Hi Martyna, you certainly have had a rough time of it lately. Copyright is fraught with challenges. I believe you have dealt honourably with this issue. I use a few sites for digital images, but only for personal use. One site I have found particularly helpful is Creative Fabrica. They have answered many queries for me, including the use of their Commercial license. I have received help from various staff members and they have always been prompt to reply, professional and FRIENDLY! No, I am not 'related' to them in any way. I just admire them as a business. Too few businesses these days care anything about their customers, once they have your money! You have had a bad shock but I am pleased to see the maturity with which you have dealt with things. Public 'confessions' can have cruel results but how wonderful people on your site have been! Keep on with your beautiful work and may the skies ahead be blue. Take care, Martyna. 😀🌺💐🌹🤗

I just found your channel. Your projects are gorgeous. I love the longer videos. I am very dissapointed about the fact that you had to stop selling your new kit. It is absolutely stunning and really wanted to purchase it. I suspected you bought the images from Creative Market. I did find the artwork there and read the commercial license. It is completely contradictory on their own site. I understand why you were confused. I'm glad you shared your experience. I am pretty sure the artist is in the wrong. If she feels that way, then honestly, she should not be offering her artwork on a site that sells commercial license. She is being way too nit-picky and unreasonable. Is there a possibility that you can alter the kit more a to make it sellable in your shop? Living in the US, it's too pricey to purchase printed. Again, so sorry about your experience.

Martyna, I liked Melissa Shultz' idea about your possibly altering the kit. I’d love to see you alter your beautiful fall kit, make your own compositions from the elements you purchased and other elements. I know you can do it and it will be beautiful!

Thanks for sharing this. Every seller is different. I too bought something one to make physical products with (sewing pattern) but the seller said I can only make 5 to sell. I decided never to buy from her again. There are tons of others who would sell with less restrictive conditions. I have been told that the artists on Creative Market are more restrictive whilst those on Etsy are more relaxed.

I think the artist should not have listed her pictures for sale and offer them with a commercial license if you are not allowed to use them commercially. I think the only thing she should have required might have been that you give her recognition for her images. What good is a commercial license if you can't use them commercially. It doesn't make sense to me.

I can not believe you would want to still use Creative Images simply because of their license terms If I were you I think I would’ve or still would get an attorney and see who’s really incorrect here. They may be guilty of false advertising and hopefully you have laws in Poland against this. I will never use Creative Market and I’m so thankful you did this video because I never realized this could happen. Too much work to do for a commercial license and still not be sure. If that’s the case, you wouldn’t need any license in my opinion because if the artists’ work is so obscure that you can’t extract the images from your work. I don’t know I’m mainly venting on the last sentence because i believe you are a good person who’s only trying to create happiness, not havoc. Shame on creative market. Clearly you didn’t do anything wrong especially not on purpose and I believe you have all the proof you need to seek legal advice. I think your artist and creative market could be wrong in their enforcement of their laws especially if it’s not clearly written because people arent mind readers. I live in USA so I don’t know beans about Poland. If it were me and I were in your shoes and I honestly felt like I abided by their written rules and didn’t have an aha moment when they explained to me verbally, then it might be worth the $ to seek legal council. You still have time to do so. Lol I’m only going by USA laws too so I could be completely wrong. I’m not wrong about never purchasing from creative market and if you knew me you’d.know that’s not me normally. And I am a glass half full person and support the little guy. But what you’re going through is serious and right is right and they could have at the very least compromised with you on this one since to me you can prove you did your diligence in research and did your best to abide by their rules. Good luck. Karma wins though in the end and that’s what gets me through many moments in life. 🤷🏻‍♀️🤓

If I were you, I would not buy any more from Creative Market. I would use older materials for which the copyright has run out and not renewed. Avoid the whole mess! I don't think you made a mistake. I think that the artist is "bending her rules."

I really love these clusters! You've dealt with this with such grace. I'm sorry that people take your money and then change the rules at a whim. At the end of the day perhaps Public Domain might be the way to go. Keep doing "you", we all love it. Hugs x

All the crafty things you do is so beautiful, you are supremely talented, Martyna! ☆☆☆☆♡☆☆☆☆ As far as the complicated & confusing copyright issues goes I would have done exactly like you do, believing all was fine, of course! Why else buy a license!?! So bizarre the whole thing! Sorry you had to go through all that, that stealing time & energy from you. I agree with Melissa below. She should not sell them if you cannot use them. I was thinking about creating kits but now have second thoughts. I am sorry you had to go through that. I am glad you worked it out. Love your work I am glad I found your channel.

Hi Friends! In this video I am making some easy and super fun clusters that can be used in journals, to decorate pages, pockets, make tuck spots and so much more. I hope you will enjoy this! I also want to share with you all what I learned from my recent experience about copyrights when making digital kits. Mind you though, all that I am saying refers to my specific case. Like other people have said, Creative FABRICA is so much better than Creative Market. Everything is Commercial Use, and some things are even Full POD, which means you can use them AS IS on print-on-demand sites with no changes. I have the monthly subscription, which includes almost 100% of the fonts, graphics and crafts that are sold on the website (millions of items). The licenses are explained FULLY, and they include photos of what is and what is not acceptable use. There are many many talented designers who sell on Creative Fabrica, so you won't have any difficulty finding beautiful images to use for your digital projects. A last note: to get around the "significantly different" part of the license, I often put other images, by other artists, behind and in front, so for example in front of the pumpkins you could put some flowers by another designer, in a similar style, and in the back you could put a crate of apples. Just an idea. This makes it significantly different, and none of the artists can say that you are using their images exactly the way that they provided them.

If I am doing anything commercial I create my own images from scratch. A lot of people don’t like that I don’t buy their art work, but I don’t want to have any copyright issues. My own artwork may not be as lovely as someone else’s but it really avoids the issues.

I've come across authors like the one you encountered and I've had to just walk away and not buy from them any longer. Sometimes I feel they are getting money yet have no real intention of allowing them to be used.

Martina, I am so sorry you had this problem. Your work is beautiful as are you. Your gentleness and kindness show through in your videos. I would check with each artist for their point of view about using their art before purchasing the license. I will be purchasing all your digital, just 💕 them.

An honest mistake and you have sorted it out now. Be kinder to yourself! It would be good to be able to order a kit already printed. Especially if it was done on heavier paper, rather than just thin copy paper. Love your work. x

I would LOOOOOOVE to purchase physical kits from you. As long as the shipping isn't too much. I don't have the internet, therefore I cannot print kits. So YES, I would love to purchase physical kits from you. Standard shipping would be $18.71 for the falling leaves kit and the add on to America. My Birthday is October 8th, we're both Libra Babies. I'd love this kit and the add on for my birthday. I was thinking the shipping wouldn't be so expensive.

Don’t worry, I’m not good at talking in English and working and it’s the only language I speak. It sounds like that website doesn’t have a handle on what is okay or not. It also sounds like you have to talk to each individual author as to what is okay and what is not in their opinion. I would ask each author before I buy. I personally prefer to buy digitals but maybe you could offer both options for your papers? I am so looking forward to more of your digitals! Also like another person suggested, can you alter the kit enough to sell it digitally?

I think creative market makes it confusing for people. You bought the commercial license and should had permission to use it. However they don’t give specifics on how not to use it. Good luck !! and keep on creating beautiful things as you do!💞

These circles are totally awesome. I just watched the mindless Crafting video. The artist used the tops and bottoms from the ribbon and bling spools for her bases. They were beautiful There are many sites that offer free downloads that are not or no longer copywriter free. I think that most of my ephemera will come from these sites. It would also be cost effective to use these sites.

I am so sorry this happened to you. After seeing this kit on Gayle's You Tube channel, I immediately went to your etsy shop and put it in my cart. Unfortunately, for me, you had to pull the kit before I completed my order. The printed kit is cost prohibitive for me, because of the shipping. I do look forward to your future digitals and I love these clusters. Keep your chin up - your subbies are here for you.

This was a very good learning opportunity for you and now for all of us. I am sure it was very upsetting to you! And so sorry that happened to you as a young designer. I am one who has been very careful not to use other's images. To the point that I do my own artwork. Or go WAY out of my way to use original pages & art in my journals. And I document where the pages were obtained in my package insert. Because I don't want to get into these problems. The way I look at it - I guess if I could look at your digital and see that it was MY original artwork - say a flower or a mushroom, that I drew, etc - AND...that you were going to sell the images as your own in a digital product, then, I would also say that would be a copyright infringement. Many artists have been badly burned by big commercial foreign markets stealing their intellectual property - and that has to stop. However, if an artist ASKED me if she/he could use one of my drawings in their digital. I might give permission on a case by case basis. I'm not likely ever to be involved in a big stock artwork website - it doesn't bring me happiness to do that. Copyright is a strange and murky business and I still have many questions. Public domain is definitely a safer way to go...I think, maybe. By the way, I loved your excitement at launching your own kit! That was very fun to watch. One thing about you that is really unique is the way you express your love for your work. Keep creating and thank you for your sharing.

i dont have a printer so I would pay for physical kit especially since you have given your permission to use in any format we wish. Sending as 'mail envelope' format will be a cheaper shipping cost, good idea. Will be looking at your selection, thank you

I am new at junk journaling myself. One of the first things I did was to research copyright material, considering all the images I found in Etsy & KZbin. One of the things I never considered was to use other people's products, specially art design companies. They all abide (here in the US) to copyright laws that are always tricky. On Etsy, I use only 3 or 4 stores, independently owned. I am in contact with the owners constantly to make sure I am using their materials properly. Other than that, I prefer to work with independent artists, who I can email and ask permission to use their work. I buy my own materials (anything previous to 1923 is public domain). It is not cheap but it is yours and you can do whatever you want: copy, use them or create your own boards that will become your art board. I make my own paper as well. Problem solved.

Wow! quite an adventure you had with creative market! She basically sold you a product that you had to completely reinvent to be able to use it. What is the point in buying something if you have to reinvent it before using it?????

I just watched this again and I have to agree with you that you did everything that would comply with the commercial license. You should file a complaint with creativemarket as they are the ones making the commercial license to you especially if you are paying for it. Otherwise use Project Gutenberg as those are public domain.

The word "significant" is subjective. The website should have some kind of way that you can take that up with a board of some kind. If it as particular as she says, you may as well make things from scratch yourself. There is a series of videos regarding copyright by Susan Taylor Brown. She shows you how to find public domain images and how to check the copyright. It's interesting. Check her playlist for the series. It makes sense to use several different authors so that it is significantly different! I am using the kit for a journal. I will post it on Instagram and tag you when I finish it. I am not going to sell it. It sure is complicated! Good luck, Martyna!

I agree! I have had so many issues with creative market, I bought some procreate brushes and I wasn’t allowed to use the drawing I made with the brushes on a KZbin video....it was ridiculous.

I just found your channel as I’m new to journaling. The embellishments are lovely. I’m sorry you’ve seemed to deal with some not so nice artists I don’t quite understand why if you purchased the pack with the correct license why you’d have to not use the images the way you want too. I mean why bother then if you have to completely demolish its use so it’s nothing like it’s intended? Doesn’t make much sense to me but I don’t understand the copyrights as far as that’s concerned. But I think your amazing and thank you for sharing your experience.

It very difficult as you say they are very unclear and vague - personally I cant see that images used separately and not in the same composition, within backgrounds, are competing with the orginals - I would say they are definatley significantly different from the original, how can they not be? Some times it seems that you cant use them digitally in any form for this type of purpose - its very confusing, I have had some of the same issues but did ask the author before I bought some kits and then didnt bother to buy them as it was too complicated and I did not want to get into trouble using them in the wrong way.

Becos digital kits can be altered by unscrupulous persons...printed ones cannot...as far as I understand.

Thanks for sharing your experience and what you learned. I’m new to journaling and found it very helpful. It does seem that the artist was contradicting the terms of the website. I was wondering if you brought your situation to the owners of the site to see what they say. After all, they received payment as well when you bought the license.

Again, just heard you talking sbout the glue. I heard a trick about your trouble with the glue. Take some strong tape and wrap the tube of glue before you use it. I have not tried it, hope it works for you.

I found the artist on creative market and she should have put sample over the top of the compositions she made and didn't want you to use. I showed it to my daughter, who is also an artist, and it ticked her off. Said the ladies TOU are ridiculous and why the heck is she selling them at all.

The item description for the specific images you purchased on creative market does say "17 pre-made design compositions". You were within your rights to use the images as you did. Only pointing this out because you shouldn't feel bad about anything you did. I understand why you removed your digital listing as it's less stressful to simply not do business with that person anymore. just know you weren't in the wrong.

It is always difficult to understand what different artists expect. Perhaps when/if you purchase more items that you contact the artist directly before you start to create with them and get a better understanding of what the artist sees as part of the licensing.

This worry's me also I alway's ask if a photo is old can I please download it and write down in a book what site I got it from etc some people tell me feel free to share but they want recognizing as the photographer or what location it was taken, i am a paying member to The Graphicsfairy Site only once in 3 years i was told the images are from a Private Collection I could use it for my own personal use but not allowed to sell it in a journal I understand your concern because it scares me. I definitely won't use the site who gave you a hard time, i have at least 4 sites, i avoid another Australian site they are only interested in selling their not so old photo's, ❤ hugs to you xxoo

This is the first video from you that I have viewed. I’m so sorry that you had to go through what you did. It sounds so confusing. Why would you buy something and then not be able to use it? I do t really understand. I think you should try another artist. You might find that they are not so picky about it. Anyway I enjoyed your video. Thanks for the inspiration.

I'm so sorry with the trouble that you ran into. But I don't agreed with that artist at all. If you force to change the art pieces and compositions completely wouldn't be your art? what would be the point of buying that pieces then. Anyway, I would understant the same as you do. Your design are beautiful.

Not gonna lie, it sounds like she ripped you off. The whole point of paying for clip art is to use it the way that you did! How frustrating.
