very good. I am a lawyer and he's got it right. 1) always ask, "am I free to leave". keep on saying it. 2) I object to searches, I object to being arrested, I object to being detained. Whatever the police want to do, object to it; 3) if they reach for the tazer, say "I have a heart problem and you cannot Taze me" doesn't matter if you don't have a heart problem, if they Taze you, you will, plus a whole lot more problems. Women can say they are pregnant. I think I may be pregnant and you cannot Taze me. A woman can be between 12 and 90 and you can say this. 4) I do not answer questions, I do not answer questions over and over.

I cut it down a little bit because I don't want to have to explain myself. As you well know, cops are not the sharpest tools in the shed. As a matter of fact, they are often the dullest. Remember that phrase “outside the normal traffic stop”. Unless you have an attorney on speed dial, or you actually have something to hide, don’t antagonize cops.

our daughter was 16 in a car accident. The police dept called me because she refused to answer any questions. when i got there she as sitting on the curb. i walked up asked police was there anything else needed from her, he said she would not give a statement? Correct she is not required to and knows her rights. She handed them insurance card and DL. She texted me immediately. YES, she listened to us.

That's actually a bayonet. The round hole in the hand guard is for attaching it to the end of a rifle. 😀

School is so useless. Spend hours of time worrying over algebra homework that is not at all aplicable in daily life, but we wont tell you your rights, how to pay taxes, anything actually usefull.

Even you're afraid of upsetting the police or drawing suspicion on yourself, consider this... This advice is EXACTLY what police officers, attorneys, judges, etc. give to their own grown children.

@@lifeunderthemic Cite the case or go find someone else to play with. The rule is that a "suspect" must make a "clear and unambiguous" statement concerning their rights. To say a person has to state a specific amendment or use a specific set of words is ridiculous. What if under the pressure of an interrogation; the person says the *wrong* amendment? Like I said earlier "cite the case" or STFU. Also, where in this presentation did it say a person must use the specific amendment along with.... Never mind.

Fantastic info from an experienced atty, very useful when you’re upset due to a traffic stop or(?). I’m hooked! Bite size chunks of info and more to come. Body cameras will record the detail of the stop. Should we ask if they complied with the policy of having operational body cameras?

this is a very informative video as these situations happened to me as a 24 yr old. Cops pulled up on me while i was sitting in my car eating a burger and drinking a shake. They proceeded to ask me every single question you mentioned in this video. At the time i didn't know my rights so i went along with it and they searched every inch of my car and work bags... and when they couldn't find anything they called in a k9 unit to further search the car. I had to stand in front of the police cruiser while an officer pointed a gun at my face telling me not to run or else they'd shoot. They even took the burger i had and tossed it on the ground. After they still found absolutely nothing they were like "you're free to go " and they drove the hell off. No explanation. No apology. I felt so violated, i just drove home crying. All because i simply didn't know my rights being young. That was about 9 years ago.

I always tell them “ no dissrespect but i wouldnt understand the laws if you read them to me im not an attourney and it seeems like im in a bit of trouble and dont want to get myself in more trouble so i will plead the 5th and not answer any questions until i speak to a lawyer i feel like i could accidentally get myself in trouble cause i dont understand the way the laws are written and i dont want to say the wrong thing”

Love the series. I've watched this one in particular several times over the past few years but it needs an update to #2. It absolutely does matter how you ask for a lawyer. There's a case out of Louisiana a few years back where a suspect asked for "a lawyer, dawg" and the judge ruled against him in court. If there is any ambiguity the cops will pounce on it. Even saying WANT may be too unclear. Say demand or something like it instead.

Having listened to this attorney make his pitch, how would you like to hear some real world truth? I have been arrested, and beaten by the police, for insisting on a search warrant for my apartment. Then they took my keys, let themselves in, and searched my apartment. I spent about 27 hours in jail, and had to spend a bunch of money on an attorney to fight thru 2 court cases to keep me out of jail. Constitutional rights are great, but they don't mean squat on the street. Even the judge would not let my attorney talk about Constitutional rights and search warrants in the trial, told us that he would find us in contempt and throw us (my attorney and I) in jail if we raised that topic. These video attorneys can rant and posture all that they want. But the bottom line truth is that they will not be there when you have to deal with the police on the street and you try to stand up for your rights. And you don't have to have broken any laws to be arrested. Yeah, the attorney will be happy to take your case and represent you in court, as long as you are paying their hourly rate. Another harsh truth that you will probably learn? The truth and justice are not the same thing. Think about that one for a while.

You made a mistake hiring an attorney. If you fought it yourself and counter sued you could have won.

@@texasfossilguy One lesson that I have learned long ago, and this applies especially when opposing C&C Denver attorneys, (but I suspect would apply in any case where it is a private citizen vs the municipality) is that if you represent yourself in court it will not matter whether you are guilty or not, (right or wrong) you will be found guilty of whatever you have been accused of. In this instance Denver was offering 10 days if I would agree to plead "No Contest" (credit for the one day already served awaiting for bail to be processed, probably have to serve 6 more with good behavior). Why would I ever agree to any kind of plea? Especially if I didn't break any laws? Especially if that deal included time behind bars? That was to big of a risk in my opinion to try and represent myself again. If I had tried to represent myself, C&C Denver was bound and determined to have me spend some time in jail. The DA had come in to the courtroom and had a private conference with the judge right before the trial commenced to explain how they (Denver) needed me found guilty of something/anything so that I could not sue them for police brutality. That was why the judge would not allow us to raise the issue of constitutional rights and no search warrant. Denver was also gambling that I would not be able to afford to pursue this case beyond district court where they could influence the outcome. On that count they were right, I did not have the means to finance additional legal fighting. If you are poor, then justice does not apply to you as much as if you have money. So in short, no. Hiring an attorney actually did keep me out of jail. And several months later at a separate trial when Denver tried to have my seized property condemned, that same attorney was able to force Denver to return that property. And for the record, the seized property was a legally sawed off shotgun.

Many innocent people get harassed and r accused for something that they have not done, especially the minorities. Again thank you very much! If you consent to searches they can sesrch anywhere. If they have a warrent they are limited to the items listed. Makes a big difference especially if they're looking for a person. They can't look in you're jewelry box for a grown man.

I happen to live in Tulsa. So, just be clear. . . If I ask, "Are you detaining me?", I point the little sword at the police officer. But if I ask, "Am I free to go?", I wave good-bye with the little sword? Ok! Got it!

Good video, and I agree with you 100%! I was a police officer for over 24 years, then Workers Comp sent me to college, when a line of duty injury put me on the disability list. I became a paralegal, graduating at the top of my class, however what attorney in his right mind would hire a disabled former police chief who is over 50 years of age. A total wast of time, but it was a fun 2 years, and I learned a lot that would have been very useful if I had been able to get back to work as a cop. Now I am (presumed) retired by the bureau, they cut my paycheck in half, but still we have enough to return to our winter quarters at an RV park in Arizona. Anyhow getting back to your video, I loved it, wish I could get one of your cards, because people are always asking me about such things when they learn of my background, and they would save me countless hours trying to explain to just plain common nomads what they should do if they have an encounter with law enforcement, no matter what the circumstance. By the way, love the bayonet!

I'm so mad about my cat being locked in jail because she didn't consent to a search. I'm still trying to pay her bail. Jokes aside, there are more and more cops surfacing that they really don't care about any of this. Camera or no, they'll force themselves on you, threaten you and overall abuse their power. Also you sound like you can do a kickass hank hill impression.

Big warning at 5:44 do not use NO before saying I do not consent to searches. It could be misconstrued. Thus to the question : Can I search you car? Refrain from an enthusiastic NO. Just say I do not consent to searches. Very tricky... Thanks for posting.

What if you are asked to step out of the vehicle ? Do you do so? Also, what if the police officer proceeds to search you without your consent but you are not charged with any crime? What should you do to ensure your civil rights are not violated without repercussion? In other words, how can police officers be held accountable for unlawful activity?

jmoney262 get badge numbers, if they don’t have badge number then identification number (some cops don’t have badge numbers) get their full names and record it. Also ask for their supervisor and explain that your rights are being violated and also file complaints. Good luck

Outstanding advice. With regard to speaking and assuming the police are on the up and up, they are still human, subject to mishearing what you (the suspect) says or misinterpreting a comment. I would add, be polite. The danger here is that not talking WILL PISS OFF THE COPS. They may even "detain" you out of spite or frustration. Ultimately however they are not the district attorney and have to PROVE BEYOND A REASONABLE DOUBT your "guilt". Not only do not talk to cops, know your criminal justice system and rights.

I am still a minor but I feel its important to know my rights, but I just wanted to remind you that not all cops are bad. Just yesterday my dad, brother, and I met a police officer at a gun store. He was really nice and joked around with the employees and my dad. He was a good guy.

they are human beings, not all human beings are bad. but when any authoritarian figure approaches you thats when you should be defensive and practice your rights. remember, when they approach you, they had plenty of time planning their approach and they try to catch you off guard like a deer in the headlights so your weak and vulnerable.

That isnt how it works, im a minor too. When I say all cops are bastards I mean they're all part of the same rotten system, not that they're bad people individually. One bad apple spoils the whole bunch, and the police force is a basket with several dozen bad apples in it. Sure, that cop may have acted nice, but he's still probably going to work everyday, joking around with people that joined the force to abuse power and kick civilian's asses, arresting people on marijuana/ drug charges, etc.

I have seen a lot of these videos, especially in the last 10 years as we have been sold out by the Supremes. What I never hear is just saying; I am evoking the 5th and 6th amendments, which should be all that is required, followed by am I free to go to establish custody and a time line. It is not my job to try to teach a probable lower IQ officer the Constitution, nor is it even possible it seems in many cases. Excellent video - you get right to the point, thank you.
