Where the problem occurs is when private concern send their employees onto public areas to try to impose perceived authority and not knowing the law. As with this video you have 2 private security guards out in public stating "laws" and refusing to acknowledge what the actual law is when its presented to them. Its "I have a yellow jacket and SIA licence (not on display) so the public must follow my instructions.

As an ex security guard from another country it astounds me how little training security guards receive. Waitrose are negligent. If SIA officers come up to you to tell you to stop filming, make sure they have their Public Space Surveillance Licence, as they're trying to taking control over video footage. If they're unlicenced to do so, they're making an illegal request under their existing license conditions. Also, while the Section 26 of the criminal justice and courts act mainly covers corrupt or improper exercise of policing powers and privileges, it also applies to licenced SIA officers in certain situations. in this case, the guy at the start is indeed acting as the security guard for the business and thus acting under his SIA authority. Liability for SIA is not limited to civil charges outside of the property he's working on, as section 7 of the private security industry act 2001 notes the license requirements, and liability of legal consequences including fines, and criminal charges.

Doesn't matter he's dealing with a member of the public in his duty of a licensed sia security. Check the govt security website laws. Better still, watch the dj audits video of him, talking to a sia corporate regional manager, at a trade conference. The sia guy makes it very clear that not wearing your sia licence, which must be visible, not hidden, is a CRIMINAL OFFENCE, except when working covertly, or its been reported lost, or stolen. Waitresses can not employ private security, to deal with non waitrose employees in the uk, unless they are sia licensed. Its the law.

I work for Waitrose and I am quite literally seen a lot of these videos of Waitrose employees coming out to see two photographers and videographers that you can’t do those sort of things… I go around taking pictures and I’ve never been stopped by the security guard so far and I’m quite glad for that but I don’t like it when other people get stopped because they are not doing anything harm it’s the job of the security guard to observe and then report not to intervene if they don’t know the laws

And there is no data protection exclusion; only an exclusion if the activity requires that they are not identifiable (i.e. covert), which doesn't apply here.

Absolutely superb display of showing how virtually everyone you encounter doesn't have a clue as to any kind of legislation that they attempt to hide behind. This can probably be taken as an indicator of how little training and education employees at all levels have been given by their employers.. Proving that MOST businesses aren't prepared to spend money on appropriate training for staff, which is very worrying because what else don't staff know about in their day to day life and in the end it just shows CORPORATE GREED as staff training is in the employers view, a nice to have and not essential... Brilliant video well done..
