Don't ever talk to police. Even if you are innocent and tell only the truth it will be used against you. All they have to do is find someone who disagrees with you to make it look like you are lying and the other person, though mistaken, has no reason to lie so you look like a liar and guilty of the crime. Never talk to cops. Period. It can't help you and only hurt you.

I learned that the hard way. I was at the station in an interrogation room, I thought I was giving a statement to help catch some robbers that attempted burglary and attempted homicide at my home; (as soon as the robbers broke in, I yelled and they ran out shooting.) Well, I was interrogated as a suspect, intimidated and coerced to give up my phone all to prove that I was the victim and not a suspect... All after attempted burglary and homicide. Very stressful day, I found out how unreliable police are...

If you get pulled over and your car has On star, turn it on so the operator is recording everything word for word. Also if you have a smart phone turn the camera on place it in the cup holder or passenger seat facing the driver window. Everything needs to be recorded. Don't trust a police report, they lie !!!

What he says is mostly correct (except you should ask "am I being detained" - not am I being arrested). Yelling is not a good way to teach people. I'm not stupid and I'm not your damn dog, I don't respect people that have no respect for me, yelling at someone is disrespectful and rude, don't talk down to me if you want my attention.

It's ridiculous to me that we can't even TALK to those who "protect and serve" without the expectation we'll be harangued, cajoled, coerced, harassed, or treated as a suspicious person. Every time a cop comes to you he's going to ask for ID, and he'll run it asap. Because, to him, you are a potential criminal and he will look at you like a criminal until he can't find anything to use against you. Sick.

2 city cops on foot patrol working under the 33pct supervision Washington Heights area approached me while standing in front of my private building. 1 officer " you live here" ME-- "yes" COP-- "can I see your ID" I handed the 1 city cop my ID, then right after asked me "why are you standing here" ME--- "Sir, I'm refreshing my mind from a long days work" COP---" at 1 in the morning" ME--- "yes" I work 24 hours 5 days a week" COP-- " 24hrs? with a stupid face" ME-- yes, I trade "currency" COP-- "stock market closes at 5pm", ME--- "Well; my market runs 24her's, mind you; the cop still holding my ID in his hand. The cop then decides to give me back my ID. COP--- "Good night sir" both cops walked away. Ive noticed most cops are not smart. Seems that NYPD are hiring Special ED students straight from high school now days...

I help my parents with all their computer problems. Sometimes I wish that stupid special ED teacher would see me now. She be ashamed of herself.

Mike- they were not stupid. You proved you had a reason for being there and you weren't doing anything suspicious. Standing in front of your residence is not suspicious activity. There was no reason to prolong the conversation. You could just as easily said nothing. You could even say you didn't want to talk to them. Valid ID is a good thing.

Familiarize yourself with local state laws about police stops. Stop and frisk laws allow police to briefly detain and ask for names (if and only if they have reasonable suspicion and probable cause to suspect a crime) and, if warranted, to pat for weapons - that's it - nothing more. A stop doesn’t necessarily justify a frisk.

macduggles Stop and frisk is unconstitutional ruled by the Supreme Court. Probable cause don't exist. They want to setup you up and put you in person. The u.s.c. codes clearly state the United States Government is a corporation.

Keeping your mouth shut is sound advice, but it will not prevent a cop from planting evidence or fabricating charges. This is the main reason people cooperate and talk. They know what these terrorists are capable of.

TrichsRUs this is why you must have a recording device and you must establish very early in the encounter , “what did i do wrong” “why am i being stopped” anyone of those questions politely will help if it’s recorded . Once you have that, they cannot say later that they pulled you over for something else that they make up, because of your attitude or a quota they need to satisfy. Say very little, but get why they are pulling u over out of the way, quickly.

its a shame that we can not live in a society where police are loved and looked at as people who teach civilians about their rights and really go after the bad guys whoever they are or wealthy they might be. instead we have cops that dont know the law themselves, who fear for their lives, dont know how to respect and serve, and care very little about facts.

Better way of saying am I under arrest is say if you are being detained. You can be detained without arresting you. Ask if you are being detained and why.

@@sirgreedy88, If you are lawfully detained you are required to produce Identification and be frisked in many states. To be clear that is the minimum standard in all states, but some states have laws that say you must be under arrest before you must present Identification. The point is... you need to be clear on if you are detained or not and whether the detainment is lawful in order to make the determination that you must comply or you can refuse to comply with providing identification, or being frisked. That is why the distinction should be made between detainments and arrests.

These days with a new court ruling, it is not advisable to simply not say anything. You should say something like "officer I respectfully choose to remain silent." If you don't explicitly state that you are exercising your 5th amendment right the cops might legally be able to arrest you for being uncooperative or some other stupid charge.

Tom Joneey I totally relate to where you are coming from, those scum-sucking thugs deserve no respect at all. I'm simply offering a choice for self-preservation. Cops are like rabid dogs, you don't want to make any sudden moves or they'll attack. So basically I'm offering the option to kiss their disgusting asses to keep them from getting hostile because they are always looking for the slightest excuse to escalate and become violent.

Unless you have committed a crime you have as much right to ask were the police man stays (what his address is) as he has to ask you your address. The police demand to know were you live could you imagine what would happen if you demanded to know were they live. So if they ask you can point out that unless he is willing to give you his name address and date of birth then you are not willing to give him yours.

me and my brother where drunk as sailors and fishing without a licence in a public area. the docks we fished off are closed at dark, so that was strike three. the officer rolled up all gun out flashlight in our face. I'm hispanic and my brother is native american, both white washed brown guys. Any way the cop asks what we are up to. we tell him testing our new reels and having a few beers. he ask if we are armed, we both tell him we have knives on us. he was totally cool and puts his gun away. he asks if we are on probation or parole, we say we are not. he then informs us the docks close at sundown. he asks if we caught anything, we laugh, not a single bite. he tells us we are kinda drunk and we agree, he asks where we live i tell him a few blocks down the road. he then brokers a deal, he wants to run our names and if they are clean he lets us off with a warning. few minutes later we get our ids back and he says we are good to go. long story i know but the moral is not all cops are out to get you and respect is a two way street. he had us dead to rights and was very cool. a night in jail would have been well deserved.

Sounds like a very amiable situation. However, you say you had three strikes against you. Let's see, you were sitting at a closed, but not fenced dock after dark (closing hours). So he had the right to run you off. Your ethnicity has nothing to do with it. You did not have fish by your side. Did you have bait? So you were testing your reels. No fault, no foul. The worst thing from that is a ticket. You were drunk in the vicinity of your home, not causing a ruckus and able to maintain a conversation with the police. That is not a violation of the law. The deal he brokered was to question you and get total submission to him, then he lets you off. You call that respect? I call that harassment of two people peaceably minding their own business. If the docks were closed and it was past sundown, all he could do is run you off (assuming you did not break in through a locked gate or something). Those are our rights spelled out very clearly in the constitution. We have allowed law enforcement to get more and more control with less and less over site. Many people have been screaming for generations that a police state will come if we continue to allow them to control us under the guise of protecting us. People think they are being protected... until it's them on the other-side of the taser or nightstick or gun. Then it is too late. Think about it, you just called your ethnic heritage a strike against you! That is not the free America the founding fathers had in mind, or we want.

I would add that public 'anythings' are funded by us, the tax payers, and the 'curfew' laws were ruled uncons. If something was made using our monies, and we aren't destroying it, how can we be made to vacate at an arbitrary hour? Most eastern and northeastern states recognize the right to hunt/fish/harvest even before the fed cons. Citizens cannot be required to procure a license before exercising recognized Rights.

He's right. I don't live in New York City, but I am not scared of the police. I am not a criminal, so I don't act like one in their presence. But, I am a member of the bar association and prepared for such a confrontation with police.

@@tonyball6863, Except those charges won't stick, and can potentially result in a lawsuit in your favor... that is better than you speaking and giving them something they can use against you in court. The police are going to do what they want to do... they will arrest you and drum up charges whether or not you speak or remain silent. You make it easier on yourself if you don't give them anything.

One thing he also he left out that is Important,you need to “Carry A Recording Device At All Time Leaving Your House”with you that has “Lock Password”,so they can’t alter the video or delete it,if you now right away especially at night when something has a-cured in the Night or Day time and your in that neighborhood,they will probably try to arrest you cause your their,if they start approaching you,take out your device,put it in your hand,set it to video so you can hit the record button right away,remember they always lie and without proof,the stupid ass judge will take their side,always keep that in mind,remember,it’s your word against theirs,don’t be dumb and leave your home without a “Recording Device With Lock Password”, defend yourself the right way.

I was in middle school (before legalization) and the teacher brought a police officer to the class for a drug speech. He handed out a baggie and asked every kid to smell the contents and said it was marijuana and wanted us to know what it smelled like. After every kid held the bag & smelled it he said he lied; he said it was oregano and he'd never give kids marijuana to smell. But he DID notice which kids knew it wasn't marijuana and later asked the teacher about those kids so he could investigate further. If at the time I realized what happened I would've told my guardians. It's never too early to educate people.

The practice of the Right to Remain Silent as stipulated in the Fifth Amendment of the U.S. Constitution it got to be performed as often as the Civil Citizen feels harassed, threatened, mistreated or so. You must to know and understand that the average cop is deeply insecure and have to exteriorize their sense of success by frighting and intimidating people so they can keep their sense of power alive. In the end is their uniform the one with power, without it they are no better than anybody else.

furyofbongos You are absolutely correct. Let me explain in a "hypothetical" case. Once upon a time, there was a person arrested arrested for traffic offense while sitting in a -restaurant eating. He had parked the car in the parking lot. There were no witnesses civilian or police to this incident. Police entered the restaurant and saw him. They took him outside and asked if they could question him He said no and made no statements. Believe it or not he was convicted. Why you ask? Despite the fact that he asserted his 5th Amendment privilege at the scene and at trial, there is a law in this state that holds that in the face of an accusation, a persons failure to deny the accusation amounts to an admission by silence. Despite the fact that his attorney argued the Right to remain silent trumps such a law, the judge admitted the officers testimony that he did not deny the accusation at the scene but remained silent he was found guilty. It is believed that it is not only dishonest police that do such things, there are others systemic side, who believe the whole system could be involved. Well that's the story, believe it or not.

Thank you for this. I have three nieces of mixed race that live in the city I grew up in. Unfortunately, there is little diversity and I know that my their mother wouldn't even think that this could happen there. Better for them to be prepared than ignorant of what could happen.

I've been advised by counsel that if pulled over or stopped by the police for any reason, turn on the overhead light, show your hands, do not get out of the vehicle, keep your doors locked, do not make any sudden movements, and do not say anything except hello. Do not hand over anything except a special card with the following text. “This interaction is NOT consensual, and is being audio and video recorded for my safety as well as yours. On the advice of counsel, I am invoking my Fourth Amendment rights and do NOT consent to ANY searches of my person or property. I furthermore invoke my Fifth Amendment rights and refuse to answer ANY questions. Please do NOT ask me any questions without my legal counsel present!” If pressed, start singing the song Cuban Pete or the national anthem.

Continue to ask if you are being detained, for what reason, and when are you free to go. It’s a good idea to have photocopies of registration, license, insurance, statutes, list of contacts, etc. The police will try to bully and lie if they can, be polite but firm! A favorite bogus tactic is to lie and say that they saw something in plain sight, so take pictures - a lot of them! Another favorite bogosity is to threaten with obstruction for resisting by not answering questions, don't fall for it! If you’re arrested for such then you got grounds for a lawsuit. Don’t argue! If they want to argue just give them your counselor's name & phone number! The police are not your friends; they will arrest you for any real or imagined reason whatsoever. They will seize your property and vehicle and force a forfeiture. Obey the law, no matter how asinine it may be!

It all boils down to confidence...taking the upper hand and not allowing the game to be played by THEIR rules. I have had many confrontations with cops and federal agents of every type and although I am not insulting or abusive to them I make it clear that nothing they say or do will change the actions I take whatsoever. Once they see it is useless to try and finagle you, they back down. I have said in the past to police : " Sorry Officer, but I am not allowed to speak to the police, only to my attorney ." And : " I will not answer any questions whatsoever, but if you want to submit your questions in writing to my attorney I am sure you will get a reply ". It confounds them when you make it a simple business matter, with no exceptions.I have at times had to remind cops that I would LOVE a chance to sue them in Federal court for violating my rights and that any violations would be most appreciated. I told one cop that if he was wiling to hand me money from a lawsuit on a silver platter it was much appreciated! Believe me they want no part of someone who poses a real risk of making them suffer.

in other words, don't be a snitch. if you see someone hurt, robbed, kidnapped, killed, just don't get involved. your day will be simpler. unless it's your own loved one whose the victim. then you'll want witnesses to speak up. When they don't, you get no chance for justice and the criminal continues to menace the community. is that working anywhere you want to live?

With testifiying in court the fact is cops can use you as a suspect if you are being a witness to a crime (maybe they suspect you but as a witness you will talk etc). So in the end this world (you see as negative) exists because of the cops not because of people who don't want to speak with them.

If you feel you cannot simply remain silent, respond with: "With respect, Sir, I will not answer your questions" - and if they come back with "Why not?" - give the SAME answer. Don't explain yourself. Don't be rude. "With respect, Sir, ..."

This is good advice, however this might not work in certain areas of the country(especially if you're the wrong shade), so make sure there's cameras and witnesses around before you try something like this.

What he was talking about was tghat a person has the RIGHT to NOT engage the police unless they are under arrest. And I've seen many instances where the police will engage a person, asking if they heard anything and in the same motion, the office will pat down the person that they are talking to without even "reasonable cause".

Don't just be quiet. Say something like "With respect, officer, I don't answer questions." If they ask why, just say "Right to remain silent."

That is a wonderful ruling by the NY court system but it still begs the following question: Why aren't they enforcing there rulings with the police departments so they will stop arresting people who walk away from them? It seems like the system doesn't work.

And yet we want the police to be able to find and arrest the actual criminals, don't we? If you have information that'll help them do that you should tell them. "Yes, Officer, I saw two guys running that way!" If it then looks like they're trying to pin it on you then you shut up and ask for a lawyer.

The problem with buying there book and knowing how to defend yourself is that there are new laws and changes in the current laws put in place to infringe on our rights annually. So next year by remaining silent and refusing a search you may think it's your right to do so, but you find out the hard way you have just given them reason to arrest you. For example the stop and frisk law in new york, 9 times out of 10 a officer will arrest you because you didn't submit to them even though they know you are not a criminal and did not commit a crime. Not to mention how willing a lot of officers are to lie to get an arrest. In court there word is believed over yours because a judge or jury would expect a officer to be professional and not lie to ruin a innocent persons life. Officers have been known to keep citizens from protecting them selfs by filming the incident claiming they consider there phone or camera a weapon. The thing is this is just not occuring in one city or one corrupt police department, but all across the country. That says this is a planned strategic government plan to control the population by criminalizing them and making new laws that contradict other laws and our constitutional rights. The fact is people are getting arrested for nothing everyday and even if not convicted these arrest go on there backround history and are considered guilty until they prove there selves innocent. Which is a huge time consuming process. The number of changes in laws and new laws constantly is ridiculous and it's not there job to inform us being unfamiliar with the laws is not a good enough defense. I guess we're all expected to know the law as good as any criminal attorney. So this book this video offers may help you not get mistreated or falsely arrested, but there is no guarantee from this level of police abuse we are seeing today. Unfortunately the poor and ethnic groups will be victims of this injustice because of the corrupt racial profiling and other groups who have not or maybe never will be victimized won't understand the frustration. Come on we have offers, detectives, and ex officers coming out saying this is injustice and corruption. This is not being made up this happens everyday. I could keep going but I have already made this comment to lengthy.
