I was married 25 years. He left and moved into our rental property. He paid the bills except one week he went away after closing our bank account so I had no money and couldn’t use my credit card because the payment was overdue. I went from living in a million dollar home with unlimited credit purchases to nothing in one day!! At least I had a home and a job but didn’t get paid for another 3 weeks. It was the most helpless feeling ever. I was afraid I was going to run out of gas driving to work and back. I had friends and family and had to borrow money from my sister. But it made me think of all the women who are divorced with small children no home domestic violence no job. If I had to do it all over again, I would’ve saved half of everything i made and socked it away! I never want to be in that vulnerable position again.

Laura's insight on conflating divorce attorneys with mental health professionals is spot-on. Divorce attorneys often bill for every interaction, even those you might deem as amicable. Rather than pouring out your regrets about marriage to a divorce attorney, a move that could prove detrimental to your case and rack up substantial fees, it's wise to seek support from mental health professionals for such personal matters.

I was a paralegal for a well respected family law attorney dealing with complex financial distributions. The best advice being given is know when to call your attorney. Just to leave a message for the attorney was $28.50. Family law attorney's bill on a decimal system. Everything and I mean everything is billed to the clients account. I would see people go through 20k a month in matters that never should have been dealt with by the law firm. Everyone has a fee they are billed out on. Attorney, paralegal, legal assistant and administrative staff have a billing fee. THINK before you call that office! That is how they make their money and that is how you see your retainer go down to a negative balance.

@canuck33 I work at a law firm & my Attorneys do not allow administrative staff to bill period. That ripping off your client. Paralegals have certification or specific experience to do so

@canuck33 I'm just saying, in no engagement letter would it show that secretaries or assistants should bill. If you labeled them as paralegals 4 that project, when they weren't that's your choice. You're a paralegal or you're not.. RETAINNER AGREEMENTS show the rates. If you were a secretary - you shouldn't be Billing for any project

​@@mkslaw2003 their name and hours may not appear on the bills but, you better believe it's being recorded to come up with indirect or admin cost rates that applied to charged rates to collect those costs. All businesses have to do that of they want to stay in business.

I live in a small town, with a handful of divorce attorneys. And my ex, the morning after I told him I was leaving him and wanted a divorce, cleaned out our joint checking account ( and we have two children so I had to ask him for grocery money, and I had a good-paying job at the time, so it was my money too that he stole from us ) and he made appointments and visited the best two divorce attorneys in our town, so that I would not be able to use them. He got one of the top three as his attorney, and I had to use an old man that should have already retired, he didn't have time for me and didn't care. So I settled for a lot less than I should have gotten, but it was just worth it to get away from the man that was driving us crazy. And my weak attorney told me that it's best to just go quickly and quietly away from a man like this, advised me to settle and just get out, because the clown had joined the circus and would play me every which way but loose. It's sad, but it's true. Some men hate the mother of their children, more than they love their own children.

Always have a plan. You were entitled to go to the bank and take all the money from the account. I took half because I thought it wasn’t fair to take all and would have made me look bad in the courts eyes but make a plan BEFORE you make a move

I have referred client to Laura Wasser. She is excellent!! Laura is 100% correct that the money going out is "your money." People forget that and before they know it they are paying out so much money to the collaterals.

This is such a wonderful podcast/KZbin show, Bethenny!! And I say that on my 40th wedding anniversary day-happily married but we were so young & naive-and we’re lucky-but I think everyone could learn important lessons about this topic-everyone has someone they know now that has gone thru or going thru a divorce-a child or friend etc. Thank-you again Bethenny for another fantastic episode-you are as sharp as Laura and she is one of the best lawyers!! ❤️

Don't forget that Bethany gave him a fair amount of money for being on her spin-off That was supposed to be about her and her business and ended up about being about her wedding and he wasn't getting paid so she gave him a bunch of her money and I'm sure he used to that and like somebody said along with his parents money.😮

Let's discuss further the importance of women understanding the finances in the marriage. I know too many women getting divorced who have never paid the bills and have no idea what they have as far as family finances. So important!

And understanding mortgage documents and maintaining records. Wills, trusts, insurance documents, spouse's work benefits, stock accounts, Bitcoin wallets, auto titles and leases. Women often don't want to do those jobs or don't know how.

As a realtor outside NYC for 25 years I can honestly say when we see a client has been listed over and over again with multiple agents. We call that a rap sheet and the client is the problem common denominator.

I really really like her. Like I literally like her so much and don’t wanna say too much negative, but I do spend a lot of time watching her videos and I had a comment. We all get better at things when we start something new. I just wonder if, a podcast where she is asking questions is the best format. She has so much to say and quite frankly has a lot of knowledge. I don’t know that she needs to bring people on board to ask questions because she doesn’t really let them talk too much. Maybe that’s just me saying that but I know that I’m a lot like that too admittedly. Anyways, love the podcast and great information. I just think she could’ve given it all without having to ask somebody to come on and validate her. We don’t need you to do that. You are awesome

I've been divorced 3 times My second wasn't my "first rodeo " so on my first appointment i had a accordian file with the "receipts". He was one of the top ones in the area, he told me i was one of the most "brilliant " women he had ever met. My ex thought he was going to roll over me .

I 1000% agree with alll these things both from B and Laura W. I also had a divorce custody situation with a legit narcissist and the divorce took a lot longer than marriage. It is totally true. That cooler has prevail and you need to be careful about what information you share to your lawyer in the heat of a moment. They definitely are not your counselor or therapist so don’t let them rack up a bill just to complain about the other party. Time to check in periodically as required. Divorce is a very bumpy road with ups and downs and curves. It is not linear. Keep everything like a business interaction and as much as it can really suck, always be the bigger person and keep your calm. It will pay you back tenfold the judges can also see especially if they see the same divorcing couple over and over again they can read between the lines, especially for the person that cries Wolf over and over and over again.

Have a friend who has lost like 20 pounds finding out his wife of 30 yrs was carrying on with a dude at the gym. Their kids are grown. He finally has an attorney & is seeking divorce. It can be so hard to watch your friend wonder what is going to happen to his inherited home (from his parents) that they lived in when SHE was the one who stepped out. 😥

Our judge in Dad looking for more time said, "this is enough. You can have as long a lunch as it takes. I don't know this child. Can I make a judgement? Yes. Will it be the right thing for him? I will never know. You two as his parents need to make decisions. Come back with a settlement that leads to 50/50 that you both agree on and I will sign it." She was FINALLY forced to give Dad time. She wasn't allowed to drag it out for years anymore. Child is finally getting happier. Child loves spending time with Dad. He can FINALLY relax. The judge saw the writing on the wall. Judge retired 2 weeks later. The idea of going back to court again (I'm sure we will. It's who she is.) Is super scary.

Wow great episode! Its so crazy how things are different in other states. In my state you keep the same judge on your case and never get a new one unless they retire or pass away. And Bethenny you are right on the way you have to make some decisions and if you have been a rule follower it works in your favor

Really good discussion. 2 comments: 1, Wasser is right, knowing the law of your state is more pertinent and better prep than a prenup BUT people do move a lot so you may not divorce in the same state where you married. 2, Bethany made a good point about discussions and agreements being reduced to a writing of some sort because it all becomes foggy years later - marriage is a contract and those collateral agreements become an "addendum" or "appendix", in a manner of speaking, to that contract, without having to resort to a costly prenup. It may not always stand up 100% in a court, but it will generally be influential in the outcome.

I love the part that Laura Wasser says that either way - no matter what happens - it's a contract. "Prenup" is one thing, but who actually understands the details of the "nup", meaning getting married is a contract and few actually know all the ins and outs of what they are getting into until it goes off the rails.

Widows/widowers and issues around wills, inheritance, etc. is also a huge thing. They’re grieving and have to worry about things like are they going to get kicked out of their home etc.

My son's wife just had a baby and didnt want to be married anymore so she took out a fake restraining order and got my son and his disabled son 6 year old son out of the house after 3 years of marriage. He cannot afford a lawyer but she has 2 powerhouse lawyers, free, from the domestic violence group. She ends up with everything, even a van my brother left for my son and my 6 year old grandson on his covid deathbed, half his pension, alimony and of course child support . Him and my grandson have to live with me or they would be homeless not able to afford to pay rent. Men unfortunately are usually on the losing end most times. They are going into their 5th mediation and not divorced yet. She ruined his life and the kids lives!!!

I needed this course 6 years ago I had to sign over my custodial ship to my husband that I was divorcing my daughter wanted to live with him because of parent alienation is a real thing and the reason why I had to turn it over was because I didn’t have another 40,000 to go to trial because he wants to take it to trial so I had to sign it over and it ison the

I got divorced in 2008, thankfully it was fast BUT I had fucking over a DECADE of mental, physical, emotional, and spiritual torture from that man and unfortunately 2 right afterwards. My daughter was the best thing that came out of my last relationship and I will forever be thankful for her. She truthfully saved my life and kept me away from a truly horrifying sadistic narcissist. And I'm 10,000% better now and in a MUCH better place and relationship now and it has been because of a lot of things that you have taught me. I will never be able to thank you enough for showing me that if I'm intimidating to a man that means he's not the one for me. It took me until I was 41 to find a man that has bigger balls than me. Thank you for teaching me to say yes to myself and what I want for myself and my child and my life. You're Just B.....I'm just Dee. I'm the girl and the woman who will never back down, who will keep getting back up after you push me down, and keep forcing myself through the bullshit of life to tell it that it hits like a bitch. You helped me find my voice and the one that showed me that I could be a good mom all by myself even if I'm not in my 20's. I would bet most judges nowadays make $250k + a year, so not exactly low pay. Plus guaranteed pensions. The public sector have all worked out really good deals for themselves over the past 20 years.

My suggestion after having worked with divorce attorneys - if at all possible do a settlement agreement with a paralegal if it is allowed in your state Attorneys will drag on the process of your divorce, billing and sometimes double billing to run up the fees. If your attorney is dragging out your process, put pressure on them to finalize the matter or they will do nothing but bilk you out of your money!

Mediation is also used more and more especially if no children are involved. My first husband and I had jobs, no kids, some assets and it was split 50/50.

My ex paid his lawyer to write a letter for the $30 ice tea maker. I responded he can have it and I will even throw in some tea. He had 60 days to get it and didn't show up in time. So he spent a fortune for a $30 ice tea maker he didn't even get. His lawyer quit twice during our 2 year divorce.

I have a family member, who is going through a very rough time in her marriage right now, that may or may not, end up in divorce. They married when supposedly neither one had much money but it appears, that he has more than he's willing to share. She really doesn't know much about his finances and to me, it looks like he's trying to hide the information. There may also be some family money involved, that she is not privy to even know about. It just seems very murky to me. She is definitely not a gold digger, and has been ok with the way things have been and still are, financially. I can't help but think though, there's a lot more, that he's not willing to share. There are other things in their marriage going on, that take precedent, but if it does end up in divorce, I would want her to have all the information necessary and how to go about it.

Right now the problem with some prenuptial agreements is that the monied spouse often requires the non monied spouse to give up virtually all of their rights. Then, at the time of divorce, the non-monied spouse does not understand why the prenuptial agreement will be enforceable and they are stuck with little to nothing relative to their lifestyle. To convince a non-monied spouse to sign, the monied spouse accuses them of being money hungry if they do not agree. (Essentially, if a non-monied spouse gives up 50% of their rights rather than 90% of their rights, they get accused of being money hungry. In the meanwhile, the non-monied spouse does not realize that after 10 plus years of marriage, it is hard to re enter the workplace.) Just started to watch and I can say for Women who do not have funds for an expensive Lawyer that most Lawyers who are paid by the Government work on your case practically the day of your court date…It is not true that it’s always a red flag if the litigant has changed Lawyers many times…Being in a nasty divorce of 15 years unfortunately ongoing that the abusive ex finds ways of making the other Lawyer to quit because the case is too large…I would say most Lawyers I have had were good but the team of Lawyers I hired with my Family help they were the best…But eventually you cannot spend $500 000 each year…No normal white or blue collar worker can last so long….Ok I will stop here but this is my opinion but does not mean it’s correct for others in a difficult divorce

Divorce should be illegal. It's ruining the quality of relationships, making men (and women) paranoid of their spouses and destroying the family nucleus. Your assets before you met, are the only assets you are entitled to - that's the way it should be. At this point, why shouldn't a woman divorce their husband? They have everything to gain by doing it. It's absurd!

Hi Here's some feedback: 1. Let the expert talk more and keep your questions short and specific to the topic 2. Don't interrupt the expert otherwise it is not possible to understand the full argument or advice 3. Limit your commentary to your solo shows; I think Laura charges about $1k per hour and it was a waste when she only talked a short period; It's ok to have a dialogue or even disagreement but discussion should be balanced 4. Avoid repetition of facts and ideas; many items were already mentioned and repeated in different ways but saying the same thing 5. Why ask an expert to rate you? it came across as narcissistic and need to feed ego; people who are secure don't have to ask for validation. Constantly mentioning that you are an "expert", "pro", etc. is not appealing. Many people who have divorced know a lot about divorce but that doesn't make them legal experts. There was a lot of talk about common sense things but those aren't legal tips.

Not sure about this Lawyer, but in watching the divorce series, I can see Bethenny is still unwilling to take responsibility for the collapse of her marriage. A marriage is a team collaboration and Bethenny is unable to grasp the concept of team. She is a right-fighter and me person. Her willingness to disparage Jason and his humble family is more proof of her narcissism.

She also doesn't talk about the specifics of the prenup. I'm certain Jason knew that he had rights to a very large amount of money and B simply didn't want to agree to that, so she drug it along. She said she offered him $2mill, so I bet the prenup said he would get a much larger portion of the business net worth and assets. Hey B, what did your prenup say?
