Do I need a Fishing License to Fish in Florida?
Unless you fall into an exemption, whether you are a FL resident or a visitor, and whether you are actively or passively fishing (meaning if you attempt to take fish or if you even help or assist in the take, even setting bait on hooks for others) you are required to have a valid fishing license on you whenever you are fishing in FL.
There are many exemptions (and you can find them neatly listed at “myfwc.com/”) but among the most common are:
Resident children (under 16); Resident Seniors (over 65); Anyone fishing on a for-hire vessel, meaning either a guide, charter or party boat, which has a valid vessel license ; and Those who are recreationally fishing off of a pier that has a valid pier saltwater fishing license.
The type of license that you need will depend upon the type of fishing that you do, but, as a general rule, you need the appropriate type license to keep your catch (a saltwater fishing license for saltwater and a freshwater fishing license for freshwater fishing) and if you catch a fish that you are not licensed to catch then you must immediately release any such species.

What if you fishing and you going for food for theirs no place in the constitution that says you cant fend for food?

Thank you for your question. It is a good one and I am happy to answer. The Constitution does not delineate all laws, in fact it only covers basic rights and lays out a framework for government with a few rules. Most laws are passed by Congress (State or Federal) or by municipalities, and are then interpreted by the Courts to be constitutional (permissible laws) or not. Unfortunately for you, States (and municipalities) can pass legislation regulating things like fishing, and they do and they did. Just like you can;t just grab a bow and arrow or a rifle and hunt for food as you wish you also cannot drop lines anywhere at anytime. There are rules. I believe if you fish freshwater with cane pole you do not need a fishing license in your county of residence , and if your fishing in a private pond/lake

You don't need a license until you turn 16 but beware of bag and length limits (please see: myfwc.com/fishing/freshwater/regulations/general/ ). You can get all the info you ever wanted by looking at the FFWCC website (myfwc.com) and you can also call them and ask pointed questions directly at 850-488-4676. I'm 9 and my dad doesn't have a license but I want to go fishing how can I learn how to fish a lot I'm not gonna keep the fish I just think it's fun to catch them and let them go reply soon plese

I have good news for you. You do not need a recreational hunting, freshwater fishing or saltwater fishing license (including for snook or spiny lobster) if you are a child under 16 years of age (see: myfwc.com/license/recreational/do-i-need-a-license/ ) but you are still subject to all size and bag limits and other provisions of law. Do you need any special license on freshwater fish like Bass.. kind of like you need a snook stamp in saltwater

Hello Jimmy, To my knowledge there are no special designations under freshwater as there are under saltwater and so for fresh I believe ("I believe" but am not entirely ceryain) that you need a normal freshwater license. Hello David, I neither make nor do I enforce the laws; rather, I'm just here to tell you how it is and hopefully to arm you with knowledge and the power to avoid a legal entanglement. If you want to know the why of the law then you are free to Google the legislative history but I suspect that it is based in common sense (and not "stupidity"); specifically A) conservation (not everyone catches and releases and sometimes even people with that intent can't, as sometimes fish are mortally injured or die from the catching process and B) the State needs to generate tax revenue to fund all sorts of things, including marine and environmental personnel and issues. Yes. The free ride ended when you turned 16. In FL if you are 16 - 65 then you are required to have Florida licenses and permits to participate in hunting, freshwater and saltwater fishing, out-of-state fishing and hunting licenses are not valid in FL and in FL "fishing" does not mean "catching"... it includes any "attempt to take fish". You do not need a fishing license if you are under 16 but you need to be careful about protected / endangered species. You should also be with an experienced and licensed fisherman. Hello Lucian, I understand your frustration but let me ask you this: If you should not have pay for a fishing license so that you can "feed yourself and your family" then why should you have to pay anything at a grocery store or a restaurant? After all, you are just trying to "feed yourself and your family" aren't you? Look, like it or not, when one lives in a society with a government then there are costs, that's just the way it is. You can dislike, complain and even protest, but things like taxes and licenses will almost certainly - and reasonably - continue to exist so long as society and government exist. There are very few uncivilized places left on the planet. Even on the Serengeti and within the depths of the Amazon rules and regulations exist to protect natural resources, including animals. Fishing licenses are designed to ensure that people have at least had an opportunity to know that there are rules, hopefully what those rules are, to safeguard and protect endangered species and to pay for regulation and enforcement. Again, you may not like it but it makes sense (and, again, it isn't likely to disappear any time soon). Okay Jose. Not withstanding your snarky and silly statement (and noting that but for people who either exercise poor judgment or intentionally snub their nose at the law I would have to find another job) I will explain "the why" of this to you, after which you will remain perfectly free to do whatever it is that you wish. Florida does not purport to "own" the fish; however, as good stewards of the land, sky and sea that constitutes Florida's geographical boundaries, the State is charged with a duty to protect it's natural resources from damage, destruction and decimation (just as is every State and the Federal government). Further, since the State is the government it has a duty to regulate people who are within it's geographic boundaries, not only with regard to damage, destruction and decimation but also for public safety. That observed "the point to have a fishing license" is multifold. It ensures that those who "attempt to take any native or nonnative marine organisms" are aware of the rules and regulations, it establishes a contract between anglers and the State, in conjunction with regulations it indirectly assists in the preservation of natural resources and it directly does so by generating funds which also contribute to conservation and protection of natural resources. The logic is similar to driver licenses, which you need in order to lawfully operate a motor vehicle in Florida (and elsewhere). In fact unlike fishing licenses you have no "right" to a driver license in Florida; rather it's a "privilege" extended by the State to certain people (i.e. you have to be of age, you must pass physical and written tests, etc.), but it is also a contract (i.e. by accepting a FL-DL you agree to consent to sobriety testing). In contrast to driver licenses in FL anyone of any age who resides in any place is entitled to (and is expected to get) a fishing in Florida, albeit without precondition. Now you know "the why" of this and, again, "you're perfectly free to do whatever it is that you wish", just know that if you get caught violating the law (yes, angling without a license is a crime) then you will not only lose you catch but also possibly your gear (potentially including your vessel) and you will have to go out of pocket for a bevvy of expenses ranging from bond to legal fees to court costs to fines, etcetera. Noting that it may or may not apply to you (and in either event I refuse to debate the issue with you or anyone else) I will add one more thing: Over the course of my 32+ years of criminal defense litigation I have come into contact with a handful of self-proclaimed "Sovereign Citizens". In a fashion which is very similar to your comment above, these folks believe - insist even - that Police and Courts have no jurisdiction over them, that laws are made by God not man and oftentimes that by employing certain procedures (e.g. writing specific phrases on bills they don't want to pay) they're effectively immune to government, laws and regulations. Although to the last one they will proverbially die on that hill it never (ever) works out the way that they believe - insist - that it will. So, like a Sovereign Citizen, if you want to live in a ruleless, lawless, self-governing society then I wish you the best in finding one as even the most remote places on the planet have some structure or another (e.g. even "Sentinelese" - an uncontacted tribe living on North Sentinel Island who are completely isolated from the outside world have rules. For instance, in 2006, two Indian fishermen, Sunder Raj and Pandit Tiwari, who had moored their boat near North Sentinel to sleep after poaching in the waters around the island, were killed when their boat broke loose and drifted onto the shore. Poachers are known to fish illegally in the waters around the island, catching turtles and diving for lobsters and sea cucumbers. Capiche?)
