What happens if you get a letter from a lawyer that for a credit card that's no longer a business and closed about 14 years ago and the debt was over 30 years ago and was on my credit 20 years ago but it's not on my credit report anymore and you're telling me they're going to take me to court for it it's not an official letter from the court posted something from the cord that's not a document from the court it's from a lawyer trying to scare me tell me that he'll put a garnishment on my check should I ignore it cuz it's over 30 years ago and the credit card company closed down in 2012

And I just checked New Jersey the statue of limitations 6 years this was over 30 years ago Isis in on my credit report and I just bought a brand new car my credit is good so I don't understand what this is lawyer can drop off a letter and telling me that if I don't respond in 30 days to try to garnish me it's not from the court from the lawyer and this company closed down and his credit card bill was 30 years ago it's not on my credit report

⁠@@nicoboiardo3612If the debt is not one that has no statute of limitations (federal school loans, IRS, child support, alimony), and you are 100% sure that the debt is past the statute of limitations, send them a letter “politely” telling them that threatening to garnish your wages on a debt that’s past the statute of limitations is in violation of the FCRA, and not only are you going to submit a complaint against the FTC and the Consumer Financial Protection Bureau on them, but you are going to sue THEM for violating the FCRA. Finally, tell them to cease communications with you.

I made 2 first payments and then NFCU sent three different debt collectors after me. They kept increasing the amount they say that satisfies them, they keep raising it, it's such a SCAM!!!!

I have a couple of old debts that are past the statute of limitations. Years ago, I received letters from the collections companies about the debt but since then all correspondence has stopped. These debts have never been reported on my credit reports. Should I reach out to the original creditor to pay these debts or just leave it alone? I cannot remember how much I owed, I just remember the original creditor’s name.

I would never ever pay off a debt junk buyer aka third party because most of the time they don't have proof that you owe this debt. I was contacted by a. debt collection agency and not only did I ask for a letter of validation of this debt, but verification as well. They can claim to validate it because all it is is a piece of paper with the original creditor and supposedly the amount that you owe, but other than that they have no proof at all. I asked for verification of the debt from an agency and they said it would take 60-90 days for it and yet never heard from them ever again about it.

I might need to email you as well I was just blocked and my Citibank account was not usable and i had a $30k transfer of funds that were sent to me as a favor to pay my aunts caregivers and the transfer didn’t go thru because they blocked the account on a weekend and i had to make a payment over the phone with my other Citibank debit card for the remaining debt collection from a 3 year old Target bill that was charged off - i had to pay them the full amount $1,543.17 to remove the levy and as soon as the transfer went through the following morning i quickly took it out and transferred it to my Aunts Citibank account where it belongs and I’m worried they will do it again - My question is can these debt collector lawyers block my bank accounts?

I received a letter from Asset Acceptance with a court date for some old debt that passed the 7 years I thought the judge wouldn’t allowed to collect the old debt but because I didn’t take the off the allowed them to place a garnishment against me

they are all scum. i was offered a deal to pay a certain amount and they would waive a small percentage, after doing that, the original debtor claimed i still owed the remaining! only after i threatened to contact a consumer laws lawyer did they email me apologizing :)

All phone companies charge you two month payments in your first monthly payment. They have the last month covered and should not charge you fees if you late in paying them because technically, you are not late since they have that extra payment! 😮

Thanks for informative video. You have mentioned that debt collectors cannot add additional fees or charges. So sending final notices with 10% debt collector fees is illegal??

Hello, i have a question if i was sent to collection agency but the account name is under a business name will they still be able to report my credit to credit agency? They billed under the wrong account and I was trying to get a credit applied which they refused to apply since they billed a business name instead of a home address and have been given the run around in fixing it. Hello, Naam ---- I have a debt that went to charge off and the debt was sent to collections. This debt is only about 3 months late and is for the amount of about $450.00. I haven't responded to any emails or answered any phone calls or returned any calls to the collection company. I did speak to the company I owe and tried to make the payment in full and they said I have to talk to the collection agency. Should I contact the collection agency and pay them the full amount or is there another way to deal with this? I'm assuming my credit has been dinged already by the charge off. I'd like to fix my credit because it was in the low 700 score. Thanks in advance for your time and help if you reply.

Question. I recieved a letter saying "Thank you for your inquiry regarding the above referenced account." I never received a letter in the first place nor did I receive get a bill from the initial place who was a Dentist office. Is this something I could refer to as a scam or sign into their site and see what it shows? Also the amount they are asking for does not match the form from the Dentist they say I owed. One other thing the "validation" they sent was a screen shot of charges not any agreements to pay and sell the debt.

From what I’ve heard, yes and no. Yes if they own the debt. No if they are just assigned to collect from the original creditor. Simply ask the collection agency if they are the owner of the debt or assigned to collect

Are you trying to pay on full? I have one Witt them for $511. I’m be wrong if I should offer 15% or pay on full to get the pay to delete letter. But the debt will fall off in 2 months so I could offer $50 bucks and they will pay to delete 😊

Not all debt collectors will remove the debt unfortunately. If they own the debt they will more likey will, if not they won't be able too.

Texas time barred debts and predatory lenders new law 2019. Now debt scavengers as Texas law calls them have to let you know it's a zombie debt which means they can't sue or arbitrate and we're never allowed to harass. HB 996, which went into effect on September 1, 2019, adds new protections for Texans with old debts, often called “time-barred debts” or “zombie debts.” The new law prohibits debt buyers-generally businesses that buy defaulted debts and try to collect them-from suing or using arbitration to collect a time-barred debt. It makes these prohibited practices a violation of the Texas Fair Debt Collections Practices Act, Chapter 392 of the Texas Finance Code. Under the new law, once a debt is time-barred, a debt buyer cannot sue to collect the debt even if a payment is made. The new law also prohibits debt buyers from suing to collect if any payment is made on a time-barred debt.

lol damn that's crazy I'm from Texas and now live in New York and thought that you had it good with the statute of limitations, but now our states statute of limitations went from 6yrs to now 3yrs and whenever they call you they have to say the same thing over the phone if it's past the statute of limitations and they cannot legally sue you and if you did make a payment or admitted to the debt than they cannot restart the statute of limitations. Another thing to be aware of is these debt collection scammers who pose as attorney's most of them calling from a 1-877 number saying that they are litigations office and they were hired by so and so to sue you and the debt was from like 16 years ago. They are scum of the earth and not a legal office at all.

the creditor is the original bank you owed the money to like capital one, discover or american express. if they sell it to a collection company then they sold it off and the collection company bought it for pennies on the dollar and you don't owe them. your agreement was with the original creditor not some slimy collection company who bought it off the bank.
