Persico, the Colombo boss, represented himself during the Commission Trial in the 80's and tried the argument that the mob indeed exists but being in it isn't inherently a crime in itself. The other bosses did not like the idea of anyone, much less a boss, going on the record that their organization exists, but Persico saw that they had no other avenue to try to invalidate the then-shaky RICO indictment since a RICO of that magnitude was a big deal at the time while being sort of untested. Persico's argument didn't work and all those bosses and underbosses took 100 years each like men. It wasn't even like Persico was stupid to represent himself against the feds, especially in a case like that, because even the judge went on the record during his sentencing to say that Persico was one of the smartest people he had ever observed in his life.... and. how it was a tragedy that he chose the streets than succeed in the legit world.
