Informative Can you make a video that covers basic fees for various types of trust? I know there are variables and not exactly a one-size-fits-all. But a range on 1- Setting one up for this type versus that type. 2- Yearly cost we need to expect once a trust is set up, so we know what to expect. I see a great range online depending on the company setting these things up. Easy to not know what the ongoing (yearly forever) cost will typically be. Many people I chat with don't realize the ongoing cost and what those costs can be. More info on being able to Change or fire the people administering the trust would be cool as well. Thanks

Couple questionw: 1) I had my attorneys at the time (over 20 years ago) draft two offshore trusts, both irrevocable, originally established to hold ownership interests in various entities at the time. Both have a 100 year trust period from the date the trusts were established. Although the entities have come and gone, would I still be able to revive these trusts with some changes (i.e. appointment of new Trustees and Protectors, etc.) to own and manage current and future entities? 2) What are the tax consequences of an irrevocable trust owning shares of a C-Corp if the revenue the corp generates is retained for re-investment?

So, we have other means we employ. Offshore trusts work VERY well for other assets when structured properly. The C-corp pays its own taxes. So who or what owns it does not have much of an impact on the taxes on its own earnings. Of course, the law requires me to seek a licensed CPA before you take action on any of the above.

I would add Equity Stripping to the tool box- basically put a lien on your property in your LLC. Lawyers look at your title and see there is no equity to grab because your house has a superior lien on it (your LLC) Since it is your LLC, you can modify or take the lien off by filing new papers with the Secretary of State

If it is a residual beneficiary (only becomes a beneficiary of the trust assets when the settler dies) than it is OK IMO for that beneficiary to be the Trustee of an irrevocable trust before and after the settler dies. However, it is a good idea to allow the other beneficiaries the right to replace the trustee by majority vote.

No. Because it can be changed. Its a layer of protection, but if you die it can be changed. Irrevocable cant be changed, somewhat. The only way you can change an irrevocable trust is that the trustees and beneficiaries has to agree for the change. Look it up.

I have a question with some random numbers. If my wife and I have a so-call AB trust that have 4 houses as co-owners. When the first person of us died, his/her part (50%) assets become irrevocable. For example those 4 house worthy $2,000,000. So $1,000,000 will be under that irrevocable trust. After many years later, the second of us died and 4 houses worthy $4,000,000. All of these houses will be transferred to my kid. After a few year’s later, my kid want to sell these houses at the prices $5,000,000. What is the capital gain? $1,000,000 or $2,000,000? Thx you

In order to be valid, I would put a natural person (human) or artificial person (a company) as trustee of the first trust. So, do to this, I would have, for example, XYX, LLC (Wyoming), trustee of the Apple Trust. So for the second trust I would have XYX, LLC (Wyoming), trustee of the Apple Trust, as trustee of the Orange Trust. Thus, I would put someone or something that can act on behalf of the trusts.

401K, IRA's and retirement plans in the USA are usually not allowed to be in a Trust. You can name beneficiaries of those plans directly by filling out a Beneficiary Designation Form with the plan administrators, which sometimes can be done online.

An irrevocable trust can be revoked easily by trustee .

Thanks for watching Kluu. It really depends on how the trust is written. The most common changes would be requests suggested by the settlor to change beneficiaries.

Hi, can I change irrevocable trust that was created 5 yrs ago? I put my bother as my beneficiary 100% of my monetary asset but now I change my mind ,instead of 100% I would like to give him 50% and the other 25% goes to my sister and 25% to her daughter. I lived in New York State,thanks

@@dustinwidger9838 common law trusts are private and non-statutory, which means they create their own jurisdiction... Statutory trusts are (which are not real trusts) are within a government's jurisdiction... A common law trust falls under article 1, section 10 of the constitution

so I've been studying law... when you say jurisdiction then talk about laws in different states, you're inferring that difference in state equals difference in jurisdictions. you are either lying or have been mislead yourself. there are two main jurisdictions; common law, and public law(commercial
