It is a principle sacrosanct in most democratic societies that having once been tried for a crime and acquitted, an individual is protected from further trial: a person cannot be placed in double jeopardy. In the US it is a principle protected by its constitution. After observing this for 800 years, the British government abolished this in 2003. A handful of cases - some notorious - persuaded them that this was necessary. Perhaps the first of these was the case of the murder of Stanley Setty in 1949...

Mark, this was a masterpiece. Your work is sui generis. The character study in this case was particularly profound because you had a character almost worthy of your brilliance. An inventor, no less. You display almost telepathic powers, you recreate his worldview with eerie accuracy. You note his virtues, take his side when he is ill used. Yet when he says, self-indulgently, "I could have done so much" you note: "so could we all". That's the ultimate rebuke to the talented failure, and in this case deserved. He liked a mongrel. He was obsessed with a woman who was too good and too hot for him. Not entirely redeeming qualities. He was quick to shoot innocent bystanders. His bankrobbing skills were disappointingly quotidian. Men with less skill in improvising electrical appliances have strung together dozens of successful bank robberies. Men with lower IQs but more nerve. Our protagonist could not handle stress. Indeed, few unpleasant confrontations end in frenzied stabbing. You don't like your boss? Killing and dismembering him is not a practical plan - most of the time. There is the rare exception. Or there was in the mid-80s. High intelligence. Poor impulse control. A capacity for sentiment but a strange lack of empathy. You found a bird of paradise and more than rose to the occasion in painting his colours. Great art. Thank you.

Beautifully expressed, Robert - I am most grateful to you, and agree with you. A man on the verge of success in the late 1940s - he apparently sold 50,000 units of the Little Atomic Toaster he invented and produced. He was doing very well and employed as many as 50 people in his business, before disbanding and selling it up, squandering his money, and turning to crime. He really could not seem to help himself.

@@cthrew1603 I commend your alertness. I have a bit of a baroque sense of humour. My sotto voce "suggestion" was that I'd had a difficult boss in the mid 80s and was more fortunate in dispatching him than Mark's protagonist, who did 8 years as an accessory. Actually my boss in the mid-80s was a prince who survived my employment for three decades. But I appreciate your close reading and question.

There is zero evidence that Hume had high intelligence. His school reports show that he was a very poor student.

Whatever trauma he suffered, he was still a murderer. In law it doesn't matter the nature of the person you killed. You should be tried the same, and receive an appropriate sentence, if found culpable. Getting angry with someone is no excuse. If you do feel unloved and insignificant, killing a person, is not exactly the best way to redress those feelings. One might feel some sympathy, but he's hardly worth crying over.

Well, what can I say? Here is yet another fascinating and gripping true crime story conveyed perfectly by Mark John McGuire!! I was only thinking the other day that I am so ready for another "They Got Away with Murder" story and bang, there it was!! I am supposed to be doing chores this morning but have just sat transfixed, listening to Mark's rendition of this case. I had never heard of this story before and hate it when it ends. I am always hungry for the next one!!! Please keep them coming Mark, this is truly the best true crime site on KZbin😀👍

Hume seems to have been alone as a child and he died alone.....what happened between his birth and death was simply his war on the rest of the world, which had always disappointed him. Worse - he had disappointed himself! For a man like Hume to be poor would have been intolerable....so a fantasy world was needed! Except, two persons actually died at his hands as he pursued his fantasy. Mark, your presentation was honest and extremely sensitive. Your art work simply excellent. Thank you as always.

For a man who had the intelligence to have gone far, this is a sad tale. His crimes cannot be overlooked, he twice committed murder. Had someone in his formative years actually cared for him, pointed him in the right direction, oh what a different story his would have been. Adults don't always know the damage they inflict on a child. Maybe they are as culpable of the life he ultimately led as he was of his crimes. No one will ever know.

Strangely, in many of these cases, the villain looks villainous. Hume has a pleasant face. His sad childhood must have turned him into this monster.

I felt more than a tinge of sadness for Donald Hume despite his criminal life and double murder. Maybe it's because of his rejection all round him when young but he was master of his own destiny! His great intelligence channeled so badly! Mr MJM you told this story so well, I was riveted. I was born 1947 and vaguely remember the name from my dad talking about it! I was engrossed in my mid teens with my new job, a boyfriend and the excitement of being a young adult. I now want to read the book of his life although your narration cannot be equalled! Thank you! 👌👏

Another great episode. An earlier version of "If I had done it, this is how I would have " a la OJ Simpson. I will say this on double jeopardy in the U.S. specifically. Murder is not a federal jurisdiction but state (generally) and in fact is tried and investigated at the local municipality level on behalf of the state. I have lived in many small towns and rural counties and there is plenty of room for those local authorities to abuse their power and harass individuals they don't like. So being able to endlessly re-try someone for murder every time "new evidence" (which they decide) comes to light could be easily abused. So in this way the scales are tipped to protect the innocent sometimes at the cost of letting the guilty go free (as with other laws). The law is not equivalent to justice but only a system of recipes that attempt to approximate it.

Many thanks for this thoughtful comment - I had OJ Simpson in mind throughout as being the most famous modern example of someone benefiting from this. I share your view on double jeopardy: in the UK The Criminal Justice Act of 2003 abolished a principle of English law which had stood for 800 years - largely due to 2 cases which had caused considerable public anger. It seemed to me to be a shame to discard a cornerstone law for the sake of 2 cases. Although there are supposed to be safeguards in place to prevent abuse by the authorities, in practice it places the decision as to whether or not to prosecute more than once firmly with the Director of Public Prosecutions... "New evidence" is, of course, always available - or can always be found, because only a part of the evidence obtained by police is used in court. This has removed a basic right from the British system of justice. I am glad the US (as most democratic systems) still maintains this important principle - the small number of people who escape by its means is worth the protection it gives to the majority.

The very limited removal of double jeopardy under very strict rules in the UK has led to the public being protected from rapists and child murderers and used in a handful of cases in over a decade. I am very glad that the innocent majority now have protection from them. I am sure the individuals shot by Hulme would have wanted the same. The "new and compelling" evidence must not have been available to the original prosecution and the first trial is only squashed by the Court of Appeal who also require that such is in the public interest and a fair trial is still possible. No prosecutor can decide alone who gets a re-trial. The scales are not a one guilty man goes free to dozens of innocents get jailed, the scales are frequently one guilty man goes free and several innocent women suffer/die.

He didn't have potential. His school reports show Hume was a very poor pupil. The only person who believed Hume was intelligent was Hume himself.

Another brilliant documentary, Mark! What comes across more than anything, is the relentless commitment and courage of you to connect with an audience, you put so much effort into communicating real meaning, to keep your audience interested for over an hour by your well researched interesting story, beautifully written and excellently narrated. Your unique , mesmerizing voice creates a positive vibe of energy and interest in your audience. Details documented and period photographs, and illustrated too by your wonderful sketches as always. You have your own original and a recognizable style in everything that you create as a poet, artist, composer, musician and writer! Your documentaries underscore your higher-order thinking and literary skills and your great intuition. You give the facts, and you do so in an analytical and logical fashion. That's why your documentaries are of a high standards. I would note that I feel sympathy towards Donald Hume. Sympathy doesn’t mean approval. The question of how he became that way can justify empathy for him. You digged into the history of his life, my heart pained over so many of those so sad stories about him. His feelings of rejection and being betrayed made him bear a grudge against society. If he had a normal childhood, who knows what famous writer or artist would come out? According to you : ''He was an intelligent person, he had made model airplanes as a boy. He wrote a thriller, short stories and was a talented artist too.'' As you rightly pointed out: he sabotaged his good fortune. I was touched when you disagreed with a Swiss psychiatrist's opinion that Donald was incapable of love only hate , you categorically said- ''that is incorrect'' because he had loved : his grandmother, his dog, his daughter. etc. I think that inside he was not bad because dogs can sense from a human's energy that they are "good" or "bad". It is a type of sixth sense. His Tony loved him. I can see you also feel sorry for him, it means you are seeing the bigger picture. Sympathy means we see the murderer as a person with a history, with feelings, with a sense of helplessness so big that the only solution was murder. Thanks for sharing this fascinating documentary, Mark! As Mark Twain said: ''I apologize for such a long letter - I didn't have time to write a short one'', Mark! ;)

I am always surprised people will listen and watch for an hour, which rather places me in the same category as yourself and Mark Twain, I think! I agree sympathy does not mean approval - it is possible to disapprove strongly and still sympathise... I find personally that the more I know of a person the more I sympathise with their situation. Donald's love of his dog certainly acts as a contrast to the terrible things he did - it doesn't excuse them, but it counterbalances the way we regard him. He wept when he heard Tony had been put down, and he went to the Daily Mirror offices especially to get a photo of his old dog...breaking down while he was there... No-one is all bad, it seems. Or all good, of course!

Absolutely intriguing from start to finish. I couldn’t help but feel some sympathy for Donald. It seems that the classic signs of a personality disorder were prevalent from childhood and without any guidance, what could have been a creative member of society, tragically spiralled into notoriety. Ultimately this does not pardon his behaviour, but there were several mitigating factors, which rounded the edges of this evader from justice in sharp contrast to many of the shady characters we have seen in past episodes. On a lighter note, I was pleased to note that the Swiss in their ever-productive ways did [not] endorse capital punishment, but I couldn’t help wandering what the “hard labour” in the Alpine confinement would have included. Far from the stereotyped Alabama chain gang digging away on the sides of a dusty road, I imagine that Donald’s sanity finally deserted him at the prospect of spending the rest of his life putting holes in Swiss cheese.

Gripping tale. Wonderfully written and narrated - I think this may be your best yet! I have to say all my sympathies are with the people he shot, in particular the Zurich taxi driver who courageously tried to stop him. And poor Tony, of course! Thanks very much for all your hard work, the result is absolutely top notch. :)

I guess I can not understand why the torso had its hands tied behind its back. This detail is not accounted for in this story. I bet the whole story is not known though much of the conjecture is compelling. Thank you for this very entertaining look back!

Thank you, Ted - I do not know why his hands were tied behind his back. According to Sidney Tiffin, when he released the cords on the floating package, the torso floated out with its hands tied behind its back, but they came loose from their bonds immediately... It is possible, therefore, that he was mistaken and the hands had become tangled with the cord. Alternatively, it may be that Hume tied them post mortem, as a means of carrying the torso - or just keeping them out of the way. If they were secured properly, then it would certainly be possible to place a different construction on this matter...

So thrilled to see this in my suggestions! Your narrations bring such class and intrigue to the stories. Donald truly had a difficult life growing up and searched for respect and acceptance. It seems that he was his own worse enemy. Poor Mr. Setty had the misfortune of passing through Donald’s orbit and lost his life most violently. Thank you from central Florida.

It isn’t often I feel sorry for your subjects(actually this is the only time), but I feel rather sorry for this man. It sounds as if everything and everyone was against him from the day he was born. I realize that doesn’t condone anything he did, of course. At least he liked animals, and his dog loved him (so sad the dog was put down). I wonder if he had gotten a job working with animals if it would have been the saving of him! Excellent presentation as always; you are a genius! Thank you.

Another brilliant video Mark....thank you. I have three comments; firstly, how ironic that Setty was most likely killed on a settee (sorry, couldn’t resist), secondly, the man messed with the guys wife AND kicked his dog, I myself, the most even tempered, non violent person in the world could resort to murder for the latter! Finally, I believe that his wife could have slept through the event as my hubbie always says that I would be the only survivor of a zombie apocalypse as I would sleep right through it and not hear a thing. I certainly don’t believe that she didn’t notice the aftermath of the clear up though as I would notice if an ornament was out of place never mind the carpet being removed, the floor being stained and the couch being scrubbed! Thank you for your devotion to your work Mark, it makes my day when you bring out a new video x

Setty had a steady girlfriend to whom he was devoted. There is no evidence, other than the word of his killer that he ever kicked the dog. Setty was known as a genial generous man and had many friends. He is wrongly villianized in this video.

This Donald Hume reminds me of several of the characters in Herman Melville's novels. They are, as he was, bound by fate to follow their nature and can do nothing else. Like Ahab going straight towards his doom in hunting the white whale or like Bartleby the scrivener, who has lost all interest in life.

What a wonderful surprise! You're back, and with a spell binding story of a very complex character. Your opinion about the sequences of Setty's murder seem the most likely. Hume's story, seems to have always been a sad one, where nothing, even crime, was successful. Obviously it doesn't excuse him, but it's interesting how much he knew himself and his motives. Yet knowing it, he still chose the path of villainy. Thanks, Mark. This was fascinating. Kudos, and welcome back!

Thank you very much, Bilinda - yes, it seems to have puzzled the kindly Swiss judge also: "If you knew you were going to fail, why did you do it anyway?" he asked. It may be asked of many of Hume's actions, I think!

Mr Maguire, your work is simply impeccable...not to mention the excellent simplicity of the crime scene drawings. I'm old enough at 78 to remember bits of the Donald Hume case and the incredible Fleet Street connection. No spoilers from me! Your thirst and lust for your subjects reminds me of the Edward Lustgarten B movies of the late 1950s, early 60s. Don't let it go entirely to your head, but I think in many respects you're even better than he was. And he set the bar very high indeed. Keep up the great work.
