How confident are you in suggesting that a Court will not consider the applicability of the legislation in question? Without giving necessary consideration to the applicability equates to ignoring legislative intent OR the prospective incidental scenario (i.e. Pith) that the legislature was attempting to address through a statutory provision. Not paying heed to the applicability of the law in question would mean attention to mere text / grammar / vocabulary, as if the court's job was to score on literary competency of those from within the parliament.
