This was the same debate during the Palworld release. Basically, every lawyer I saw weigh in said you concepts don't constitute IP. So, yeah, as long as the assets were developed by them (or probably purchased, in this case) the developer of Exit 9 is legally free to create a game where you spot anomalies in order to escape a subway tunnel. Disclaimer, though, I'm not a lawyer, just repeating the information I've gathered.

A part of what made Exit 8 so good is that it managed to make a scary experience by hiding very subtle changes in a bright and clean environment, making the player lose their mind searching the room. "The Exit 9" here entirely misses the point, making it a "dark and spooky environment" like every stereotype creepypasta game, with details that are far easier to notice. Wow such doge. Even Fortnite did a better job trying to rip another game off.
