Im sincerely grateful for Rufai's and Dr Abati point of argument with the Grt SAN Mr Olisa Agbakoba that we shouldn't throw away a baby with the bathing water. EFCC has done some good works else, some of the former governors would have made away with all their stolen wealth without returning a dime. Though as affirmed from the position of the Grt SAN that the body was not lawfully instituted, police and the sister agencies have failed and continue to fail in their responsibility, they've disappointed greatly and they're all guilty of the illegalities raised by our respected lawyers. Constitutional Lawyers will always throw away good results when there's no law to support the beautiful efforts of any individual or body. It's just like when a military head of state is providing good government policies with beautiful results such government will still be considered illegal by any lawyer or Democrats. Let the National Assembly do the needful to legitimate EFCC and also introduce laws that will limit the President from highjacking it for their personal interests.

Not until any institutions e.g POLICE, JUDICIARY, ELECTORAL COMMISSION, MILITARY address politicians appropriately in line with the constitution, defending our sovereign nation not minding the party affiliation and 100% NEUTRA in their dealings, I doubt if this country can get better.

I love Mr Agbakoba. Brilliant gentleman and I agree he deserves a medal. The man no dey gree for anybody and rightly so cos he knows his onions and sees how Western countries operate in a no nonsense matter with regards to the law unlike in Nigeria a lawless jungle. My Simple solution is for the National Assembly to review the laws of creation of the EFCC and make the EFCC and NDLEA departments of the Nigerian police but with parallel specific mandates such that their commissioners do not function under the control of the IGP but they are able to share resources and cooperate... e.g EFCC should do their investigations independently (with access to police database) but when it comes to arrests...Arrests MUST be passed to the police force to do the arrests. (in police uniform but with the Police arrest lead or all team wearing EFCC hivis over the Nigeria police uniform ) . The arresting officers must be trained on different specific ways to conduct their arrest e.g EFCC requested arrests should be done by Officers who have completed training on EFCC arrests as such officers would know what to check for during an arrest e.g hard drives. These officers must then have Hivis over their Police uniform and carry an EFCC badge which should be given after completion of training in efcc arrest courses. Same with the NDLEA. (e.g with sniffer dogs) Commissioners should be appointed by the NJC.

Dr Olisa (SAN) sounded theoretical when he argued that EFCC is unconstitutional. Which constitution are we talking about, without glitches, abuses and breaches on daily basis by the police and the judiciary. This aguement on constitutionality could be relevant in countries where nobody, leaders and followers alike is above the law. What is important at this time in Nigerian history is to find a way of mitigating the evils of corruption while the academic debate on constitutionality goes on. Even the judiciary and the police that are supposed to be the watch dog continue to misinterpret 😮 the constitution. Unusual times demand unusual solutions. EFCC is a child of circumstance following the inadequacies of police and judiciary, and should be encouraged to fight crime at source. 33:21

The problem with the lawyer is that Nigeria is not their mini chamber. Part of Nigeria problem is that there is not check and balance. The institution is not the issue, the issue is lack of responsibility and accountability of the all levels of regulatory personnel. Empowering them to do the right thing for the state while the state protects theirs personal integrity. A regulator should be able to challenge all powers on the wrong side of the law e.g senior executive, judiciary, politicians in the same capacity as common citizens. EFCC started on a wrong footing but EFCC should be strengthen and reformed and Police powers decimated to different divisions and fostering collaboration. Regular police should be different from Transport, civil, financial .

Although I have concerns about the EFCC, such as selective prosecution, focusing more on "Yahoo boys" while neglecting politicians who are largely responsible for damaging the economy, and allegations of corruption, the positives of the EFCC far outweigh its negatives. If protests against the legality of the EFCC are coming from governors, it raises questions. Honestly, Baba Agbakoba, the constitutionality of the EFCC is the least of our problems; the real issue should be how they can operate more efficiently.

Bro, Whether constitutional or not, the EFCC should be able to confiscate assets that are beyond the salaries of governors and other public officers. Those people who spend 8 years in power doing nothing must be held accountable. All Igbo governors must have exit interviews with EFCC on completion of their tenure as part of the handover procedure. EFCC officers conducting the exit interviews must be from another region and have a template of what to look for which includes all state allocations during the tenure and how spent. Any discrepancies will be a subject of further investigations by forensic auditors and the ex-governor must deposit their passport with EFCC until cleared.
