And this is why you get a lawyer. She thought that if she kept repeating her lie over and over that it would become the truth. Her "best friend of over 10 years" completely destroying her narrative was hilarious. If anything her friend's testimony actually proves that she is the abusive one. The best part is that Mr. Allen didn't even have to say ONE WORD.

I really like this judge's style. He kept control of his courtroom and spoke calmly and clearly. The witness was extremely helpful. And Ms Smith is her own worst enemy.

As a DV survivor, she pisses me off. She's using the pain of other survivors to create a story to get revenge on this man. I don't buy for a second he ever abused her. If anything, I think she's the abuser. The way she talks about his "tiny" waist, the way she glosses over the story etc. She's another Amber Heard.

I cant believe she passed out on the toidy! I mean…that’s shameful and embarrassing at that stage. She’s not a spring chicken college kid it seems. Can’t really estimate the age of the ex. I’m in my 30s and the thought of drinking by to oblivion makes me bones ache 😹

There is no behavior that justifies DV. I used to think if I just behave differently I would not be abused, but that is simply not true. I do think unless drunk, most victims wouldn't deliberately enrage the abuser.

@@snippetsordinarylife Agreed, but unprovoked DV is very different from trying to become a "victim". Don't poke the bear and cry when it bites. It's common to provoke the person then not let them leave. I personally know a woman, my sister, who in every relationship purposefully provoked 2 men when she was wanting to leave the relationship. In order to prove how horrible and in the wrong the other person is for personal sympathy and legally, to get a restraining order so they can't come back into the home so she could keep it. And as I said, it's become quite common for people to use this tactic and it is a shame because it takes credibility from those actually abused. I'm sorry you were in that situation.

@eternity7477 it's not justification. It's proof that she's a liar. Victims of domestic violence are typically abused unprovoked. They aren't going around doing things that they know will provoke the abuser to attack them and when they do something that provoked them, it is usually something small, and they don't continue to do it. This is common sense. I don't know how you could possibly claim otherwise.

I caught that about it already being swollen. And it's not nerve pain that causes swelling. The pain could be caused by some inflammation but That could just be caused by water retention.

She is huge on the contradictory statements lol. Lawyer: "Did you ever think to call the police? Why didn't you call the police?" Smith: "Oh no I didn't and I wouldn't ever call the police unless I felt like my life was in danger" - immediately followed by: "and you know what? I did feel like my life was in danger" ......okay!? So why didn't you call the police!!! This is what being mentally and emotionally unstable looks like. Poor guy having to deal with this.

So, let’s get this straight: 1. She grabbed the guy’s ‘waist’. 2. He ‘flings’ her hand off of himself, ‘hurting’ her. 3. Repeat previous steps two more times. She can’t take the hint? And why would any logical person grab someone they were afraid of?? THREE times??? “… he’s very strong… they don’t realize how strong they are… “ Umm, who exactly is, or are, “they”. Dare I ask if she’s profiling, to put it nicely? NOTE: If your bruises are yellow, this means that they will soon be completely healed. This final stage of healing is characteristic of the yellow hue. FUN FACT: The drywall used in a residence needs about 10 Newtons force to punch a hole in it. An average person, with no martial art training, throws a punch in the 800-1200 Newton range. - BG

I love this judge, I bet he’s a blast in real life! In regards to the bowl cut lady, I think we’ve all encountered wackadoodles like this in life and there’s no getting through to them. It’s frustrating. Her friend seems like a really sweet genuine lady though. Poor thing got wrapped up in this mess, but props to her speaking the truth to her recollection and not just defending her friend blindly. That’s actually a good friend there! Hopefully this doesn’t complexity flip as I’m 3 quarters the way through

This will shock you but it's not just women who are victims of domestic violence, many men suffer from domestic abuse but very rarely say anything. Also statistically women in same sex relationships are more likely to be the victim of domestic abuse than a woman in a heterosexual relationship.

There seems to be one piece of testimony that would completely tank her story: if he grabbed her wrist and she was crying in pain, why would she then touch him two more times and endure excruciating pain thrice?

Exactly. So much pain that she was instantly crying but everyone keeps on enjoying their night anyway while it happens two more times. It isn't beyond the realm of possibility that the other two are lying about what happened either but as the one pressing the case the burden of proof is on her and she did a piss poor job of providing even a single shred of evidence.

I had to petition the court for a no contact order because my ex-wife was harassing me with unwanted phone calls, emails and texts. There was no fear of physical harm but she threatened to cause a scene at my place of employment, etc. When we came before the judge, I kept my mouth shut, allowed my petition and evidence (emails, texts and phone records) to do the talking for me. I only spoke when I was asked a question and kept it as brief as possible. She constantly interrupted and corrected the judge, talked incessantly and was loud and emotional. When the judge finally said to her, “you like talking over people, don’t you?” I knew my petition would be granted. Keep your mouth shut, be stoic and terse. Never interrupt the Judge.

My mil had court by zoom and she was so worried about learning how to work it so, I suggested that my husband and she use zoom to iron out any issues and it really helped her. Sure…it took 3 weeks but she wasn’t quite as nervous about it.

I know a person like her, its caused them to become isolated as no one wants to be a human punching bag. Its like this with them: if they don't get what they want, they become vindictive going as far as making serious and damaging false accusations in retaliation! My sister had wrist surgery, and her arm looked EXACTLY like that for over almost 2 months.

@sixxygrrl7332 people don't typically go to prison unless there is some kind of evidence or confession. As a mother, I would be careful what I call false from my child unless I was present. Not saying you weren't there, but as a mother, this allegation makes me cringe.

Thank you for this one Squishy! Many years ago I was asked to be a witness regarding a similar situation that a friend (well, ex-friend) was involved in. In front of her lawyer(!) she began telling me what I should say if I went on the stand, and I immediately told her I could not lie or fabricate evidence.

I am a survivor of brutal DV and SA which I went through for 7 yrs. An abuser doesn't start that type of abuse on a 2nd date, which she claimed he was verbally abusive on that date. I don't believe a word of what she said. If that truly happened that way, her best friend of 10 years most certainly would not be on that man's side. Ms Smith's story make zero sense. She stated that she and Ms Plusser went to her house to stay bc she was going to leave her boyfriend the next day and that's why her BFF was with her. Yet she claims she couldn't have asked her friend to leave with her, or better yet her friend who supposedly witnessed physical abuse hadn't intervened by calling 911 or getting her out of the house, after she was the person who told her she needed to get away from him? Instead, she got angry at Ms Smith and left her alone w/a man who supposedly caused her physical harm. Ms Smith is lying thru her teeth and as a survivor of DV I find it so offensively disgusting to lie about such a serious issue.

She was drinking on top of medication to the point she passed out in the bathroom and needed help. I think it's very possible he shoved her wrist away, but the event was amplified and misconstrued. She also doesn't seem stable even while sober. Judge Davis is excellent and accurate in his ruling, imo.

I have CRPS, and haven't touched a drop of alcohol since I began taking the medication for it. We can't mix alcohol with those drugs. The pharmacist, doctor, and bottle of medication say so. Often, people have a pain management plan they have to sign that promises they won't drink while on the medication. As an RN since 1998, I know the dangers of drinking with the meds (death). I started on percocet, tizanidine, gabapentin, and temazepam. My doctor has now added morphine and topamax, and changed the tizanidine to baclofen. Imagine those medications combined with alcohol. No wonder she needed help off of the toilet. It's a miracle she remembers any of the night, and woke up at all, if she's on the medication she says she's on, because she also states she's on antianxiety medication and antidepressants on top of those. This means she has built up a tolerance to combining alcohol and those medications. That's why she can't drive. I hope she never does. Scary.

Honestly as a person who works in mental health what I hear is a person who has been through significant abuse/trauma in the past and now has an overactive trauma response. That means that is someone slightly raises their voice it triggers the memories of what has happened in the past and feels like it is happening again even though it isn't. It suggests that this lady has been through a very tough time and needs some significant support. Often these people end up in relationships as they feel they cannot cope alone, but then end up in situations like this or in situations that do involve DFV.

Yellowing of bruises is a sign of the bruising healing. Yellowing happens towards the end of bruising. I had tendon repair surgery on my index finger knuckle at the hand and it was yellow towards the end of recovery.

I honestly think that she believes she was abused. This could be due to trauma from her dad along with being with an “super compassionate man” for 20 years. She already had a swollen wrist, according to her testimony. He may have grabbed her by the wrist to remove it off his waist but then through her life filter, along with her chronic pain, she talked herself into it being “abuse”. Being on narcotics like she is also lowers her pain tolerance substantially. Her friend probably saw she was overreacting and seems to have had to put up boundaries.
