The defendants were trying to manipulate their responses in the hope that it would help their case. U don’t do that in front of JJ and not look stupid.

I think people are so clueless about the law. Like the guy who printed out laws that bicyclists have to adhere to in his state after running him over when he was a lane designated for bicyclists. Like Judge Judy would have seen it and said "Oh, now that I've read bicyclists should always wear a helmet and look both ways, it's his fault you ran him over." But they have to prepare for a case and if they don't have a legitimate defense, they just bend whatever they can find to prove their case. Also in cases where someone obviously damages their property and they even admitted to it in a police report but then say "No, I didn't" or "How do you know that damage wasn't already there?" as if they can give probable doubt like it's some murder case.

The photographer is very polite, respectful and honest. I would use her business if I lived in the area in a heartbeat. I'll bet if she has a family they are model citizens.

Both times I've hired a photographer, the contracts CLEARLY stated that they retained the rights to use the pictures, and I received some free ones. OR, I could pay a bit more and would receive the rights with my photos.

There are some local laws or regulations judges might not be aware of. It's quite common to point out the existence of those laws if they seem to get overlooked. But you don't do it in a 'well acktually' way like mum Karen did here

@@erickmatamoros1853 The whole concept that 'everyone has to know the law' is unrealistic, even for judges. A judge in arbitration court (like Judy) can try cases all over te country in all kinds of jurisdictions.

As a semi professional photographer...... Wow.... but there is one thing I stand on. Long time friends are not. Always, always, always get a contract/written agreement regarding the free photo sessions in exchange for business advertising. You never know when deals can go south, especially when the work is already done.

Exactly. I had pics done of my granddaughter and the photographer wanted to use some for her portfolio but I had to sign a release for her to be able to do so.

I agree, except it depends on the friends. I have a good family friend who is a photographer, and when we use her we always pay her full fee and tip afterwards. Good friends will never shortchange or try to barter for your art, at least that's my humble opinion.

I always use a Release Form that the customer signs indicating that I have rights to these photos for advertising. In return the customer gets a dozen photos.

If the customer doesn't want you to retain the rights & they're paying money for portraits, is that ever a problem? I'm asking seriously. Besides I.D., the last portrait I've had was 30+ years ago for my high school year book. Will you work with customers you don't want you to retain the rights to their photos? Will any pro photographers? Before digital cameras I guess the customer could request the negatives, but now with digital cameras.... 🤷‍♂️

Jim Jones sometimes that is requested and I am okay with it. Usually it is a boudoir or lingerie shoot that the customer only wants her husband to see. It doesn’t happen often, but in these cases, I agree because I have plenty of other photos to advertise my services.

The photos were taken by a business for free so what did the defendant expect? I have paid for professional photo shoots for things like headshots, model portfolios and album cover. Although I paid for the pictures to be taken that still didn’t give me copyright to the photos. So the photographer and I had to draw up a contract where I paid so they relinquish the rights to me. Otherwise I could have been sued for duplicating the photos. Ever notice when you go places like Walgreens they won’t duplicate pro photos without documentation you have the authority? On the other hand I’m also a photographer/videographer but because I mostly did this as an employee of companies the companies own the rights to all my work not me.

As a photographer, I hate people like this. I also retain the rights to all my images and can use them as I please. Do I respect my clients? Absolutely. But I do have the right to use any photo I take in advertising my business. People are nuts. She got free photos done for her and she agreed to do it for advertising. I just can't. The Mum and her don't have two braincells to rub together between em.

I would never do business with you if you would assume total ownership over a product I have paid you to produce. If you want license to the images I am paying for then that is a separate clause in the contract and would require some accommodation or remuneration.

Like I said literally above, I respect my clients, but I do have the right to use my photos as I choose since they are my artistic property. That is the law. Would I use them if a client specifically asked me not to and we had come to that agreement before the photos were taken? No, I wouldn't. But legally I retain the rights to all of my photos.

I think the mom just wanted final say on which pictures she wanted the plaintiff to use for advertising. If I were a mother, I would also want that final approval on what images of my child go out to the world. But that needed to be clear in writing before the photo session. I'm not sure what the plaintiff is suing for since the segment did not reveal that.

Many years ago my company had a photographer come in to do pictures for a company brochure. I signed a waiver to use my image, was paid $10 by the photographer, and that was it. Ontario, Canada.

Defendant says plaintiff didn’t have a right to post the pictures. Ma’am, what exactly do you think copyright is? The photo owns the image, not the subject of the photograph.

Photographer holds the rights to the negatives, unless specified in writing. Its the photographers work.

So she always showed you the pictures beforehand… When the pictures were FOR YOU! This was a different scenario where they weren’t for the defendant, they were for her business! She can use whatever photo she wants to advertise for HER business! 🤦‍♂️ Plus she already had permission when the deal was made!

My best friend is a photographer and I would never taker to court if she asked me to take photos of my kids to advertise her business,once she tell me i would be like ok let get it done cause it’s to help my friend succeed, and as my best friend she has offered free pictures for my kids if I would like some

But she waived that right when she accepted to have pictures of her child taken for free for advertising. The judge doesn’t care about a technicality like that. It’s the photographer’s property. She can do what she wants.

I feel like it all started with the grandmother.... The daughter is going along with what her mum wants. They through away a friendships not the photographer

I do think there is a difference where she uses the pictures. If her son is the face of her company and all over the internet instead of one small poster on one small wall in a rural mall. It DOES make a difference and the photographer should have stated what she was gonna do with it. I would give permission to let my child be a model as one of the examples, but not as the face of her business.

Horrible... just Horrible... if that was her friend, why take her to court over pictures? Let me guess... was jealous that she started making money and now her and her mom wanted her money. Smh! Think it's mainly her mom who started the drama. Bet daughter was fine with everything, until her mom started given her feedback and input.
