No, it's not illegal as long as you don't sell it. And yes, you can do that. You need to boil the water, sugar then add the yeast. Pour it into the jug or whatever you're aging it in, with the fruits, and cover it.

1. You don't put any sort of cover (like lattice) on top of a custard pie, because it will either sink down or get covered in filling 2. When you add the leaves to the outside, only put them on at the last minute. If you put them on too early, then use foil to cover them once they are mostly cooked. If you wanted to do a cool pie top, it CANNOT be a custard pie. It takes ages to learn how to master that, and even then it doesn't look good. 3. Also, if you are making a non-custard pie and you want to do a lattice top, use a ruler and knife to cut out straight lines
