Thank you! This was so helpful and detailed unlike other videos I’ve watched. I have two questions if you don’t mind. I filed due to debt. I have been paying for a rental in another state that I don’t live in anymore for 4 months since I couldn’t break the lease. They demanded I pay them the last rent, and I told them I will pay them but to give me a week. They said they will put more fees on my account and notify their attorney since I won’t pay them right now. What can I do in this matter? Also, when it comes to property damage, they have been saying I caused issues to the carpet when the carpet was very old and stained to begin with and I have pictures! How can my bankruptcy case help me with these situations? I highly appreciate your help if you can. Thank you so much!

Have you already filed for bankruptcy, or are you considering doing so? The bankruptcy will discharge (eliminate) your obligations to pay the rent on that apartment in another state. The bankruptcy, in effect, breaks the lease, and you won't owe them anything. The property damage can be a bit more tricky, but they would have to dispute the claim in your bankruptcy, which is unlikely given the amount involved. Also, it is unlikely you intentionally damaged the carpet, so that shouldn't be an issue. The bankruptcy will eliminate that claim as well. In any event, these are questions you ultimately should ask your attorney.

We were on rental assistance. My wife is in treatment for cancer. Rental assist was poorly implemented and left most of us very large rent balances. Without bankruptcy I am worried a $25k judgment against us in eviction court will allow landlord to garnish wages seize money from bank etc. Seems to me we have no choice. That said it is likely my wife will not survive this which makes the whole situation very very unstable. This whole pandemic thing has ruined millions of lives. Worst part we rented here for 19 years without issues but who can beat COVID and cancer?

I am sorry to hear about your challenges. Bankruptcy WILL remove any liability for the monetary judgment. However, as the video explains, bankruptcy cannot really help with preventing eviction. It will relieve you of any monetary judgment obtained by the landlord (unless you committed fraud or intentionally damaged the property).

I am not sure what you mean? The point of the video is that bankruptcy doesn't actually help or meaningfully delay an eviction.

Question, what if a person has valid reasons for filing bankruptcy besides rent, and the tenant DOES intend to move but simply needs more time? The tenant will not have Feb 1. 2023 rent, but cant move by then,, &needs a few more weeks to move. The landlord is NOT open to negotiations, and will most definitely issue a 3 day pay or quit, then an unlawful detainer. The lease expired years ago,, & the tenant has been month to month without a lease. The tenant hasn't filed for bankruptcy yet... but does intend to file due to cc debt & back rent. Should they wait until the 3 day notice is given to file for bankruptcyso that it can be included? And if so, how much more time will filing when Feb 1st rent is due,, provide for move out?

That question requires specific knowledge of your state's eviction law to advise on the timing of a bankruptcy case filing. However, so long as the tenant has a good faith reason to file bankruptcy (e.g., has other dischargeable debt) and is otherwise eligible, then the tenant could file at the opportune time vis-a-vis the eviction to try to buy a few weeks. However, there can be a catch. The tenant should have another place to live lined up, and if it is a rental, have already paid the deposit. Any money saved for the deposit for a new place may be at risk in bankruptcy.

Got my word as a men I will subscribe if my question is answer ok I have a chapter 13 bankruptcy with debt stoppers the automatic stay is in affect do to me filling before the judge hearing which is Nov 17, 2022 if I ask for 30 days can I pay 3598 dollars? also landlord can’t evict me if granted 30 days and I could continue my lease??

My plain is to delay delay delay for atleast 30 days which is reasonable from the court/judge and repay 3598 back with in 30 days which I can my only question is can I ? Will the landlord be able to stop that ? After paid in 30 days am I able to keep my apartment till lease is up in April 2023 afther paying 3598 afther granted 30 days from automatic stay bankruptcy law?

The answer depends on where you are in the eviction process. Also, you have to be able to demonstrate that the money is available. Also, if you are already month to month, the landlord doesn't need a reason to terminate the lease, he can just give you the notice required under the terms of the lease.
