@@jayray1714 Disney said her "social media posts denigrating people based on their cultural and religious identities are abhorrent and unacceptable". The defamation part of the trial is disputing that any such thing happened. She said the culture war was being used to divide and dehumanize people, just like 1940s Germany used small social differences to divide races and religion. Where's the denigration? Also Pedro's tweets are exactly relevant to the discrimination case; a male co-star also made inflammatory posts, but got away with it (because it was company endorsed rhetoric). One who is just a actress with all the ingredients for a lawsuit, another is a celebrity CEO who will potentially upscale the stakes then take it as far as it can go based on his influence in Gina's decision. She has a solid case but Elon can make it worse for Disney and they can only gaslight and pretend this is a non-issue despite the fact that they are shady enough to have dirt on them that Gina may exploit. At this point, it's not about the money, it's about covering their asses from their reputation getting any worse than it is. Disney WAS too big to fail but somehow had the stars aligned and failed themselves in ways that defy the bounds of logic based on their persistence to pursue political agendas that has already been exposed.

The big smoking gun here is that Pedro Pascal had previously done exactly what they claim they fired Gina for - repeatedly, before _and_ after Gina did it, and with nowhere near the same level of respect and dignity that Gina did it. Seriously, look at Pascal's tweets and selfie videos talking about Trump supporters. The guy is unhinged and full of rage, hate and malice. He outright says "people who like Donald Trump are Nazis" with glee and venom. Pascal has faced exactly zero consequences from Disney for his history of this. This is the part that Disney is going to have a very hard time explaining in court - why only one of their actors was fired for something they both did while the other wasn't even reprimanded. And in our current political cIimate, the fact that the one who was fired is female while the one who was given a pass was male is only going to make it even harder to explain, especially for a company that has made "fighting misogyny" their main core brand value over the last decade. To be clear, in a perfect world I believe Disney has the right to fire whoever they want for whatever reason they want. I also think if Disney wants to be an openly partisan political organisation ie anti-Trump and anti-Trump-suppoters, they have every right to be. But Disney deny being partisan and claim partisan politics had nothing to do with Gina's firing. Furthermore, Disney have spent the last decade screwing others over in the name of these values they themselves have violated, so the issue here is really about Disney's hypocrisy, inconsistency and quadruple standards, so I'm all in favor of seeing them suffer for this.

In a sane world nothing Gina wrote would be seen as controversial but we don't even live adjacent to a sane world.
@yewtewbstew5478 ай бұрын
Well realistically any time the treatment of Jews in WW2 comes up, or especially gets used in comparison/metaphor, people get their panties in a bunch. So in that respect, I would argue that what Carano said WAS controversial. But 1) It was significantly less controversial than the similar post made by Pedro Pascal, and he didn't get fired. And 2) just because what Carano said could be considered controversial, doesn't mean it wasn't true. Also Disney's assertion that her comments were "denigrating" to minorities was a bunch of dishonest, emotionally manipulative crap. Nothing about what Carano said denigrated anybody. She just made the point that people shouldn't hate each other for their political views, and that continuing to do so could lead to worse things. Which is a perfectly reasonable opinion.

This whole situation has led to me developing some real interest & respect for Elon Musk. While I still dislike most of what he does, this push of his is looking good. To help people like Gina who have been wronged by overly powerful and corrupt companies over personal opinions. To push out the crowds that are destroying entertainment and social culture. And knowing he is a self-propelled force that cannot be bought or influenced by money. I may regret this in the future, but Godspeed you Musk.

It's not the firing that is legally a problem. You can fire anyone for any reason(unless they have an ironclad contract). You can fire them if you don't like the shoes they wear. What you absolutely can not do is slander someone you have fired and call them a bigot. That is why Disney is in trouble here.
@jackinthebox3018 ай бұрын
It is, actually. California state law says it's illegal to fire an employee for their political affiliation. So she's good from that angle too.

@@jackinthebox301 Learn something new every day. That seems like an astonishingly sensible law. I just wonder how often/fairly it is enforced in a state like California.

The last time he joked about buying something he brought it. In order to make it too expensive to buy the company Disney will have to start making money again which means it has to make good entertainment again. If they keep failing he'll be able to buy them. Either way Elon wins.

Extremely, especially for Disney. Though.. doesn’t matter much, her contract ran out, she wasn’t fired.

It was my understanding that Disney simply didn't opt to renew her contract. That's a lot different than getting fired. Defamation is a different charge, but that may be harder to win. I don't like either group, frankly. Carano and Disney can walk off a cliff together as far as I'm concerned. Neither of them give two shits about me.

Mirror-verse. So many times in the past several years it feels like there was a massive transporter error and reverse people came into our universe. People are doing actual evil things and think they are the good guys. Saying you are about freedom, then trying to destroy someone who tries to be free. Saying you hate corruption, then backing the most corrupt people they can find. Saying not to discriminate, then discrimination at every turn. ETC. Mirror-verse stuff.

Well if you're at home using Twitter or Facebook or even GAB what you say off the job is not your employers business. Unless you're employer is paying you 24/7 hourly wages which I doubt any company would do that. I mean even a butler has days off, so firing someone for something they said on social media is utter bullshit.

I think this is great. I think Disney has gotten very comfortable with the way that they treat people and the things that they do because they know they are so financially secure that nobody will ever really stand up against them. Having the financial backing of someone like Elon Musk is a huge benefit and I don't think Gina is the type of person who's going to back down or settle. She more than has a valid case and I believe will see it through all the way. I think we're seeing a trend beginning to start that I really appreciate where in cases like Amber Heard versus Johnny Depp and Evan Rachel Wood versus Marilyn Manson that we're not letting people get away with defamation and character assassination anymore. This could very well be a historical turning of the tide and I'm here for it
