I think he is exposing you to something which may have been eluded to in the video (off shore) English Common Law if you can use Juris of the Land as discussed above allows you to avoid being subjected to and statutory (state) law

What kind of annual cost would an irrevocable trust incur? Some trustee fees mandate a large enough trust so the income of the trust covers the costs of management.

Informative Can you make a video that covers basic fees for various types of trust? I know there are variables and not exactly a one-size-fits-all. But a range on 1- Setting one up for this type versus that type. 2- Yearly cost we need to expect once a trust is set up, so we know what to expect. I see a great range online depending on the company setting these things up. Easy to not know what the ongoing (yearly forever) cost will typically be. Many people I chat with don't realize the ongoing cost and what those costs can be. More info on being able to Change or fire the people administering the trust would be cool as well. Thanks

What happens if you get a 3rd party person to create the trust(become the settler then assign you as trustee) then the creator resign off the trust? Now you can control it and you are not the creator

A non Grantor trust??? A Non Grantor, irrevocable, complex, discretionary, spendthrift trust, but who can set one up properly is the question?? You can't go to a regular attorney. They have no idea what you are talking about. They want to set a statutory trust.

What is the best trust to hide assets from all levels of government and potential lawsuits? One does not want any government to see what you have and take what they want nor have SS/SSI/SSDI tell you to spend down your assets.

Currently, 17 states offer asset protection trusts where the settlor can also be the beneficiary and enjoy asset protection. The trust must be properly established. US result-oriented judges, however, often ignore the law and simply rule based on their desired result. That is why offshore trusts fare much better.

I has signed something that at time the atty did not disclose what a irrevocable trust was later I told her verbally she was fired and i revoke,rescind my signature and I do not consent or agree on the part where she wrote in irrevocable trust i tried to write something also and paperwork which they have tampered with , this should be breach of contract she failed to tell court this and she misrepresented me as well due to this she has caused irreparable damage and harm as well as emotional distress to me and both my children . Is there something I can do or that you might be able to help me with this ?

New subscriber...I plan om doing alot of estate and asset planning in the next year. Still confused on If i'm activly buying items or maybe a business bank account can be in an irrevocable trust or not. Like I dont want my ex trying to touch ANYTHING regarding my business. Does that make sense?

Not having much trouble with the irrevocable trust I am involved in except the high high federal and state income rates. I would like to find a way to get lower taxes out of the funds in the trust.

Couple questionw: 1) I had my attorneys at the time (over 20 years ago) draft two offshore trusts, both irrevocable, originally established to hold ownership interests in various entities at the time. Both have a 100 year trust period from the date the trusts were established. Although the entities have come and gone, would I still be able to revive these trusts with some changes (i.e. appointment of new Trustees and Protectors, etc.) to own and manage current and future entities? 2) What are the tax consequences of an irrevocable trust owning shares of a C-Corp if the revenue the corp generates is retained for re-investment?

Feel free to contact us. www.assetprotectionplanners.com/ Offshore trusts owning domestic companies do not offer substantial asset protection as a US judge could dismiss the offshore trust and seize the entities. So, we have other means we employ. Offshore trusts work VERY well for other assets when structured properly. The C-corp pays its own taxes. So who or what owns it does not have much of an impact on the taxes on its own earnings. Of course, the law requires me to seek a licensed CPA before you take action on any of the above.

I would add Equity Stripping to the tool box- basically put a lien on your property in your LLC. Lawyers look at your title and see there is no equity to grab because your house has a superior lien on it (your LLC) Since it is your LLC, you can modify or take the lien off by filing new papers with the Secretary of State

Could the "settlor" not just be a special purpose entity like a WY LLC (single member, controlled by the trustee individually) to protect against judgements in states like CA from piercing the trust?

The trustee does not retain beneficial ownership of the assets of a properly structured asset protection trust. Therefore the assets are not exposed to their personal litigation. (The law makes you say this is it legal advice blah blah blah.)

If it is a residual beneficiary (only becomes a beneficiary of the trust assets when the settler dies) than it is OK IMO for that beneficiary to be the Trustee of an irrevocable trust before and after the settler dies. However, it is a good idea to allow the other beneficiaries the right to replace the trustee by majority vote.

And so when the settler is in the proper jurisdiction, one needs to be oriented with the laws, such as in California or in Nevada, and so then you have no practical reason to comply. And our trustees have never been penetrated. And the true beauty is if you’re in Iceland, you’re in a very good place.

No. Because it can be changed. Its a layer of protection, but if you die it can be changed. Irrevocable cant be changed, somewhat. The only way you can change an irrevocable trust is that the trustees and beneficiaries has to agree for the change. Look it up.

I have a question with some random numbers. If my wife and I have a so-call AB trust that have 4 houses as co-owners. When the first person of us died, his/her part (50%) assets become irrevocable. For example those 4 house worthy $2,000,000. So $1,000,000 will be under that irrevocable trust. After many years later, the second of us died and 4 houses worthy $4,000,000. All of these houses will be transferred to my kid. After a few year’s later, my kid want to sell these houses at the prices $5,000,000. What is the capital gain? $1,000,000 or $2,000,000? Thx you

There is the cost of creating the Trust, and then of administering the Trust if the law firm or trust company is also the Trustee.

@wordsaladd It may cost 10-$20K to set up the Trust, but the ongoing cost of having a firm be the Trustee of a $20 million Trust is sometimes a percentage of the Trust assets per year, but I believe this firm uses a yearly fixed fee that is more economical for a large Trust.

There are a lot of variables. Irrevocable is only one factor. Jurisdiction? How is the trustee associated with the settlor? How was it drafted? Call us.

6:46 HOLD UP, why would you add an LLC and have the settlor as the Member and Manager of the bank account, which allows you as the trustee to be compelled by a judge to move assets out of that account to pay creditors. This sounds like an opportunity for a rogue trustee.

Selecting a trustee is important, but being a trustee is a fiduciary responsibility and subject to criminal prosecution for any kind of embezzlement, and civil prosecution for negligence.

HE thought of EVERRRTRRRYTHING, within his Trust along with the Notary Public that helped him, an his wording, even down to him becoming INCAPACITATED, that I as his Sussessor Trustee, an EXECUTOR, can bypass going to court to have him CONSERVED as his Guardian, through court. He stated that the person named in #6 has full AUTHORITY over the courts. So you are absolutely, rigggght! Paying all that RIDICULOUS, money going through ESTATE ATTORNEY, an others PAYING all that money is although a Need, is a matter of studying, an wording, the facts to the BEST way possible, as it's the GRANTORS wishes of how their TRUST should be worded of a matter of protection an also lastly, it should not be based on someone elses PRECONCEIVED NOTIONS. ITS CRAZY, the videos, are here to help us, yet many I see are simply telling us they are not our Attorneys just giving some hindsight, info. And if we want to retain them, we may. I applaud every one of these Lawyers for giving all of us, the ends an out, on how these trust works, ESPECIALLY the ones speaking on Medicaid/Medi-Cal Nursing home protection, which are months and years of studying before their property ends up being taking advantage of with a lien, if one goes into NURSING. SO EVERYONE HERE PLEASE DO YOUR OWN HOMEWORK! A trust is a relationship, not an entity. It is the relationship between trustee and beneficiary.

What about when making the irrevocable trust you make that the trustee? How would this work? Do you have any thoughts or videos on this?

In order to be valid, I would put a natural person (human) or artificial person (a company) as trustee of the first trust. So, do to this, I would have, for example, XYX, LLC (Wyoming), trustee of the Apple Trust. So for the second trust I would have XYX, LLC (Wyoming), trustee of the Apple Trust, as trustee of the Orange Trust. Thus, I would put someone or something that can act on behalf of the trusts.

@@TheBusinessGuy I have heard that some of the largest $$$ people have theirs set up this way. This is why I'm asking. I'm not sure how the irrevocable trust would "act" as the trustee, when I set it up and "gift" it to this "trustee" would how I word the trust to the "trustee" be how it would be managed to "the beneficiary/s?

Can I roll over a substantial amount of my 401k to fund my irrevocable trust? I will add my house and other assets to the trust for asset protection. Though I am in good health at 65 I am wanting to protect my self from Medicaid and the 5 year look back that they have as well as the spend down of my assets to pay for the nursing home. Thanks.

401K, IRA's and retirement plans in the USA are usually not allowed to be in a Trust. You can name beneficiaries of those plans directly by filling out a Beneficiary Designation Form with the plan administrators, which sometimes can be done online.

Good question. If someone was inexperienced enough to own a car in the same trust that owns investments, that would expose trust assets. That's why we recommend holding safe assets (cash, stock) in a different legal tool than dangerous assets (cars, real estate) .

Hi, can I change irrevocable trust that was created 5 yrs ago? I put my bother as my beneficiary 100% of my monetary asset but now I change my mind ,instead of 100% I would like to give him 50% and the other 25% goes to my sister and 25% to her daughter. I lived in New York State,thanks

@@dustinwidger9838 common law trusts are private and non-statutory, which means they create their own jurisdiction... Statutory trusts are (which are not real trusts) are within a government's jurisdiction... A common law trust falls under article 1, section 10 of the constitution

so I've been studying law... when you say jurisdiction then talk about laws in different states, you're inferring that difference in state equals difference in jurisdictions. you are either lying or have been mislead yourself. there are two main jurisdictions; common law, and public law(commercial
