Ken another great and very informative video. A tough lesson for Josh but now he will be forearmed with a body cam. Which is not a bad idea. The only question I would have is, “was this flight all within line of sight?” That is what keeps me on my toes. Apparently (as I have learned) saying “but I could see everything the drone was doing just not the drone itself…” is not a good defense. For Josh get back in the air!!

Lawsuit was the wrong choice. You should have filed a police report for stolen goods. If you throw a baseball onto a neighbors yard on purpose they do not get to keep it. Tort law is a lot more flexible than criminal law.

Why would you throw a ball onto a neighbor's property on purpose? I think negligence will be the reason for almost all real cases. I think the neighbor will have a solid case for being paid compensation, and might want to keep the ball for evidence in a civil suit. You can't throw trash on a neighbor's property, why would the ball be different?

@@jwagnermail Finders keepers is not how the law works. The law is clear. Throwing trash on another persons property is illegal because of illegal dumping or some equivalent crime. One could feasibly be charged with some kind of public disturbance or nuisance for throwing the ball on a neighbor's property but that doesn't mean the neighbor gets to keep the ball. Look into it yourself.

@@kylehardy7519 "Finders keepers is not how the law works." ...that is what I was hoping too, when I started the lawsuit, but the notion that I lost it due to negligence meant I was not entitled to any recovery... it's NYS case law: "A mere non-delivery will not constitute a conversion, nor will a refusal to deliver, on demand, if the goods have been lost through negligence” (A., Link Partners, Inc. v. Senderowicz, 2010) Also, there was a police report, since I called the police and had them come to the waterpark the same day. And I sued for the civil tort of conversion.

It's time for the faa and government bodies to start stream lining what needs to be known and what's illegal and hold both parties accountable. Touch grey area, to much over reach, to many hoops to jump through. I think if places like this decide to have a no drone policy, they need to provide proof that they have read and understood faa and congressional laws put in place before implementation of their policy, and sign it!

This is why I argue the 107 test is BS and needs to be fixed. Stop making me know the tower freq of an airport 2500 miles away and start teaching and training people on personal property and private property rights because this is the one thing we have to face every single day we fly, but I'll NEVER have to know the tower freq's in my life for what I want to do.

I’m sorry the drone ended up in a tree. It can happen to even seasoned flyers. I’m not so sure that drone is still not in the tree. On my channel I chronicle my adventure when I lost my Mavic Pro in a tree in a cemetery (a much bigger drone than a Mini 2). It took a months time to eventually spot the drone and only after the leaves had fallen. It was autumn. The drone was eventually rescued by a tree climber. I took it apart to make sure it was dry inside, put it back together and I still fly it today. I think Mini 2 is still hanging in the branches.

Flying beyond visual is a challenge. I am about to buy a drone and these stories help make me understand how to fly responsible, and safe to protect others property and my investment. Ken forgetting to raise the flight level for auto return in one video. This video and trees are the number one reason for drone loss.....not paying attention to flight height when out of visual sight.

Media mogul David Geffen, for example, has a highly secured five-parcel affair that once belonged to Doris Day at Carbon Beach. On the sessna argument I'd like to exspan with how uncontroible hot air ballons are and the damage they can do to crops, ordhards or vinards. As for air property rights I like in the movie Burlesque where a developer buys the air property rights over the theater.

A kids ball goes over the fence... a kite... a rubber-band airplane, a hat in the wind... a kids li'l puppy or a kitten... the Water Park who is there to PROFIT off of kids, is going to reprimand a kids for their pet getting through their fence, or their toy getting stuck in their tree? Boycott that water park. Put a few photos and videos of the place all over YT.

One thing that missing from the discussion is that the water park doesn't want people flying drones there for privacy reasons. They have a no drone policy for a reason and while the park was closed at the time, they didn't change the rules and they clearly don't want to start a precedent with allowing people to fly drones there. You have to take the venue into consideration and try to understand why they reacted the way they did. It's not like flying a drone over vacant land.

Great teaching moment Team Ken. I'm sure Josh learned a lesson and I am happy the community gave him a lift raft to replace his device. In my opinion he just ran into some buzzards luck by nipping the tree. On another note, a question for those who think the amusement park was inconsiderate or somehow did Josh wrong, do they have a FAA Part 107 certificate? May not seem like a big deal to some but those who are certified seem to better understand the ramifications - good and bad. Just my 2 cents.

here in Thailand this is actually very well defined, the regulation just say 30 meters vertical AND Horizontal from the structure/land. requires the permission of the landlord. but don't move yet, there are a few other issues here as well (they have a blanket-rule about privacy and annoyance) which basically always puts the pilot in a bad spot.

The policy says you cannot use a drone for "filming" or "video taping." The DJI Mini 2 does not use film and it does not use video tape. It records digitally to an SD card. So he was not doing either of these prohibited things.

The gentleman in the upper left makes a good point from a pragmatic point of view. I, and I think most people, think of the space above their property at least up to the height of the top of their roof or perhaps the surrounding trees as being "their" space. I can erect a tower or an antenna in that space up to a height of 200 feet without (short of being in an airport flight path) having to get permission from the FAA. I surely support drone hobbyists flying over parks and public land as there is no expectation of privacy. But, perhaps there should be something codified about flying over private property.

November 15, 2015, was flying P3P at about 650' to take pics of the top of the tallest building in the State-something malfunctioned and it started flying away. It didn't respond to RTH, or any input. I watched it fly into a federally guarded port facility, and I tried to talk them into letting me locate it-to no avail. A couple days later, I was allowed to fly over and check building roofs-nothing. THEN 5.5 months later, I got a call that they had found the drone on top of a white roofed building-so it was hard to see-even close up. It had been in the rain/thunderstorms of Mobile, AL for a half year. I replaced the battery, cleaned it up, and the bird flew great. So, I guess that I'm trying to say "just cause you get a drone soaking wet, don't give up on it."

I think what one of the bigger ironies in this is that your respectful and level headed young guest here made an honest Oops..fessed up..and tried to approach it in a proper manor only to eventually get okie doked out of his drone by the park and his attorneys retainer, not small change for a college kid. And yet numb nuts like our buddy at the Bengals/Raiders Playoff game will likely receive little to nothing in response to flying their drone 10' above people/kids heads and arms length away from the Action cam guy wires only missing apparently due to the blind luck that comes with stupidity sometimes..for some clicks. I've been curious your take on that whole thing as well. Best I could get out of Vic was "..greatly disappointing!" (Not really a hot take guy though) Imagine you'd have a bit more comprehensive of a take on it now that things have simmered. Just seems like all the wrong people are still paying the lions share of penance while "alleged" aholes get to skate. Rather curious to me just overall 🤔

Great story Ken. The park simply could have viewed the sd card and seen that not a sole was there. Young men do dumb things all the time , it's part of growing up. A firm verbal warning should have been sufficient then out of common decency helped him get his drone back. No harm done. Did they crush it ? No , they stole it. Good to hear the community dug in and got him a new drone. Collectively we have power.

In the days of CB's there was a regulation that you could not put up an anttena higher than ten feet above the highest item on the property. That would imply ownership of the airspace up to and including ten feet above the highest point on the property.

Same thing with gliders. If we have to make an emergency field landing the land owner cannot prevent you from retrieving the aircraft. If they dispute this, they’re also responsible for its safe keeping whilst it’s on their land.

I was filming a Infomercial for a HOA website and crashed my MPP into a homeowners roofing, I knocked on the owners door, (I’m in full vest w/license displayed), the owner Blew Up! My drone ruined his tiled roof and he was calling the cops, OK FINE, I was hired by your HOA, and my 3rd. Infomercial in 2 years. I showed him my flight path and exactly on his roof where my drone was, ( between 1st and 2nd floor under a ledge), he went onto his balcony with a broom. Dragged my drone to edge then onto ground. He then stated he was keeping my drone, I said fine, just need my SIM CARD, (Drone was totaled anyway), long story short, We shared a heated conversation, retrieved drone and sent off to DJI CARE REFRESH, received new MAVIC PRO PLATINUM 4 days later, and completed job for HOA. FLY SAFE FELLOW PILOTS

We tell new motorcycle riders to get a smaller and cheaper first bike. Easier to control and lift when you fall. I just started this drone hobby, bought a 3 yr old "new" Bug2se for $60, two flights in, only one crash (no damage to drone or tree). Lots to learn and practice. Next flight will be on a soccer field that is not in use!

If a car damages property, can the owner of that property keep the car? The question is what was the amount of damage caused by that 250g drone? Obviously nothing. So why would the water park not return the drone? That drone costs money. Why not at least give the kid a chance? To make an example of him? I will never go to that water park and will tell anyone who asks how uncool and unfair the owners are. Kids are the main clients if water parks. Kids make mistakes and do silly things. Why have a business that caters to a clientele that you don't like? I guess it's 100% business. Who cares about kids they must think. I am really appalled by their actions. That thing about a burglar suing a homeowner shows the insanity of the American justice system. A mugger won a excessive force lawsuit against an off duty cop. Imagine that anyone rescuing a person being attacked by a mugger risks prison and/or a money payout. The justice system in America is sick, really sick. Someone committing a violent crime can not be allowed to benefit or even become wealthy by suing anyone involved. As soon as they start committing a violent crime, they should lose their rights. Otherwise mugging can be a good choice in america if you know the law. Go mug people and whether or not you succeed, you walk away with a profit. Is it just me who thinks that the American justice system is heavily flawed.

I know this is a late comment but DJI Care has flyaway cover which allows you to pay about 1/2 the cost of the drone and get a new one without returning it. Obviously that would require the user to have DJI Care in the first place.

As someone who works at a waterpark AND flies drones, i totally agree with all the waterparks regulations on drones. we also dont allow cameras in the park because of privacy issues. people are really big on privacy and id rather lose my drone than have my waterprk sued for invasion of privacy. yall have no idea how big that is.

Kids there day. Wait till night and hop the fence. It's the reason tennis shoes evolved into running shoes. Real problem I saw was not setting the altitude above treetop.

Y'all are asking if a helicopter or airplane landed on the park if they would have to give it back. But y'all ain't asking what is the helicopter doing loitering 20ft off of the ground over the water park. If you say "hey, I was flying and I had to do an emergency landing because my battery was failing" is a completely different conversation compared to "I was flying inside your property, hit your tree and need to get my stuff back after clearly entering an area that I should not have been in"

Ken, excellent video as always, I'm wondering why all these places don't just put in geofencing to keep drone pilots out, period. Wouldn't that be a better solution than just putting up some stupid sign for them to do whatever they want. 🙄

I think it is only 339 ish for a mini 2 aircraft only drone replacement. If the drone was recovered and broken from the fall, it probably would cost a couple hundred to repair anyway, so filing a lawsuit was probably a lost cause even if the judge ruled in his favor and they returned to him a rain soaked drone with broken arms.

I loved this piece. So in NC you have to have a license from DOT to launch your drone. There are land use laws with that and state says you can not launch from state owned public property. And, if you crash on private property, you can not enter private property to retrieve. So basically, you can not fly except from private property from which you have permission.

I say - any time you fly over private property you are taking the risk of loosing the drone. Just like flying over the lake means you may loose your drone. You may be able to fly over and film, if you get it back fine. If you land/crash you're at the mercy of the land owner. A nicer owner would go help you. Someone not so nice has the option to say no we're closed. thing is, he may not have done damage but flying into someone else's property can have resulted in damage if it crashed on their gear/equipment. I say "at your own risk". Then always plan you may lose it.
