Mute buttons shouldn't even exist on body cams tbh. They should have an audible alarm every time they're turned off that lasts for 15 seconds too. That way NOBODY can claim they turned it off "on accident".

I was wondering how many posts I was going to read before this point was brought up. As soon as he asked for an attorney the rest became unlawful regardless of the outcome and became inadmissible by the agency against the man and became evidence in favor of the man wrongfully arrested.

@@rzu1474 because FAA investigations go onto your Federal file regarding your pilot's license REGARDLESS of the outcome of the FAA investigation. There is NO assumption of innocence involved. If the FAA investigates you then you are presumed guilty even IF it turns out to be a bad DUI arrest and the charges are dropped. It's about the safety of airplane passengers. The FAA wants to make sure the aluminum tube hauling people at altitudes higher than 10k feet is being controlled in a safe manner

The clean blood/breath tests proved that this cop was (at best) mistaken or (at worst) lying when he claimed to "smell an overwhelming odor of alcohol".

the guy is accusing him of being drunk. So he cannot sign it if he is intoxicated because he will not understand what he is reading or writing. A person who is extremely drunk cannot sign a legal document such as what he was given.

@@crimpers5543 That only works if you know you're going to be asked to sign something. If you are voluntarily intoxicated and then asked later to sign something, your signature isn't valid. If you know you have to sign something and then you get intoxicated your signature can still count

Meanwhile I’ve seen careers destroyed , adults losing custody of kids; and people going bankrupt trying to fight it. It’s a sick practice and the police chief defends it. He doesn’t see anything wrong with 20 citizens getting arrested and charged when they hadn’t touched a drop of alcohol. He says that doesn’t mean the arrests were unlawful are done in malice. I beg to differ.

@@karinaz8756 As long as they keep getting paid for it, they're going to defend it and continue to do it. Hospitals were doing this too with the coof, by the way -- they got more money if they had more cases, so what happened? Little Johnny cuts his knee on some glass, goes to the ER, and it's filed as coof-related to get those numbers up. Many schools have this problem too where they get more money if more kids graduate, so they'd pass kids who don't know what they're doing so their funding isn't reduced. This is why you don't attach monetary incentive to things that affect others' livelihoods. All you get is a den of liars looking forward to that bonus or budget increase.

Let me repeat myself- people have lost custody of their kids, gone bankrupt fighting to clear their names, lost careers , spent nights in jail , when they haven’t touched a drop of alcohol. And your response to that is - oh well whatevs? That takes boot licking to whole new level. When you give men with marginal intelligence, and low moral character power over other people you wind up with corruption. We want ACCOUNTABILITY. You know what’s lazy? Charging and arresting people that haven’t touched a drop of alcohol. Explain to me how that’s actually helping the drunk driving problem. When cops are spending their time and energy processing innocent people- how many drunk drivers are getting away? Guess we found our dumb comment of the day.

That should have sealed any 42 USC 1983 lawsuit filed in the District of Colorado for the plaintiff. The officer was clearly on a FISHING expedition, having harassed the motorist, who slowed down and pulled over into an adjacent lane to avoid being tailgated by an impatient driver, and then was "traffic stopped" on the basis of his reaction to being bullied on the road. The officer then goes through a scripted and obviously FALSE "song and dance" about Elias having a "strong odor of alcohol" about him, then, after Elias does as he's lawfully allowed to do, that is, REFUSE the FSTs, immediately ARRESTS him w/o having probable cause. Later, when pressuring Elias to sign the blood draw consent form, the officer tells him he had "reasonable suspicion", which is a standard to INVESTIGATE, but NEVER to ARREST. Clearly, the officer is either poorly trained on evidence, investigation, and arrest procedures and standards, or he simply disregards them, in pursuit of "trophies" and/or promotions. It keeps going downhill once the breathalyzer test is administered, and Elias repeatedly blows "triple zeroes", because THEN the accusation changes to Elias being "under the influence" of an UNSPECIFIED intoxicant, w/o any evaluation by a "drug impairment specialist", to continue the investigation and holding Elias under arrest for DUI. Then Elias is wrongfully badgered into consenting to take the blood test, which he'd ALREADY declined in favor of the breath test, and threatened with the "DUI refusal" even though he'd ALREADY complied with Colorado law and the "implied consent". I hope Elias sues the living shit out of the City of Loveland and that corrupt cop. That was one BULLSHIT DUI arrest.

I mean they do every single day. They are corrupt and full of nepotism in my town and other small towns around me. A judge in a town like 20 min from me got caught stealing cocaine from evidence rooms and seeking it as well as doing it. He was allowed to resign with his pension. A judge in my town went down to a Sunoco with the local sheriff bc the Sunoco worker caught the judges secretary shoplifting. The judge had the cops arrest the women and she went to jail for 2 damn months. Took like 3 years for anything to be done about it. Not one cop had anything happen even tho they know they illegally arrested someone and the judge was allowed to retire with his pension and all. A borough cop in my town named Ace winters got drunk one night, broke into a guys house and beat him with a baseball bat in the middle of the night. He thought the guy was fucking his wife. Turns out the cop broke into the wrong house and beat the wrong guy. The cop was allowed to resign and went like 2 counties over where he’s got hired as a cop again. This is just what I know about in my small town. I live in waynesburg PA. People here don’t have the money to fight these tyrants. Everyone here knows the prosecutor and DA are also dirty and are honestly just asshole shitty people for no reason acting like they are better than others. It’s just frustrating. Don’t even get me start on probation and how you’ll have six months of probation and it turns into 5 years like me when I never once committed another crime, passed every drug test and always showed up when told. They still violated me for anything they could make up to make me pay even more money to behind bars for 6 months at a time and then restart my probation time all over. Fuck the government and everyone a part of it. I wish them the worst life possible.

@@lostboy2637 I agree. I was a teen in the early 1970s and worked graveyard in convenience stores in the later 70s, and ran into that constantly! I never did any drugs, never even once tried weed, very rare for a teen in the 70s, but I was regularly pulled over and my vehicle illegally searched by crooked cops in Memphis who were looking for drugs. What I still find curious though is that in about two dozen searches, only twice did the subject of the gun in the vehicle ever even come up. One was when I was asked directly if there were any weapons in the vehicle and I said "I work graveyard in a 7-Eleven in the worst part of Memphis! Of course I have a gun in the vehicle!" The 2nd time the crooked cop found it and asked and I gave a similar answer. What I today find curious is that I know the gun was always found, it wan't really hidden. But none of the cops cared, they were looking for drugs. And I wasn't even living in the state! I lived across the state line, and in those days the law in Tennessee ignored the constitution. Carrying without a license, which I couldn't have gotten anyway because of my age address was technically illegal, yet I was never once charged with that. And frankly, at the time, I never expected to be. In my mind I wasn't doing anything wrong or unreasonable. And I was right! But today, looking back on it, I am a bit surprised that the crooked cops with no regard for the constitution never arrested me and only brought up the subject twice.

My father was in a similar situation where he was accused of driving under the influence of alcohol. He blew zeros, and they then insisted he was under the influence of drugs. He was then taken to the hospital and forced to give a sample via catheter and blood was taken. His license was suspended indefinitely, truck impounded, and all cash removed from his person. It took almost 16 months before the courts ever had a record of this arrest. Upon going to court, they had no record of the tests as they were negative and discarded. They then re scheduled another court date and said they found the test results. We showed up and the judge asked the prosecutor why he is being charged with DUI while the tests were all negative? The prosecutor stated that the officer then stated that he knew he was coming off drugs. They then dropped his DUI charge and asked him to plead guilty to to an impeding traffic charge as a means to justify the arrest. The prosecutor demanded the judge find my father guilty of impeding traffic. The judge stood up for what was right and actually tore in to the prosecutor and stated that it was malicious prosecution and that it was the kind of wrongful arrest that costs the government money. All charges were dropped and a lawsuit was filed on my father’s behalf. Unfortunately my father passed before his case was heard.

100%, I've said it before. ALL police body cams should be controlled by a federal agency. They should go on when cops go on duty, and only able to be turned off after their shift has ended. Cops should have ZERO control over their body cams, or any footage after the fact.

I think officer body cams should mark instead of mute and should only stop recording when plugged in to recharge. Record everything let the officer mark different things on the video (bathroom breaks, personal information, etc) and let the department manage deletion and muting. I figure some deletion will need to take place for data storage purposes if that's deleting old video or deleting idle time I think that would be ok but I think that should be someone other then the officer on scenes decision.

The financial incentive came from MADD (Mothers Against Drunk Driving) to encourage arrests of drunk drivers. MADD awarded him a placque for 1622 drunk driving arrests, but they never checked how many of the arrests were let go because there was no physical evidence of any real impairment due to alcohol or narcotics. As this video shows, unwarranted arrests / being falsely accused of drunk driving can lead to life-changing outcomes for those wrongly accused.

I live in Washington and crossed into Idaho for a roofing job and not 15 min pass the state line, I got pulled over (unfamiliar with the area and roads, I guess the road turned from a 45 to a 35 but the sign was mostly covered by a overgrown bush and the cop was maybe 100 feet past the sign hidden) anyways I wasn't gonna argue my case to him so I accepted the 10 over ticket, then he comes back and asks me how much Marijuana is in the car, I anwser truthfully and say none, he continues to say there is no way as the smell of Marijuana is just pouring out of my vehicle, so after I won't admit to there being weed in my car he asks when the last time there was weed in the car and I again awnser truthfully (because it's legal where I live in Washington) and say it's been atleast 6-7 months since a friend had a little in his pocket when I was with him and I dont smoke myself, he pulls me out of the car, 2 other cops show up and im sitting on the cops bumper while he tares my car apart looking for this non existent weed even though I never gave him consent to search and a dog was never ran and when I said don't you need my consent or a dog hit or a warrant to search my car and he told me no not in Idaho. He spent 45 minute going through everything in my car and ends up finding nothing cause there was nothing. He was so corrupt and obviously fishing. Wasent just that cop either, while I was sitting on the cops bumper another cop standing next to me so I wouldn't run asked me what was going on so I told him that this other cop thinks there is weed in my car and there isnt and said my window is down, go smell for yourself and he walks towards my car and turns back to me while still being 6-7 feet away from my window and says "whoa dude, yeah that definitely smells".. lmao such corruption. Luckily i didn't have anything so they couldn't catch me with their fishing. Got my 10 over ticket and was let go, inside of my car a fuckin mess with everything spread all out

If hedid smell alcohol and two blows came back 0.00 case closed and not "I smelled alcohol but the test comes back 0.00 so it MUST be drugs". This cop is a disgrace. Look at the release rate of 83%. He is randomly pulling people over without cause and then fishing for a violation. It's cops like this that give policing a bad name and unfortunately the nature of the work attracts power-mad assholes.

I disagree. The reward should be the same punishment that would have been received if the driver was found guilty. Cop not only gets terminated, but gets a sweet DUI on his record, gets driving privileges suspended, and fined whatever the going rate is (~$15k).

@@Freyii I don't see why they shouldn't be allowed to use marijuana odor when it specifically comes to DUI if they are able to use alcohol. I guess of course odor is less correlated with amount consumed and impairment than with alcohol (and IMO odor of smoked vs unsmoked cannabis is relevant and somewhat distinguishable too, although maybe not to the degree that it would be accepted in court or believed by a jury). 5 ng/ml is a very low limit and since it is per se I feel like most people would fail if they recently smoked marijuana (of course today thc-free cannabis is becoming more common).

I can't get over what an unaccountable monster you have to be to continue fucking with this guy's life after he blows zeros and proves you wrong. Just let the fucking guy go home and move on with your night. There's nothing wrong with being proved wrong, there is something very, very wrong with deciding you're going to deny his request for an attorney and then start fishing for something, anything you can pin on him because you're mad that you were wrong.

That right there should have been enough to put the cop on administrative leave pending dismissal for lying. Zero breathalyzer means that his perception of an overwhelming odor of alcohol was a bald faced lie. And that he continued his questioning after the defendant asked for a lawyer? That should have been immediate dismissal, no questions asked. Loveland PD is corrupt, and the FBI should be called in on this.

@@adcolt54 the driver should have told the cop that he already complied with the express consent and an invasive procedure like drawing blood needed a valid SEARCH WARRANT. Because the express consent is EITHER/OR it can't be used for a second test. Period. The exact verbiage on the Express Consent form is LEGALLY BINDING on the cop.

I thought the initial probable cause was valid. Hell, I thought he was drinking by the way he was acting, talking, open container in the car, etc.... But officer Gates seems to have too much pride not to admit he's wrong. That's what got him in trouble, plus, that part where he wouldn't let ole boy read the consent form and just slapped the cuffs back on him was jacked up.

It reminds me of when i go to the doctors office or the time i had gotten a loan from a bank. The person will say,"and this form says blah blah..." But they get irritated when i read it for myself before signing instead of taking their word for it 🙄 no one should ever sign ANYTHING legally binding without reading it first.

Cop said he had an "overwhelming odor of alcohol " But the breath test results were: " the cop is lying". Now that the cop knows the driver has 0.00 % b.a.c. he starts saying it was his maneurisms that indicates some other intoxication. It's scary to think that such cops exist!

This officer was a teacher of mine in the police academy… he’s one of the main reasons I decided not to pursue the profession.. he introduced himself as the “DUI God”. He usually wasn’t prepared for class and when the academy director was unhappy with the class and our understanding of the subject he taught (report writing) he blamed the students and had a 20 minute monologue about how disappointed he was in us… He might be one of the worst people I’ve ever been forced to be around. Loveland will be better off if he’s not on the force. So sorry for this man, he deserves better care from the civil servants in my hometown.

4 years ago this exact same situation happened to me in upstate New York when an officer claimed that I had clearly been drinking because he found empty beer cans in the saddlebags of my motorcycle which I had picked up as litter on the side of the road I was given three breathalyzers consistent zeros on each one when I went to court the district attorney told me because I was unlicensed at the time that I may be able to beat the DWI case which was absolutely false but if I made him look bad on that he would hang me on my unlicensed operator it's now been 4 years since I've been able to drive is this legal? The only reason the DWI case stuck was because after passing three breathalyzers two on seen passing all field sobriety tests and then passing one more breathalyzer at the barracks I refuse to take a blood test

@@Justin-rk3yb that’s crazy I currently have a pending court date I was arrested for dui first they smelled alcohol I volunteered to do sobriety testing they said I was borderline I argued they arrested me when we got to booking I blew triple 0 they were so mad they got a warrant and took me to hospital and took my blood I only tested positive for marijuana but I do smoke and have a card had none on me and he didn’t smell that he smelt alcohol. My lawyer thinks it might even be dismissed day of court but I’m curious to see how this plays out I feel so violated. And having a dui even pending has cost me my job too …

i cant say this enough over and over again, police should never have the ability to turn off or mute their body worn cameras. these actions conceal vital information that could clear an officer of wrong doing or provide information to clear the person under suspicion. i hope the guy reads this .........i hope you take the operational budget of the department ,multiply it by the number of minutes you were held hostage/captive and sue them for that amount. they quite literally cost you lively hood and advancement in that lively hood

He actually did mute it appropriately at one point, when entering the hospital with many people in view. There's a few times it's supposed to be off, crap time, piss time, and when it breaks various laws or regulations. So the hospital, a-ok, but unless he was actively shitting his pants and wiping up, he can go fuck himself trying to question someone while muted.

@@paulsad7624 generally when you give someone a position of power, you must uphold them to a higher standard than the power provided. So what part of a system that punishes wrongful convictions that weren’t “accidents” is bad? That people who abuse the system don’t have repercussions and can just go back to life as normal quicker? This officer had a history of “accidentally” turning off his audio, was 100% wrong about this guy’s intoxication, and was refusing to let the man have access a lawyer, or the ability to read a form that he is “required” to sign without the officer consistently threatening him for playing “games” also known as expressing the freedom that we are privileged to be able to have. If we don’t hold them accountable, why have the constitution at all when they can normally claim they weren’t aware that the action wasn’t illegal and there is little way to disprove it was ignorance even after multiple lawsuits to the same department.

I don't think QI needs to be eliminated, but it definitely needs to be changed in a major way. If an otherwise good officer really does make an honest mistake, they should be retrained.

Right, QI is indeed necessary. The stretching and abuse of QI needs enforcement. A Mayor cannot sue for defamation because an officer stopped/arrested him in front of city hall for DUI during business hours. Now That's QI! On the other hand, If a peaceful protester is standing there, looking at a mural on a wall, and is struck in the face by police SNIPER less lethal.....QI should not be stretched/abused to say this occurred while performing normal police duties, thus protected. What is needed for change is requiring Police to carry their own insurance. When they have to start paying lawsuits themselves & the insurance goes up or they no longer are able to find a company that will carry them they can't be Police. I believe QI ended in Colorado, looks like this POS could care less! They also need to get rid of IA & have a 3rd party company handle everything. If let go for something serious like violence, their certificate should be yanked for good. This eliminates them getting a job 1 city over & the pattern continues.

I would imagine because other nervous system depressant drugs similar to alcohol probably don't come up on breath test things like valium, percocet, opioids, Benzodiazepine, barbiturates, ect.

When he says it’s a common courtesy for the man to tell him if he’ll get poked with anything, does he mean the same common courtesy he gave when he lied to the man about the overwhelming smell of alcohol coming from his vehicle, or does he mean when he lied to the other officer and said he “reeked of booze”? Well, I guess I am the problem. The officer was wrong about the man being impaired BUT I don't see an issue with this case. The officer did not use excessive force, the evidence was not tampered with, upon the blood test showing no alcohol or narcotics all charges were dropped. It sounds like the justice system worked fine.

@Aluzky DUI -> Driving Under Influence -> Influence of something -> alcohol/drugs. Therefore, if a DUI is not related to any kind of psicoactive substance, then it's a wrong called DUI; and then again, the blood test won't show anything capable of drive impairing, as it is used solely for the purpose of testing for drugs, not illnesses or such. If the cop would have cared for the health of a civilian, he would have asked about any potential medical conditions the civilian may have from the get go or, at least, from the point the breath test gave negative. This cop wanted a positive through and through, and manipulated the civilian all the way around to make him pledge to unlawfull demands and intimidation to make him sing up forms and give up his rights. In short, you are trying to defend a piece of shit and his phishing activities against civilians.

You cannot be "under the influence" of a disease, you can have a disease that effects you in a number of ways but that exception does not disprove the rule. I agree about "DWI" being the more applicable term here though, it does cover more area than just a simple "DUI"

Went through this same thing in Arizona. At court, my test came back negative and was sent on my way with the charge dropped. No apology, no money refunded, nothing. I was sober as could be and sat in a room with 7 officers circled around me telling me they’re going to get my blood one way or another. I stay as far away from police as possible now.
