50 hours Mon to Fri. Following week got my check for 40 hours, not 50. I had to earn the OT again. Had I missed a day in week 2, it would kill my OT. I missed very little time so it wasn’t a major issue but it wasn’t right. They cheated some people out of a lot of OT that way.

An Employees on a particular shift started out on day shirt making 9.00 then moved to evening making 10.00! The entire shift was promised 1.25 raise but did not get said raise! Only got .50! That's not what was posted tho! Employee making 10.00 was expecting 11.25 but was only given .50 more! With no official explanation!! How is that even legal???

I'm a contractor in Idaho and I put in a full month of work (this is my first month). After submitting the invoice and waiting the max 10 days, I went to the office asking for my check. The company said they are having financial trouble and "might" be able to pay me in the middle of next week. Should I graciously continue working with them hoping they pay me, quit abruptly, file with the department of labor, an or get a lawyer? Thanks.

Sadly tip laws are hard to narrow down easily. I work for a pizza franchise and we do not receive tips from customers who tip via credit cards. Our company changed it policy after a GM stole large amount of money from the company by lying what was done with the tips. We are paid state min wage and aren't considered a tip driven wage. Not sure if this is legal or not in my state of AR. Luckily I don't loose more then a $100 a month so far. This rule does not effect our drivers only the insiders. So this means its not cause they don't have the means of processing the tips it just less trouble for them not to. But any cash tips we received are required to be pooled between us. Sadly 80% customers pay with CC so after a week making $100 tips sadly only $5 of that was cash and I now have to split that $5 5 ways.

I don’t know my rights but after this, I definitely need to turn my two weeks notice in. I guess they think babysitting a 94 year old with no need of too much. That I deserve 5 hours a day pay. Which is 85 a day. As a independent contractor no agency no facility. Just me. I’m confused if I reach out I feel like they think I’m begging for more money. I rather be home once my hours are up like any other would. They hate when I vent. I beg for my sanity back. I miss being home more than 2 times a month. Yes 2. 🤦🏾♀️

And how do official vacation days fit into the 40hrs per week. If you use one of your vacation days for 8 of the 40, and you still work 5 regular days on top of that for example, do you still get overtime pay?

Hi there. No. Overtime is only paid on actual hours WORKED- Vacation pay does not factor in as it is not time worked.

Sure. So they are bordering on illegal but it's not really actionable yet. I would tell them (in writing) that this fantastic lawyer named Richard Celler (kidding! but not really) says that the FLSA (Fair Labor Standards Act) requires timely payment of all wages. Cover your butt and put it in writing. This way if they try to punish you or retaliate against you for insisting they do the legal thing, you have covered your butt. Hope this helps. I can't get overtime because other employees agree to work for strait time through some program that pays them anything over 40 hrs. This is a non-profit company that takes care of people with disabilities and regulated and funded by the government! How is this legal? Also, this is a field that doesn't pay a living wage to start with and hours are abundant and are always hiring.

14 year army veteran 100 % disabled va ssdi since 2012 Terrance M (me) finally collected the info i needed to show that my civilian job owed my disability pension after they denied me 2 times in 8 years . the second appeal process i was able to show where the insurance adjusters (fiduciary), had been neglagent ( dishonest ), in their process. threatened a lawsuit , they got right on paying my back 9 years pay with interest. that has changed my filing statues from exempt for 2019. the fiduciary payed my fed tax for me at 20% 29,000$ tax if i would have been paid on the months i was and am now being payed and paying taxes on till i die for witch i expect the full returns . i would have been paid as would have been correctly done by the fiduciary for the past 9 years, full refunds as a exempt indigent tax payer .with less than 15,000 taxable income every year. is this back pay tax situation fixable by ????? file back tax returns for the past 9 years and claim the refunds. or is there a way to do it another way that doesnt cause such a labor intensive paper work intensive situation ?

Lets talk short/coffee, non-meal breaks, several employers i've worked for insist they are punched out for, despite it takes me less time for a cig i was made to punch out for versus the 20min crap my manager took everyday n didn't need to punch out for, most employees understand how it is SUPPOSED to work but every employer will tell the employee fighting for it a dufferent interpretation that fits their side of the argument, and because they aren't required to give them, if u keep arguing for it they'll just take away the shorts breaks, so all of u going through this, SAVE ur punch out slips and when you leave claim unpaid wages against the company, they DO owe u, 5 minutes 3 times times 5 days a week times 52 adds up maybe once we all stand up to employers this way they may start respecting and treating their employees properly, and for those that don't, we, the employees, need a reasonable method to get rid of employers and companies that insist on impropriety, when an unpaid wage claim takes so long and is already such a process its not an effective manner of dealing with bad employers

Did I wish I had the patients right now to tell all you guys what an idiot and a sucker I am and how I convince myself the owner of the company I’ve been working for for five weeks was a genuinely good guy. Let’s just say at this point he owes me like $7000. 60 hours of overtime pay and last night after telling him I was already over my 40 hours because I’m on salary he told me that if that is my problem and I shouldn’t be messaging him that at night I called him early in the morning when I realize this the problem is that I have a schedule that some times doesn’t allow for me to be at location or and or be able to clock in. Not to mention I didn’t get a clock in at user and password until like the 15th of March and didn’t start building the habit of clocking in until the 19th I actually didn’t realize that I was exempt from overtime as I have communication exchanges of him specifically telling me I’m not a manager but the contract they sign says I was and he is paying me as one. He also misrepresented himself by including a bonus structure that was a percentage gifting of the company based off of a revenue generation and the company was in fact on the market for sale and I was not told this until I found out because someone came in asking about it. I keep kept telling myself that it would all work out until last night when he told me too bad I have to work tomorrow and he still owes me all this money we haven’t even talked about overtime but without the overtime I was supposed to get a $1050 bonus last paycheck which I did not receive. And I was told that it should be on this paycheck but he’s not really sure it seems like. I feel sick to my stomach and I don’t even know what to do because I don’t wanna go to work right now I don’t feel safe or know if I am making a bad mistake. I also don’t want to quit and have to be broke because he won’t give me my last paycheck plus the bonus he owes me. Almost all of this can be proven through my schedule and text messages communications and emails between the both of us I’ve gone through them all and they basically establish the entire timeline with a few pieces missing that you have to kind of see that oh OK so what I’m saying lead to this and that’s why it makes sense but other than that there’s a lot of physical evidence of communication just makes me sick. Not to mention this is my dream job and now I’m probably gonna lose my place to live if he doesn’t pay me
