disabled child social security (DAC)
Did you know your child could receive 50 - 75% of your social security benefit? It's true. Social Security's Disabled Adult Child (DAC) Benefit allows children to receive benefits based on their parent's work history.
The child must be disabled before the age of 22. I think the easiest way to establish this is by applying for SSI at age 18. When the child is approved they become eligible for DAC. Parents should not have to do anything else unless Social Security asks for redetermination.
When one of the parents becomes disabled, retires, or dies the program may automatically kick in. The child may start receiving SSDI. Every dollar received in SSDI will reduce SSI by an equal dollar. The benefit will be based on the parent with the higher amount if both parents are retired or dead.
This is important to consider when thinking about taking your social security. Taking it early could reduce the benefit for both you and your child.
After receiving SSDI for 24 months your child will get Medicare. They can keep Medicaid. They have to meet Medicaid's asset limit. This is CRITICAL if the child is receiving Waiver services.
You CAN work and receive the DAC. Unlike SSI, SSDI is all or nothing. If you qualify, you get the full amount. If you make more than $1,350/mth (2022) you could lose your SSDI. Talk to a Benefits Counselor to learn more.

Hello I am possibly going to be receiving the adult disability from my father and I currently receive SSI and SSDI and also for medical I receive the medical care as primary and then Medicaid is a supplement if I go to this why keep my Medicaid I meant my Medicare is primary and the Medicaid is secondary if I go to the adult disability program wise still be able to receive my Medicaid and I am legally blind and also work a little bit

Generally speaking, you can keep your Medicaid if you lose your SSI because of SSDI. Medicaid pays Medicare's Part B premiums and copays. It's also what covers any HCBS Waivers you may receive. Here's a link to the Social Security POMS that explains the rule (scroll down to B. 4.) secure.ssa.gov/poms.nsf/lnx/0501715015

when my son gets his SSI or DAC benifet when I apply for retirement can that money be used to help pay the food and bills like his phone and etc?
@VisibleNationalTrust
@VisibleNationalTrust 3 жыл бұрын
Yes. Money your son gets from SSI and SSDI (DAC) can (and should) be used to pay his share of the household bills. When applying for SSI the Social Security office will almost certainly ask you if he is paying rent, because they use this information to determine his benefit. If he is paying "fair market value" he will get the full benefit.

Can an adult disabled child that had a part time job, and went over the allowed limit to earn, which caused a stop payment on his benefits with no possibility of repayment of over 7k dollars because of the 6 payment rule while reconsideration was in effect, and because there is no possible way to repay this amount, change to deceased parents disability benefits?

This is a question best answered by the local Social Security office. I am not a Social Security "expert" or employee. I'm doing the best I can to raise awareness of programs, but I don't feel qualified to answer this question.

I'll do my best to make it less confusing Sassy. I'm also going to include a link below so you can get help specific to your situation. When you qualify for Disabled Adult Child Benefit you will receive SSDI. SSDI is unearned income. SSI is reduced $1 for $1 by unearned income. If you get more in SSDI than you do in SSI then your SSI goes away, but you will keep Medicaid. My son is receiving both SSI and SSDI because my wife (his mom) died 10 years ago. I don't know why you are not getting benefits from your dad, it could be because he didn't earn enough credits. Or maybe you need to apply with Social Security. I recommend you use the link below to find an attorney near you who can help nosscr.org/referral-service/

I don't know if she's eligible or not. To be eligible your disability needs to have occurred before the age of 22. I would have your cousin look into it. Here's a resource that may help - mindset.care/

what is the cut-off or income ceiling of the highest earning parent?
@VisibleNationalTrust
@VisibleNationalTrust 2 жыл бұрын
I'm not sure if I understand the question correctly, but I will try to answer. In 2021 Social Security will stop coming out of your earned income when you make $142,800. Next year (2022) this will increase to $147,000. If you are trying to max out your Social Security for your child this is the earned income you'll need. The other "cut-off" is Full Retirement Age. Your child will not get any of the extra you receive if you delay taking social security beyond Full Retirement Age. I hope this answers your question.

Hi, I was born with birth defect disability and I am 32 years old. Unmarried. I know in my case ,it is considered as adult child disability, but they said adult child can apply SSDI using their parents work credit. My dad is deceases and my mom lives in Korea, so she never worked in U.S...but I worked on my own AFTER I got disability, and now I have 12 work credit, in this case, will I still be qualified for SSDI ? thanks

I’m a the payee rep, for my son. Question? Can I invest ?
@VisibleNationalTrust
@VisibleNationalTrust 3 жыл бұрын
The money your son gets from Social Security is designed to pay for his expenses (food, rent, etc). If you want to invest the money he is receiving you would need to open an ABLE account for him. ABLE accounts have the ability to invest the money and it will not be counted against the SSI asset limits. I'd be happy to schedule a call if you'd like to talk. eric@specialneedsnavigator.us

If you get both SSI and SSDI from dac, how does that work? You still have asset limits and rules from SSI??
@VisibleNationalTrust
@VisibleNationalTrust 2 жыл бұрын
Yes. And the only way to get both SSI and SSDI is if your SSDI is less than the SSI benefit. For example, if you receive $500/mth in SSDI and were receiving the full $841 in SSI. Your SSI would drop to $341. If you received $1,000 in SSDI you would receive $0 SSI. However, you would still need to watch the asset limit to keep Medicaid. Does this help? If you have other questions you can email me, eric@specialneedsnavigator.us; or set up a consult meetings.hubspot.com/eric1021

@@VisibleNationalTrust Yeah because I believe I'm entitled dac but it be so low that I would get both SSDI and SSI. And I was wondering if it's even worth getting it If it's essentially be the same as being on SSI currently with all the same rules with SSI. I'm guessing I'm not seeing the benefit of getting it right now if it essentially be like SSI anyway as of currently? I guess that's something I have to decide on. I have to send social security the updated copy of the birth certificate so it's not like they can give it to me automatically Maybe when Congress updates the regular social security in increases benefits I can see it worth getting it because when that happens the SSDI would be enough to not need SSI. But until that happens I would get both SSI and ssdi

@@joegrizzly4785 even if you don’t get more with your DAC SSDI it is still worth pursuing because after 2 years you would qualify for Medicare, and should still be able to keep your Medicaid, thus giving you better access to more doctors because most accept Medicare but many don’t accept Medicaid.

If I retire at 62 this year , will his DAC benifet be based off of my early retirement or at my full retirement 66/10?
@VisibleNationalTrust
@VisibleNationalTrust 3 жыл бұрын
DAC will be based on early retirement. If you can retire at 62 but not take social security until 66/10 that would be "ideal". The longer you can delay between 62 and full retirement age the better

At around 4:50 you state the the Disabled Adult Child’s benefit will be reduced if the Primary Recipient takes their Social Security before their own FRA. Can you please verify this. Everything that I have read is that the Disabled Adult Child’s check would be based on my PIA, independent on whether I take my Social Security at 62 or 67. If their check will not be reduced then this greatly influences the reason to start taking Social Security at 62. One still needs to be aware of how the Family Maximum comes into play because Social Security still counts the Primary’s full PIA toward the maximum even though the Primary will only be receiving 70% of their PIA. Please correct me if I am wrong on either of these points. Thx

@@bradk7653 I will get my 1st SS check this Friday, Sept 3rd , My son will get his 1st SS check for DAC also Sept 3rd. He his getting 50% of my PMI His check is $584 lest than my check at 62 wth 42 years of work history recored to SS. When I die than his check will go to 75%. SS did a phone call with me this month and stated that his ssi check was already sent out and that we would have to send it back do to his new intitlement. In Nov this year he will get the 2nd installment of his back pay that will need to be used within 9 months. if you caluate my sons check double that , the amount is within dollars of what the ss chart show what my full rwetirement would be. With my sons money there is no limit on savings or investment so we are setting up a account for him. Not going with the ABLE account heard to many stories about it and getting the money out. his money is based off of my earnings and not like ssi.

Daniel, thank you for the information, a real life example really helps and confirms what I was finding. I am still a couple of years from 62, but trying to plan what is best for my family, and it sure sounds like 62 will be the answer. As far as StAble accounts I would still recommend looking at setting one up, and also look at a Special Needs Trust if you have any assets that you want to be able to be used for your disabled child when you pass. Ohio has a really good Stable account program, the fees are not bad and residents from most states can use an Ohio Stable account. You can have 2 debit cards on the account that you can load StAble money on and use like a regular debit card for purchases. If your disabled child is capable you can also have one debit card for them that you control the amount of money loaded on it and a second debit card that you can have a different amount of money loaded, that way you can use one to pay their bills/expenses but they can have another to have some level of spending that you as a guardian control. Thanks again for the confirmation and I hope the best for you and your family.

Am I allowed to make capital gains from investments while on DAC benefits?
@VisibleNationalTrust
@VisibleNationalTrust 3 жыл бұрын
Yes. Be aware short term capital gains (< 1 year) count as income and will be applied towards SGA. Long-term capital gains (1 year and a day) do not count as income and should not affect DAC (paid as SSDI). If you are on Medicaid you will want to put any money from capital gains into an ABLE account or 1st Party Special Needs Trust to maintain eligibility. Please email me if you'd like to do a deeper dive into this. eric@specialneedsnavigator.us
