@alexzzzzzzzzzz2472 жыл бұрын
@@Michael_Lak You'd be surprised. The ONS estimate there's at least half a million people in the UK being paid less than minimum wage, probably more. Someone with a poor understanding of the language is likely to have a poor understanding of employment laws. All three of these had a good enough grasp of English to hold a conversation but if, for example, an employer paying them minimum wage told them they have to pay for their own uniform and equipment (hence meaning they get less than minimum wage in effect), it's possible they might not question that or realise what the law is. In some cases, exploited workers might not even realise they're entitled to a minimum rate.

I'm not sure how it works in the UK but I suspect if it's similar to the USA, you absolutely can be trespassed from a "public place" for filming as you are a visitor on privately owned land. Inviting the public onto private property in order to collect packages or shop doesn't make it public property and no photography policies can be enforced. However, with that said, DJ hasn't done anything wrong here. The property owners do not own the airspace and he wasn't ever told to leave for filming (in fact they kept him there longer by asking questions which is kind of funny). DJ's understanding is incorrect though, if the policy is no filming and you continue to film from their property, you can be barred from entering and trespassed even if you're picking up packages.

10:20 No you don't need to or have to ask permission before using your camera when on private property or inside private property. If that was the case then people wouldn't be able to take pictures in stately homes or museums or restaurants or pubs. Using a camera is the same as using an umbrella. You can use it anytime you want to. Now there are social conventions about the use of both. For instance you don't open an umbrella inside. And similarly you don't use a camera at inappropriate times or places. But social conventions are not rules and can be ignored at will. It does mean that there could be consequences such as bad luck if you open the umbrella or being called a voyeur if use a camera. The point about public place photography is that in a public place which is always on private property (it is not public property, there being no such thing in the UK) the owner is limited about when they can ask you to leave as they have made it available to the public. Some public places on private property can have conditions of entry which can have some code of conduct but they all need to be reasonable and not unnecessarily limit people enjoying the place. A place which is not accessible to the public can have any restrictions it wants, but it has to be applied to everyone. So for instance, they can't say that filming is not allowed and then allow police to enter whilst they have their body cameras recording.

Also when you are recording on a body camera, then you are recording evidence. It's not the same as using a mobile phone or DSLR since it's not as easy to point it at people, it's just recording what is in front of the person and the audio is the key thing. If someone demands that evidence not be recorded then they will have to handle the consequences of being accused of perjury.

Re ‘the owner is limited about when they can ask you to leave’ -not quite right-the owner has an unfettered right to withdraw the licence allowing you access, at their discretion.
@TheSadButMadLad2 жыл бұрын
@@rogerpattube But if they withdraw the access in a discriminatory way then they can be sued. You are right, they can use their discretion, but that means using intelligence to decide when something is not worth bothering about, such as someone with a selfie stick doing a vlog. It might not be common, but it's not anti-social. In fact it is pro-social since it ends up on social media.

Cycling, at a speed in excess of walking pace, in a dedicated walking lane is asking for trouble. A car could start to edge out and knock you right off your bike. The car, even if being very careful has blind spots on the A pillar and the view is also restricted by the cars parked either side.

In other words, clear off our land unless you’re spending money with us! We don’t want your physical presence on our property without first taking cash.

That’s a fairly good summation of the implied licence to come on to private land. Nice.

@@RyderCragie Is a big name TV actress that went to school with my sister, sang as a cantor in my local church when she wasn't working, plays instruments, sells music albums, and has done a bit of presenting work for something I stumbled across a few years ago... An actress, a singer, a musician, or a presenter? She's all of them! The same argument can be made for DJ saying he's not just a KZbinr.
