This was very informative, but to be honest I rather pay my agent to take me from seeing the home to closing, I want to be safe and not be a know it all and lose my money. However, I will always educate myself to best of my ability, but I feel safe in using a professional buyer’s agent and of course a professional Attorney. Thank you always for your wise wisdom, it’s helping us all.

My wife and I have bought multiple homes in multiple states so we prefer to qualify the properties so we are polar opposites. We can still be friends. 😊 Real Estate Agents imho are like pearl divers whose job is to shuck oysters looking for the next pearl. It's a money business and time is money. Education is the key. Agents Commission Rules are changing or are they ? Sorry for the rant but we stumbled upon this channel and my brain got worked ! 🎉😊

1. Some sellers will opt to continue to offer “concessions” that would pay the buyer’s agent commission. 2. Your Realtor/agent can negotiate compensation with the seller directly on the contract, just like a for sale by owner. There are those options as well. Thanks for the video.

As a seller listing my house FSBO and refusing to be in MLS i wont pay nothing to the buyer agent because when i bought my house years ago i went to zillow and search for homes on sale from the owner directly found it we went together to the Title company let my bank know about it they told me get inspection i did then after 28 days i i become the owner of the house . And done . I am willing to do the same thing by selling it myself not willing to pay nobody

With houses staying on the market longer, I expect sellers to continue to compensate the buyer's agent. Many first-time buyers barely have enough money to close.

Great video but WOW. By the time I find the property, arrange an inspection, understand what inspector found, argue about getting stuff fixed, review the contract and hire an attorney all without messing something up, how much have I saved? I used the same agent for my 2 properties (home & rental). She was good and argued with them about paying for the AC condenor and HVAC coils which would have cost me 12K at least. She even went to the inspection while I was at work so I didn't blow any vacation or sick days. The sellers paid her so I hope that remains an option. This sounds like me becoming a part time agent.

I tried to do this a couple months ago here in California as a first time buyer. Some of the listing agents will try to get you to waive all contingencies right off the bat. I ended up getting a buyers agent in the end. Just closed and even got a seller credit to cover most of the closing costs.

Most of my closings 4 percent total commission im in CA not sure why all these people think it’s 6%. I haven’t gotten 6% in like 10 years.

Assuming the agent handling the "contract to close" portion is doing the bare minimum (show you the house and make sure you dot your i's and cross your ts). What do you feel like is an appropriate commission or flat rate. say for a 500k house?

Wow Shaheedah this video was very informative. Basically it became even more expensive to buy a home b/c for now ppl would feel more comfortable using an agent to buy a home especially first timers...just until everyone becomes more educated.

Buyers can still ask a seller to cover their buyer's agent commission but since it the commission offered will vary by seller, the buyers agent will still have their clients sign saying if you choose a house that is not offering a buyers agent commission, you will pay them directly. You could say that you only want to see homes that are offering a commission but there will be some uncertaintly if there is a gap between what is being offered by the seller and what you have agreed to pay your agent. No licensed real estate agent should be giving out purchase agreement to ppl. Access to real estate transaction documents are only for licensed agents who have paid for that access.

A non real estate person can handle the contracts to a limit ...last time i got buyers/purchase contract those professional could not even fill out the blanks.

@@mprrx by licencing agreement with the company who owns the document, they are only to be used by those who pay for the service of using the documenta. Now anyone can go to an attorney and have a purchase agreement written but the one's a real estate broker who is apart a NAR or their local board aren't allowed. It's like giving your neighbor your Netflix account or a copy of your Microsoft software. It's technically against the agreement.

This is insane to me. All of these years an agent never charged buyers and now they’re having to. Such a joke, or a buyer has to go unrepresentative if they can’t afford it smh I’m glad that I already bought to skip. I definitely don’t know if I will buy again after this house.

I have 2 questions could I use one agent for a home and use another agent for a different home. There was an agent at the open house that was basically a family member to the listing agent, who is also best friends with the builder but I felt it would be easier to sign with that agent for that exact home but would want to sign with another agent who would also show me different homes. I only like the first one because of the benefits but trust the other one for any other home I want to buy???

You could, but if they want to sell the open house home, then they will often offer you the same benefits. You need independent representation...make sure you get it. If you find an agent to represent you, they may still offer to pay your agent. perhaps just a lower amount since you found the house on your own. If you choose to go the 2 agent route, make sure in the special stipulations of the BBA you list the address of the house, so they are only representing you on a house in listed in that specific subdivision.

Credit score has never really been an issue. They need to see regular money coming in from work and business. Then they need to see debt to ratio.

Waiting for prices to come down might seem wise, but it can actually lead to spending more later. As you wait, home prices will continue to climb, you'll need to borrow more to buy the same property. It is also possible for interest rates to rise. One item, or a combination of the 2 means you will end up paying more for the same home down the road. Acting now allows you to lock in a lower rate and secure a property before prices potentially rise further.

Yes, we will get through this. It will a new norm and interesting to see how sellers will react. I think if it's a balanced or buyers market, more people will will pay. If rates fall and we are in a sellers market then all bets are off.

Great question, but in my experience no. By law in most states you cannot pay a "commission" to an unlicensed person. The builders agent will likely just get the full commission since you are not represented.

That is a hard one, but if they are not a broker, you can contact their broker. If you still can't get a reponse, drop a letter to the owner - mail it and let the seller know you have tried to contact their agent with no response. @anthonydaniel117 Thank you for watching

Thanks!!! "Contract to close" is something I had not thought of .... we are looking in Texas right now for a home saving the agent the leg work. I just wish joe public had access to the MLS. So buyers agent is limited to 1% commission if listing agent shows property if I got that right. Sellers could offer concessions to the buyers agent in this Texas market - right ? Hello! Real estate agent in Texas here. The buyer’s agent fee is their fee. The 1% (out of area) fee is typically only applicable to agents out side of our association/MLS and this caveat has been removed from our updated forms. Limited service representation is banned by most brokers in our state, but a lawyer can review the contract for you. It’s important to note that they typically will not assist with showings, inspections, scheduling additional contractors, ordering surveys, scheduling or providing access to the appraisal, advising on repair requests or many of tasks required to get you to closing.

Yes, sellers can still offer concessions to the buyers agent, but they will on most MLS systems not be able to advertise what if anything they are offering buyer agents, your agent will have to ask them directly in most cases. You will have to in most cases agree in writing for your agent to ask for their commission to be paid by the seller. All fees are negotiable with the buyers agent.

@@ShaheedahHill Our forms (up until 8/17 when the new ones become mandatory,) allow us to offer different rates to agents inside and outside our association because there's no statewide MLS or lockbox system, making it harder for listing agents to provide access. Usually, if a listing agent shows a property for an out-of-area agent, the commission offered by the listing broker is significantly lower (theres no standard, but since you and the OP mentioned 1%, I wanted to provide more context.) This is because it means the listing agent will have to provide access for all showings, inspections, etc. The buyer would still be responsible for covering the difference in accordance with their buyer rep’s agreement. Buyer’s agents set their fee according to their experience, training, and results they provide. Buyers can absolutely choose an agent whose fee fits their budget but will definitely sacrifice experience and service quality. This can be risky and costly for consumers, especially first-time homebuyers unfamiliar with the process and potential expenses. Opting for a cheaper, inexperienced real estate agent, unlicensed transaction coordinator or attorney (they’re not full service in Texas) might save upfront costs but will definitely have long-term consequences… especially when negotiating against an experienced listing agent. The reality is that purchasing a home is going to get much more expensive for buyers. We need to be honest about this, especially as real estate professionals.

The agent that represents the buyer does not just fill in the blanks. What about when contingency time frames are up and the buyer is not ready? What will the buyer do? What about when the buyer is also selling (concurrent close & possible rent backs & home of choice contingency). Things can get complicated and attorneys to not cater to clients like a good Realtor will do. Guarantee the attorney will not be right there at the property the entire time. Let’s explain to the people that most of the time the commission (always negotiable for both buyer and seller, has always been that way) will be paid by the seller. Specially right now when properties are staying on the market longer. Of course that can change if the market changes. Most sellers will want to get the most buyers to see their home. Which means they will need to be competitive. 🤷🏽‍♀️

Filling in blanks were in relation to the contract only. The contract to close option will include everything except helping the buyer find a house. As these commission changes are implemented, buyers need to know all of their options and choose the best option. I will have another video soon that will explain all options for buyers. So why aren’t you saying that the buyer agent/buyer can’t negotiate that fee? In other words the contract was written to say the seller will pay X amount of dollars to the buyers broker at closing and funding. That’s not possible?

Because the seller can say that the fee offered is negotiable they do not have to list a fee on the contract at all for the buyer's agent. They have to list compensation to their listing agent but they can leave it open as to the compensation to the buyer's agent. All offers must be submitted and if that offer includes compensation for the buyer's agent, the seller will have to determine if they want to pay that amount or not.

The condo builder may be paying your agent, read what it says in terms of commission in your contract.

No, but it will depend on what agreement the listing agent has in place with seller. At at open house the listing agent will likely make sure to ask if you are respresented by an agent when you register, very similar to new construction. The NAR new rull will basically separate seller compensation from buyer compensation. In the past it was very common for the seller to pay the listing agent and buyer agent. 2:50 you can’t use the contract that builders have and can’t use the contracts the REALTORS use. These are not state contracts as in state gov. These are tailored towards your state laws but are exclusive to those who paid for them. At the end of the day, seems like everyone wants to do business without paying. I DIY a lot of things that are not complicated, or can cost me a lot with a small mistake. Real estate is one of those you want to pay for. Offering the wrong amount alone can cost more than your agent.

I am not suggesting they use the contract on their own, but to try to get a copy of the contract so they have an idea of what they are signing before they sign. It is not uncommon for new construction agents to send a copy of their contract to review before buyers sign. Many first time buyers sign contracts they don't review in full because of time or lack of understanding, our industry is one of the few that make it difficult get a copy of the contract before they sign. I used a Broker not an agent, negotiated flat fee 6k to buy a 435k home. Agent dont have much decision making authority because they work for a broker. Go direct to broker to save money.

Refinancing often comes with various fees that can add up. These fees can include application fees, appraisal fees, title search and insurance, attorney fees, and more. The total cost can indeed reach several thousand dollars, depending on the lender and specific circumstances of the loan. 8:32 - If listing agent shows the property and the buyer is going to make an offer WHY would the Seller agree to pay the buyer's agent anything? If Buyer wants an agent, they pay. That was the reason for the lawsuit and settlement, Sellers got tired of paying the other side's agent.

For the same reason sellers may offer to pay closing costs, to get their house sold. In sales if you increase incentives it usually increases demand for any product. Demand and supply plays a role as well. If it is a sellers market, less incentives will be needed to make a sale. Seller may offer to "pay closing costs", to get their house sold. All that means in non-broker speak is "lower the price." What I see is that it appears that buyers simply need to have enough resources to be able to pay their closing costs without "help" from the seller. That's the problem here.

I'm being told and have been told in the past if I don't pay top commission agents won't bring clients to see my home. We're being forced to pay so much money just to sell and buy. This is why they got sued. I'm California.

Unrepresented buyers have no obligation to sign anything but a Purchase Agreement and Lender docs. Dual Agency will become a legal nightmare.

You can use a Realtor attorney. You pay the Attorney a fee which probably will be cheaper than the agent.

2:50 you can’t use the contract that builders have and can’t use the contracts the REALTORS use. These are not state contracts as in state gov. These are tailored towards your state laws but are exclusive to those who paid for them.

I am not suggesting they use the contract on their own, but to try to get a copy of the contract so they have an idea of what they are signing before they sign. It is not uncommon for new construction agents to send a copy of their contract to review before buyers sign. Many first time buyers sign contracts they don't review in full because of time or lack of understanding, our industry is one of the few that make it difficult get a copy of the contract before they sign. I agree it will be difficult but not impossible. Thanks for watching and sharing.

As a homeowner, I would rather pay a real estate attorney to review my documents. Attorneys will be unbiased not the realtor because they want to make a commission. It’s also more economical to hire an attorney. A lot of them just charge a flat fee. When I purchased my first home, I had different realtors helping me out. All of them were very incompetent.

Your buyer's agent can still ask the seller to pay their commission as part of your overall offer, so you do not have to pay out of pocket. If you want to terminate your buyer brokerage agreement it is usually easy and can be done without penalty if you are not already under contract.

August 17th is when most MLS systems (where homes are listed by agents) will remove the commission section where they used to include how much commission is offered by the seller. But in anticipation of these changes many agents will have you sign updated agreements now. Thanks for watching.

As a real estate professional; many ppl don’t understand how imperative it is to have representation. Even at new construction…if you use the agent representing the SELLER; it’s like using your wife’s lawyer in the divorce settlement. Good luck!!!

I have bought and sold 8 homes and the bottom line is both the Buyers and Sellers agent do what they want! You have to do the Math yourself or 99% of the time you get screwed. I did better doing it myself at the last purchase BUT I knew what to do.

If the seller will not split the commission with the buyer's agent, the seller or seller's agent should be the one to find a qualified buyer. Ultimately, the commission comes from the buyer's financing when the deal is closed. Sure the seller receives less paying both parties, but the seller does not pay commission out of pocket. This new law does not favor buyers.

The commission is paid from buyer proceeds, seller disburse...commission is built in the selling price, unless I am wrong. Lies!!!

The commission is typically paid from the sellers proceeds from the sale, but you are correct that the money is coming from the buyer since they are purchasing the home, so it really is how you look at it. From the sellers side they feel they would make more money if they did not have to pay commission from the house sale. From the buyers side they are the party bringing the money to table either cash/financing or a combination so they could argue they are paying commissions in the purchase price.

I work with all the builders in SoCal. The seller pays the buyers realtor a commission. It's an easy sale for those agents because they don't do any of the work they would do in a typical resale. They get paid for bringing the client. Sometimes the buyers come in without the realtor and sometimes the builders will still allow their realtor to get added to the contract...a nice payday for doing virtually nothing. New home buyers DON'T NEED an agent...it's their choice ...and some smart buyers will split the commission with the agent on a separate agreement. I see it happening all the time.

So why don't you look for house that for sale by owner directly call the owner of the house and fix a day and time four a tour if you like it make an offer by texting the owner if the selle accept let your bank know and go with the seller to the nearest Title Comapny sing contcart with him so the home can go pending put deposit get inspection Email it to your bank then back up let the Title comapny and your banck handl the rest of the job when its time for closing your banck will call you and tell you what to do you will save a lot of money that way and dont have to pay agent commission be smart and educate yourself buyer

LENNAR is greedy in Orlando Florida they don't want to Pay the buyers agent. This is why America 🇺🇸 is GREEDY. I want to use mt Navy Federal Relator because NFC also gives me a rebate. But, LENNAR what all the 💰 Money 👀. They tell me, "You don't need a Relator." This is my 4th house. I always use a Relator buying and selling.

So I'm not paying a buyers agent any money out of my pocket under any circumstances. This is a 30 year commitment that is already expensive for me and a commission check for them. If a realtor tells me if a home is paying 2.5% and they get 3% and I have .5% to cover I would drop them as an agent. For the amount of time and involvement a buyers agent puts into helping buy a home they should negotiate down their commission. I get you'll want to make as much as possible but not at my expense be greedy on someone else's time.

The buyer agent brought you their pre-approved buyer. Where do you think your proceeds come from? The buyer. The buyer has gone to through the credit process and got approved to pay the seller hundreds of thousands of dollars and you think it's the best decision to have the buyer pay their agent on top of all of the other expenses that goes with buying your home. My thoughts are this will become a buyer choice and seller choice market meaning...... The seller can make the decision to not pay a buyer's agent 1 dime and the buyer can make a decision to only look at homes that the seller is offering to pay for the buyer's agent commission because they just don't have the money to pay the agent. They can go 2 houses down the street to your neighbor's home who is confidently willing to pay the buyer's agent. Also be advised that this could potentially mean your home could sit on the market significantly longer. Lastly, a home sitting on the market for several months could lead to a stale listing, Buyers will start to think something is wrong with the home. Food for thought.

They can negotiate their own commission with the seller, but only with the buyer's permission..because that may interfer with their offer getting accepted. But I do think when this goes into effect that with the buyers permission everything will be on the table, price, closing costs, commission and the seller will choose the offer with the highest net, if there are even multiple offers.

Hi Shaheeda! I have been watching for a while now and live your videos. My sister recently purchased a condo and was supposed to close on Monday. Unfortunately the broker stated they were not able to obtain a document from the property that she was hoping to buy and she was told by her realtor that she would lose all of her earnest money. She was told the sellers would keep it due to the closing date being missed but it wasn't on her end. It was the sellers property who couldn't produce the building report for the underwriter. IS there anything she can do since nothing was done on her end that prevented the closing? She was scheduled and then rescheduled. We packed her entire apartment up of 16 years.

I'm so sorry to hear this, your sister needs to go to a lawyer ASAP. Tell her not to sign anything terminating the agreement or releasing the earnest money until she talks to a lawyer. Depending on the amount of the earnest money it will be worth a consultation with a real estate attorney to see what her options are. Her agent should be able to recommend someone. Another garbage move in a garbage industry.. think about the low income families who struggle just to get a down payment now pay for the agent too if the seller wont.. unless its a banger deal there are very few circumstances where a seller is now going to pay it.. Laughable ..realtors already were bottom feeders but this is icing on the cake

It's not, it's just a video that gives options that buyers may have if they choose not to enter into a traditional buyer brokerage agreement. Most agents are looking for this video to explain how the seller can still pay their commission. This is not that video. 35 years in the game, you remember how it used to work.
