Tacoma is a crap hole town. The cops have way better things they could and should be doing, but this guy sealed his fate as soon as he admitted to smoking the previous day. Shut your fracking mouth dudes and dudettes.

Absolutely. I've gotten two DUIS. At no time did they care if I was able to drive. I just had to do the test. They aren't optional in Michigan. And both times it was some BS reason for getting pulled over. (air freshener from the mirror, slight deviation over the line on an empty rural road, etc.) Nothing was in danger except their budget.

Disciplined for what? He did his job properly. He investigated an accident where the driver claimed to have a green but witnesses and video show it was red. Based on the drivers statements (visiting a marijuana store/claiming to have smoked yesterday then switching to hasn't smoked in a year) and the drivers performance on the walk and turn/foot raised test (which we can see in the video he was not 100% stable) the officer decided he had probable cause for an arrest due to likely marijuana impairment. After the bloodwork came back clean the charges were dropped. I don't see where the officer did anything improper. The officer did his job objectively without bias - he even included in his report facts that could be used in the defendants defense - the nystagmus test was passed and the preliminary breath test was 0.00. In order to test for substances other than alcohol the driver must be arrested and blood tests performed. I don't see any cause for disciplining this officer.

@@aebalcYour a complete idiot!! One it’s not against the law to visit that store or to say they smoked yesterday. Sure the cop was doing his job by investigating the situation but saw NO signs of him being impaired, which was stated on the report. I could understand if he was showing visible signs of something not being right but at no time in that video did he seem as if he was impaired at all. Your probably the cop from the video trying to defend your actions. Going on here acting like this was totally justifiable which it was NOT.

He never changed his story...He stated "A year ago" only. I give you a C+...You have the basics down, but need more exxageration in order to copsplain successfuly...Tqke it for the valuable lesson it is; NEVER, EVER amswer Police questions, and NEVER submit to any roadside test other than a breathalizer!!! ESPECIALLY in Weed legal states!!! A blood test can't determine when the marijuana was consumed; Only, how much is in your system @ the time of the test...Now; Imagine he HAD smoked some the day before...? "Guilty!"

At the bare minimum, it’s lazy police work. “You’re drunk…okay, you’re not drunk, so you must be high or something.” Same thing with the Tayvin Galanakis video. It also goes to show that 99/100 times, by the time cops ask you to step out and take these “tests,” they’ve already made up their minds that you’re going to jail for DUI. No point in taking them.

​​@@MrBeevee5 the way I see it is the driver had nothing in his system and the officer is now arresting him and taking him to get probed by a doctor that most likely works for the department and isn't a doctor just a registered nurse, in the past people have been arrested, blood drawn, went and got a second blood draw from a hospital (as law usually states is requiredby the department anyways) and the hospital one DID NOT have traces of anything while the other did.

Yup. I was talking to a “drug recognition expert” from Mesa PD out of Arizona, and he literally told me one of the telltale signs that you’ve been smoking marijuana is if your TONGUE IS GREEN. Lol my jaw dropped. Like what are they teaching these guys?

The guy screwed up by answering the cop's questions. When the cop asked him "where are you coming from?" the guy said "a casino." That was stupid. Then he really screwed up when he said he bought some pot. The correct answer was "where I'm coming from is irrelevant. I will only answer questions related to this auto accident."

All he has to do is suspect someone of DUI. It's honestly a double edged sword. Those FST are hard to do completely sober, but if he lets a DUI suspect go, and the driver kills someone down the road. It would be on the officer who let him go. I do understand in a way, but the guy he arrested wasn't loaded, and he knew that. I think he gets his kicks off making DUI arrest.

The one time I had to waste my life on a jury case, the pigs failed to prove DUI because the American opted for a blood test. And by the time the blood was drawn, his alcohol level was negligible.

any physical test after an accident, when the body is still flooded with adrenaline and the person probably has suffered a whiplash injury, is the biggest nonsense of all. In such a situation, only a blood test or a breath analyzer makes sense

_"What did I blow?"_ _"It doesn't matter."_ Then why do it? I, personally, do not drink, smoke (anything) or do drugs. If I am ever stopped and asked to do a field sobriety test, I am going to refuse it and _demand_ a blood test be conducted at a hospital _immediately_ (so they can't claim any substances they thought I had in my system had dissipated). Blood tests should be the _only_ evidence admissible for a DUI conviction.

He was just in a car accident, albeit at low speeds and no injuries, still a traumatic experience and is forced to answer questions. Yet LEO's are allowed time to review camera footage and time to "process" before making a statement after a shooting in most jurisdictions. 1:26

It’s so difficult to trust a field sobriety test because we’ve seen in multiple videos where sober drivers are still being arrested. Sober individuals, that are not falling over drunk, are being arrested for minuscule subjective reasons so the arrestable standards should be raised or ban the test.

I don't trust FST's, or the people administering FST's. If a officer suspects you if DUI. There is no amount of FST or roadside chemical test that will save your @$$ from being arrested. Their mind is set on cuffing you before the test.

I've been in a similar situation, dui tests proved me sober but chp still illegally arrested me suspended my license and charged me with dui, and after fighting it for several months it was dismissed in court it is still on my record for some stupid reason and it still affects my ability to get employed. The worst part it doesn't matter if you deny or take part of the test they automatically arrest you and treat you as guilty .

"Where are you coming from?" - Correct answer is, Officer the answer to that question has no relevance on the current situation. If the officer pushes back, then you reply with: "I am invoking my 5th Amendment Constitutional right in that I may not be compelled to testify against myself. I have the right to remain silent and I will be invoking that right from this moment forward and will not answer any questions unless in the presence of and advised to do so by my legal counsel."

People in shock or having an adrenaline rush often don't notice if they are hurt. It's often not a yes or no answer when asked if you're hurting after an accident. It can take a while for people to notice if they are hurting or not after an accident.

The cops know they can't make the charges stick... but they love running people through the process. Its a power thing ! (and likely a positive aspect in their next performance review) You would be well informed to invoke your 5th amendment RIGHT to remain silent. Your remaining silent CAN NOT be used against you in a court of law. That's about the ONLY statement you make that can't be used against you !

I was told by a police officer friend to never take field sobriety tests as the only reason they ask is they suspect you’re impaired and therefore only look for signs to prove their assumption . Any small error you make is amplified by their bias and is all they notice.

This same bullshit happend to my friend. She got in a minor fender bender outside of her apartment. Pulled into her designated spot. Cops showed up. Told her she was intoxicated. She wasn't. She passed all the tests and blew 0.00. They said well, you passed all the tests but we still think your on something. They arrested her and towed her car that was in her spot.

This is insane that police in America can just pull up to an accident and assume that you are under the influence with zero evidence and take you to jail. Costing you hundreds if not thousands to bond out, hire a lawyer, court cost, etc. Then have all the charges dismissed and dropped and not a thing happens to the person nor does a dime come out of the pockets of the one that caused you all that grief and financial burden simply because they "thought" you might be under the influence. If there was some type of punishment for these false claims this shit would stop happening. That's why they need to end qualified immunity.

It appears that Fire/EMT was standing by while the PO was questioning this driver. I was under the impression that ‘Medical attention’ have priority. Medical examination could be in this driver’s favor of not being under the influence.

I thought the same but neither cop is clearly bright or honest. I got hit hard enough to temporarily dislocate and tear a tendon in my shoulder and didn't notice till hours later

Y’all remember MADD, right? “Mothers against drunk driving”? I’ve read where they give yearly awards to departments AND cops for the most DUI arrests in a year’s time. Awards for ARRESTS. Not CONVICTIONS. And every time I see someone arrested for DUI and they end up being stone cold sober, I think of MADD. And before I started watching audit videos and body cam footage, I would think “no way would a cop arrest someone when they are completely sober”. And I’m sure MADD isn’t the only one to incentivize DUI arrests. I know that departments recognize the cop with the most DUI arrests as well… It needs to STOP. Because after watching how cops REALLY are, I fully believe that they can and WILL ruin someone’s life for a trophy or blue ribbon. The arrests incentives and qualified immunity HAS GOT TO GO. Until it does, they keep claiming victims like the good citizen in this video.

this is what happens when you allow cops to make medical determinations through physical exams. Yes. Some of the tests are useful, but with the eye test that is medical professional level skills. That cop was thinking, "He blew a .000 so I have to imagine or make up something.

I learned how to give the eye test in my motor learning and control class and I’ve never seen a cop administer it correctly. You are supposed to move the object in a half circle in front of the face not side to side and up and down motion does nothing as the twitch is only presented at the lateral extremes.

Cops should be forced to read Miranda at the start of every interaction with a suspect as their investigation has already begun. Really gross they can be all buddy buddy asking you everything forever and then once the cuffs go on "YOU HAVE THE RIGHT TO REMAIN SILENT". You always had that right, they just tricked you into talking.

"You don't hafta be drunk to get a DUI." Truth If a cop wants to give out a thousand DUIs a month, he'll get recognized for those arrests. Rarely, will anything be done to that officer if only 5 of those are convicted. Because, every single case puts money on the books for that municipality.

I love it how officers just assume your impaired and not,, just mistaken. IE... people can make mistakes without being impaired. Officers who go to the wrong address and bust in the door of some poor innocent person,,, do they all have to get sobriety tests?

Poor dude talked his way right into an arrest. Don't EVER talk to police without a lawyer. Their ONLY job is to find anything possible to charge you with. Police are NOT your friend. The only time you might waive your Constitutional Rights, is if the cop also waives his Qualified Immunity.

The following needs to happen for policing in America. 1. Ban qualified immunity. 2. Every cop should have a diploma on constitutional law. 3. Make every cop carry liability insurance 4. If a cop resigns/fired from a department they needs to reapply for their certification before they can apply for another job. 5. If a cop has 5 or more sustained complaints they need to lose their certification. Then and only then will policing improve.

Also I would like to point out. The man was just in a collision. He got his bell rung a bit. Think about it, something hits you in the face. At 200 miles an hour. You're gonna be right in your mind for the first hour or two after it happens, I doubt it. And for everyone's information that's how fast an airbag deploys at two hundred miles an hour. Concused....

Well his grad school just got paid for. My uncle retired as a cop 30yrs ago and growing up he always told me never talk to the police. He said there was some bad apples out there that would hem you up any way they could. Thanks Uncle Bruce

Abiyah, your work here is outstanding! I have learned so much on how to interact with LEO. I will not roll down my windows more than 1-2 inches. In NJ, all of my documents merely need to be presented, not relinquished. Most importantly, invoke my 5th amendment right not to converse with these ass clowns. No way should police be able to get away with arresting anyone they can't prove is drunk or under the influence of any drug. IMO this is malicious arrest and the police ought to be fired and sued.

An excellent example of: 1) Why you don't talk to the police. 2) While field sobriety tests are "scientific", the evaluation the testing by the officer is subjective and can easily result in false impressions of inebriation. Unfortunately, this is a story that happens all too often; people know that they did nothing wrong and feel that they, therefore, having nothing to lose in talking to the police. Freedom - freedom is something that you have to lose.

@@bobthetitanic Then the officer has nothing to substantiate the arrest for DUI. He could still make the arrest, but he's on shaky ground as to the justification. This is why, even when someone is clearly under the influence, officers still seek to do the field sobriety test. In addition, the tests really do nothing to help you. If the officer believes that you're DUI, then they could always say that they "saw indicators" (there is no pass/fail) when conducting the test. Many officers that has been asked if they didn't arrest someone that they suspected of being DUI after administrating the field tests and their answers were 'no'. When you take the test, all you're doing is providing evidence against yourself, which is why lawyers advise you to always decline the test.

What did he accomplish by talking? Every single time that pig asked him about medical conditions or smoking weed he should have turned it back on him and asked him the same question. When was the last time you smoked mofo? Always remember how many videos we have of people acting normal and passing those tests and the cop claims they acted impaired. The kid in Iowa was 100% sober and free from any substance and the pig cop insisted his eyes were watering and he was slurring his words. They are either outright lying or they are so distorted in their mind they see things that are not there.

He was not prosecuted and all charges were dropped but you can bet that they're still at a rest on that officer's record that benefits him anytime a cop makes a bad arrest he should be penalized and all of his or her retirement fund removed

Its like, forgot which state, but they get grants and more funding for their police department when they can show that they make a ton of DUI arrests. And it didn't matter weather or not that those arrests resulted in convictions or exonerations. As long as they stacked their dui arrest record, regardless of the outcome from them, they still get millions in grants. They get to make more money, and if they get sued from false dui arrests, it doesn't bother them because they still get to keep their money and don't have to payout those lawsuits with it, because the towns/cities are the ones who have to take the money out of their budgets to payout.

I have central nerve system damage and have had permanent damage to one side of my face. It's not obvious to everyone but it certainly is to cops looking for a DUI. The thing is, I rarely drink, if do, it's at home or a family/friend's place where im spending the night, like a holiday thing. Maybe twice a year? I know I'm not drunk or high, I just kind of look like that to them. Worse, the nerve damage makes me unable to do a breathalyzer, I can't blow up balloons either. My nerve damage also affects my balance, nothing horrible, but definitely shaky for balance like the testing they do. I've tried to insist on a blood test, it could check everything but they're very reluctant to skip to that part. The last time they refused and went ahead and charged me but, no evidence so my case was thrown out. I'd really like to avoid all of it. You touched on it but...how far can a person go in refusing to do the road side tests and just skip to the blood test? Is it a right? I'm tired of it happening every time I'm near a cop. I'm a great driver but the last time was simply from being in the line behind them at a gas store, he waited outside for me to come out and stopped me in the parking lot, at the pumps! I'm sick of it!
