I am from UK where the death penalty was abolished some 50+ years ago. I have never been for the death penalty. Listening to the pathology of what this little girl had to go through changes my mind.

Death penalty? Oh, well, i think he will live a little bit. He and his lawers would probably spend years on trying to appeal. All expenses covered by citizens taxes... Citizens will pay for his food... Something is definitely wrong here.

I am from the US and am usually staunchly against the death penalty. However, this case makes me questions my stance. I at least think this monster should suffer the worst life has to offer if the penalty of death isn’t carried out.

I really admire the medical examiner .. she clealry cares and in touch with the fact Cherish was a real person and not just a body to cut up and investigate ... I hope that she is such a lovely, kind, caring woman who did such a great job in her very very diffuser task, brings some comfort to her mother and loved ones, that she took so much care of their little girl, during the autopsy.

I don’t think there are too many Medical Examiners that would not feel emotions in cases such as these. I’ve seen the biggest of police officers fold when it comes to children being hurt.

I lost it when she talked about the bruising to Cherish’s chest being caused by sucking... that poor little girl! The terror she went through! I have so much respect for Dr. Rao... the fact that she behaved so professionally when she saw that monster naked is testament to her focus on justice for Cherish. I don’t think I could have held it together... it would have been hard for me not to damage him heinously!

This has got to be the worst of the worst cases! I watch trials constantly I have never seen a M.E act anything close to emotional as she did. Imagine the horror of having to do these tasks to the actual child. I have so much respect for M.E’s especially her! I’ve never seen anything but almost robotic testimony! This must of moved the jury an extreme amount

@Jessica I think what really got me is the fact that she has seen so many autopsy’s in her career. The fact that this affected her to such an extent not only speaks to the fact that she cares but to the horrible trauma that poor Cherish suffered. I just felt sick listening to it.

It is so difficult to even fathom. And he’s just sitting there like it’s no problem. He wouldn’t look at her autopsy photos. He should have been made to do so. He actually winked at a camera person. This is horrific brutality. I don’t even have the right words for this.

Anyone here against the DP, imagine the last hour of this little girl’s life, the torture, the pain, the terror and what he did to her. And he has been doing this since age 21, in and out if prison and rehabilitation programs, costing the taxpayer millions for trials, lawyers, appeals, upkeep, medical care, dental care, vision. I’ve been working in the field of law for 20 years. This is the worst violence I’ve seen. The devastation felt by all the first responders and the Medical Examiner was palpable. My heart hurts for this innocent baby. If only this monster could’ve been stopped before he got to her.

I have watched a few court cases on KZbin (not addicted) and this is the first time I have seen a medical examiner look and act so haunted by what theyhaveseen. Although I wouldn't wish that on anyone, I'm glad the autopsy was done by someone so compassionate.

He had a long record of arrests for pedophilia and was released from jail every time. His mug shots start when he was a young man. It's criminal that they released him after the 1st offense bcz as another doctor testified later, pedophiles don't change. She said, "all the medicine in the world wouldn't change who he was attracted to." He should've been castrated and spent life in prison. Whoever kept releasing him are also responsible. This child's death was preventable.

I simply adored Dr. Rao. Having been in Emergency/Trauma Medicine (ER/TRAUMA RN) almost 40 years, I have cared for many difficult, and very heinous, injuries to both children and adults. So, I don’t know how dear Dr. Rao gave such a sad, but fantastically perfect testimony without breaking down. I would have loved to have been a student under her guidance. This crime is particularly horrendous, as it involves killing a young child who thought she was going to get a hamburger and fries at McDonalds, which apparently was a treat her Mother couldn’t afford very often. 😢😢😢 Pedophiles are, in my opinion, the worst predators on this planet. I have never agreed with the death penalty, but in this case, I totally agree with the jury’s admonition. God bless and safely keep ALL children in this world from the foul evil of pedophiles, in Jesus’s Precious Name, Amen. 🕊🙏🌹💕

Donald Smith should have not been in the courtroom to relive what he did to Cherish Periwinkle- he’d be getting off on it. When the Medical Examiner was giving testimony on all the injuries and describing them in detail including the genitalia areas to the jury ....he should have been removed from the room beforehand...imho!

I have to say, I hope the lady in charge of the forensic report got a crazy promotional desk job and paid vacation for the way she served our public. Everything from, the autopsy, investigation and photos of “Don *vomit* Smith” and reporting in court services are so obscenely traumatic in this case. I don’t think I’d have had the strength let alone the willingness to do the job that day. I hope I would be able to, to do a service for Cherish, but I really don’t know if I could keep my impartial mind in that. I can’t see her as anything short of a hero! I keep watching her stoic testimony in en effort to see justice done. If that is even possible here. I want to thank her by sending flowers to her office but I don’t want to drag her back to that day. I wonder what would be right to celebrate her in this. But I hope if anyone’s reading this that does this job.... please hear my. Thank you. I’m a Mommy. I’m a daughter. I’m a human being. After listening to this M.E. Bless her heart and soul so much. I couldn’t imagine. As a mother. as a HUMAN BEING. I always wanted to study forensics and go into this field of work until I had a daughter, and realized that there is no way I could do what this wonderful woman can do. She is a hero to this little baby girl and I’m sure hundreds of other families. So much respect. This vermin doesn’t deserve the death penalty, the only right answer is to let mom and dad in a room with him for a day and decide how he goes and how quickly he goes. I’m quite the true crime junkie, watch trials all the time. This one brought me to my knees. I hope this woman was able to find peace after having to do her work on this case.

I have no much compassion for this doctor. The fact that she had to be the person to autopsy Cherish’s ravished body immediately after death and then come back in and testify in graphic detail what this disgusting excuse for a human did to this poor child. Her eyes speak volumes. The fact that medical examiners see the worst of the worst, but this case has such a profound impact on this doctor speaks to just how barbaric a crime was committed against Cherish.

@@lukassvensson2326 he dumped it. He didn’t want any evidence in his van. Rayne pushed the stroller into the van while on the way to Walmart. She left it inside of the van while they shopped in Walmart. It was still in the van when he took off with cherish. He wanted to get rid of any evidence so he just dumped it on that man’s lawn hoping it wouldn’t be found or connected to the case .

I am horrified by this. Poor Cherish suffered at the hands of this man who slipped the American justice system for far too long. Had he been dealt with correctly in the first place i.e jailed for life this would never have happened. Feel so sorry for the way she died. Her mother will have to live with that till the day she dies.

It isn't clear, did he kill her in the Walmart parking lot (which I think he did in the 18 minute lapse of time before the van moved) or at the church or did he just use the church as a dumping site? He'd been in Walmart for 3 hours so did he move the van to another parking spot beside the car with the couple who he said "We're going for Cheeseburgers...". I thought the husband said they were parked there for quite a while.

This is the first time I have heard of this case. No words can adequately describe the snake sitting in the court looking smug and probably reliving his crime against this baby and relishing his attack and how he enjoyed it. This is a DP case if ever one was. But if he gets life, my wish is for him to get some good prison justice. Unfortunately in CA here our governor has made child molesters a misdemeanor, so these creeps roam the streets everywhere in search for their next victim. They don't need to post bail, and murderers are actually let out on a very small bail, if any. I hope these creeps pay a visit to their families so they can see how the criminal are coddled and the victims are ignored. We are gonna see a lot more of cases like this with our liberal DAs who refuse to prosecute cases and let them roam free. I'm just disgusted at the torment this Angel of God went through. Rest easy little one in God's loving arms.

I watched this and cried my eyes out. And then sat my children down and told them AGAIN how dangerous people are and to never ever trust anyone or go with anyone. That they can never really trust anyone, except me and our family. Then it hit me, cherish did exactly that, she trusted her mother. Her mother is the person, the one person, who is supposed to protect her and use any and all her judgement to keep monsters away from her. And her mother failed to do that. He is a vile sick monster, but in my opinion her mother is vile as well. As a mother myself, I am sick and angry and DISGUSTED that this woman basically served her child on a silver platter for a trade off of money or clothes or anything. That woman didn't care. She had a bad feeling and ignored to because hey it's free stuff. Yes this man killed her, but he would have never had the chance if her mother had used a fraction of maternal instinct, and even attempted to keep her out of harms way. I hope they both burn in hell

I also agree that the mother was inadequate in many ways as a parent. However, she was also clearly very poor and very desperate; in her circumstances on the day that her child was abducted she was very vulnerable to the approach of a seemingly kind stranger who was offering to help her. Yes, I know, most mothers in similar circumstances would probably have maintained such a person at a distance and been guided far more by prudent caution and “instinct” - I am not sure Cindy if you have had an opportunity to listen to the 911 call that she made as soon as she realised that her daughter was missing. It is heart-wrenching because she says several times to the operator that she should have paid more attention to her gut-feelings about this person. Her trauma is palpable and the way she reproaches herself is very raw and genuine. This poor woman who had had to walk for 20 minutes (as she did not have a car) to the local Dollar store only had a budget of $40 to buy shoes and clothes for all three children. He offered to use his Walmart gift voucher to the value of $150 to buy what she needed for her children but could not afford. He presented himself as a Godly, married man who belonged to a local church and just wanted to be able to help someone out in need. Of course, alarm-bells started ringing - she said as much in her 911 call along the lines of “I thought that this was too good to be true” - but her desperate need to feed and clothe her children sounded louder in her mind than her own very well-founded suspicions. He also used the ruse of “my wife is meeting me at Walmart soon, so let’s go to Walmart and wait for her there.” Of course, the wife never turned up, but he continued to dupe her into thinking that she would be able to buy the shoes and clothes her children needed. She did begin to have serious doubts towards the end, but once again her desperation and false optimism overrode her suspicions, which she told the 911 operator that she kept dismissing as “paranoia.” He offered to buy them all cheese burgers from the in-store MacDonalds and Cherish followed him. She thought that it would be ok to let them out of sight because they would not need to leave the Walmart store to get the burgers from the in-store MacDonalds. It is easy to imagine how she rationalised this to herself - it was already well after 10pm and by then all three children were hungry. This is probably why Cherish was so willing to follow him to MacDonalds. I agree with you Cindy - it does come down to this woman’s multiple failings as a parent. He then just seamlessly led her eldest daughter out of the store. Her error of judgement will haunt her for the rest of her life. There really are no words powerful enough to describe the horrors her daughter suffered at the hands of this deeply depraved and evil man.

Crimes like these are now punishable by death in Florida. Unfortunately, this law came too little too late. It hits so much harder when it’s your home city, and everyone was powerless to stop this horrific crime. Her own mother failed her. Losing custody of her other children was absolutely necessary to guarantee the safety of the siblings.

@@valerie2827 This could have been avoided if this POS was kept in the prison system like he should have been. He took advantage of vulnerable people. Mom is obviously not right in the head. And she had custody of the kids because the dad was abusive and beat on them. He beat one of his girls so bad she wet herself. So smh. Everybody failed them, not just mom. I have compassion and sympathy for her. She's dead inside now if she wasn't already. And maybe dad should have learned some self control or he would have gotten custody!

Her boyfriend provided the incorrect spelling of Cherish, than she corrected it. She had the same boyfriend's money to buy clothes. I solely hope she's paying child support and had her tubes tied but we know it isn't the case

All doctors and officers, to some degree, are good at separating their emotional triggers while working through difficult cases of extreme violence against anyone let alone a child. The unbelievable part is that he was still permitted to roam the streets freely. He had a long criminal history and had been recommended for institutionalization several times. The system that let this monster go free to eventually commit this atrocity shares in the blame. Society failed Cherish. Her mother also failed her. Though I recognize she suffers from mental illness and was desperate, it still doesn't excuse letting your child go off with a stranger. There's no reason she needed to go with him. That was incredibly reckless. I honestly can't believe this even happened. Just heartbreaking and enraging.😥

This type of predator is the scariest to me… They come across as someone you can trust, someone who is nice and caring and kind, therefore, they usually don’t have to even use force or a weapon to get the victim to go with them or get in their car or go in their house. And then they don’t even have to have any kind of weapon to kill the victim they use whatever they have which includes clothing, shoelaces, hands, etc.

I advise mothers to be cautious when leaving their children with someone else, whether it be a stranger, friend, or even a relative. Personally, I only entrust my child to my parents, and even then, I sometimes have doubts. Trust your instincts and if you sense something is not right, do not hesitate to change your plans. Your child's safety should always come first.

I have an undying appreciation and admiration for the woman who has done the job others wouldn't, and is nowledgable and humble in playing the role we know we couldn't.
