Thank you for being one of very few on KZbin to actually breakdown the good, bad and ugly of these lawsuits/complaints. Most are reading it and using it to confirm their own bias and influence opinions but you point out the faults and inconsistencies in both. Thats why I always come back to you Emily.

Baldoni's lawsuit against the NYT is not formulated as a lawsuit, they put in extra details because they have considered this is their way to get their side of the situation out into the public sphere. And it's been very effective.

100%! It’s basically a response to BL’s complaint - which didn’t need to I close any of the details but she used it to defame Baldoni and push her narrative to the public. I actually believe Baldoni’s lawyers filed in Calofornia because they don’t really want to bring a suit to the NYT and count on the state’s AntiSLAPP to sh!t it down. But if they can get discovery out of it, they can use it against BL and RR (and Harvey’s PR lady)

His is a pr campaign dressed up as a lawsuit to get his version of events into public rather than address how NYT changed the truth and did something unlawful. This makes me think his pr is running this and the fact that his lawyer is doing a press tour all point to a continuation of pr and crisis management and has just moved from articles in the media to using the legal system to control public perception.

Emily, I just want to say, as a person aspiring to be a lawyer, while I very much love all of your legal and court coverage, one thing I appreciate most about you than most other KZbin creators is how incredibly compassionate and understanding you are with neurospicyness and ADHD as a whole. Especially when you bring up ways you learned to manage ADHD in the social aspects and professional aspects of your life. I relate to it so much, and whenever I start doubting whether I have the right mindset for a legal career due to the way my brain works, you are always right there to show me that I can do it, every time you talk about how you were able to manage it. You're an incredibly wholesome person and I appreciate everything you do for us Law Nerds so much. Sending love from Canada.

@@007nadineLI appreciate just about everything she has ever said. Having to put people on 2 times speed, having to read a different way or preference for audio books. Putting on a podcast or music in the background "as a distraction" to some but for you it helps you focus or your mind is the distraction. Dealing with people asking you to do things their way, that "you have the potential do it this way". Being told that I'm too much all at once or that I'm too high energy and need to tone it down constantly. How validating she is when she says that it is okay to be different and not let yourself be put into a box, no matter how different you are, and that it's okay to look for what works for you. There's so many other things she's said in so many other streams, so much resonates, and it helps me deal with feeling like moments like these don't necessarily have to be obstacles that stop me from being the person I want to be.

Their comments show that he is not the nice guy he is trying to portray. Their job is to make people look bad in public and they were taking advice from him according to the texts as to how they should do it with the Hailey Bieber texts. Nice guys don't give those type of recommendations as a tactic that destroys careers. Encouraging using a tactic that brought Hailey Bieber years of hate shows his true colors

The internet bandwagons hard, I learned that as an early follower of the Depp cases. It tends not to read the documents, have a short memory, and side with whoever dropped the next batch of receipt without asking if it actually addresses what was said. I am leaning towards Blake on this one, but can concede that Baldoni made some points although I am not sure if they address the issues of harassment and whether they retaliated even if it wasn’t to the extent they planned. Emily is the first one that I have seen cover Baldoni’s lawsuits critically though. I have been following since the Tati lawsuits and she never disappoints.

This case intrigues me because two things can be true at once, he could have done what she accuses him of and she could have used that against him as leverage to elevate her standing in the movie. If people would put down their torches and pitchforks we could have actual discussions about this. It's frustrating to see. Emily has by far the best coverage, everyone else seems to be fueling the fire for clicks and views 🙄

The stream introduction was beautiful in so many ways. 💜💜💜 I've been hesitant to dive into this topic due to the subject- it's awful if it's true and it's awful if it's not. Thank you for reminding me this is a safe space to learn about this case. I also loved the neurospicy tangent, especially the part about our parents. Aside from learning about my own spice blend, listening to my mom talk about her childhood I've come to realize she probably has her own blend which has allowed me to have a little more grace and patience.

Same friend! I realized I have ADHD and all the traits are the same as my 70 year old mother! She's now recognizing it as Her own neurospicyness and it's just how our brains work vs us failing as humans. She gives herself more grace now and it's great

Part of replay crew today and having seen many people cover this on different fronts. I appreciate all the wtf we need discovery reactions. I think one thing that is not spoken about enough is that there is a development timeframe prior to onset production occurring that is super important. This includes locking down the script, props, wardrobe, set design, blocking instructions, lighting, etc. Changes to character choices, script changes, "improvising" can affect all of the work needed to get the camera actually rolling. Scenes are shot out of order and any delay can snowball into lots of $$$ lost by production. Discovery for this will be so interesting (if it makes it that far).

Whoever Colleen Hoover supports, I immediately consider them suspicious. CoHo is one of the worst modern writers and she’s not a feminist as in the authors notes for It Ends With Us she discloses that 1. She fell in love with Riles (not Atlas) during the writing. Riles is the redeemed DV/SA’er of the book. 2. CoHo writes that it was inspired by her own parents DV conflicts but her mother by most accounts quickly divorced after her father began hurting her mother. *CoHo dedicated the book to her father not her mother.* her mother gets 1 paragraph of recognition but she writes 5 pages about how her father was such a dynamic, forever trying to better himself and his commitment to not committing DV despite never succeeding. Her mother is still alive but her father has passed.

She was also mad because she sold the rights of the series to Baldoni about a year before the book got big on TikTok so it would’ve been worth much more than he paid for it. I find the timing really suspect because she and Blake Lively we’re trying to get the sequel going which was supposed to be about the characters learning how to coparent while not being together but they were gonna change it completely writing him out. That alone makes me suspect that originally when they released that complaint right before Christmas I truly think they both didn’t think he would do what he did by suing the New York Times allowing him to get his side of everything and showing what her side left out (which honestly was kind of telling). Both Lively and the author tried to tie in merch to the movie that were inappropriate like Blake’s alcohol line were they created “signature drinks” based on the characters and important scenes of the movie (on domestic violence) and then the author actually created a nail polish line (which she then pulled because of pushback) where the colors were named after characters in the book… like the red color was named after Baldoni‘s character… as well as other big scenes in the movie. It just seems very…ikcy but that could be me.

She supported Justin for the last few years and he would know if she was a feminist but he still was friends with her forb5 years. What does that say about him being friends with this person for 5 years, supporting her, and only taking the lead role because of her wanting him to? That makes him suspicious. She seems to be supporting Blake now so I guess both are suspicious to you

@@ikeakarose The prodromal to all of this is Lively and Reynolds trying to get the sequel rights from JB. Correct that was well known back in the lead up to the films release. At that time JB was (rightly imo) using his ownership of the rights to the sequel as business leverage.

I think the issue isn't if** the NYTimes had the full information but why they didn't question what they did have as they went so hard in one singular direction. In doing so, they acted as a quasi PR agency for Blake Lively. Its my belief that they should have questioned more and sought the other side of the emails and texts they had and the lack of doing a full(er) research is a form of malpractice on their part.

Exactly. The fact that they didn't investigate their claims (for example, they published that intimacy coordinator was not hired at all) can be framed as a defamatory. What was shown to the Times is not the issue, it's teh facvt that Times took that and published it as a fact without checking.

As Emily pointed out, NYT was simply reporting what was in the complaint. Did they reach out to Baldoni's people for comment before going to press? I don't know...and I'm not sure we can take Baldoni at his word considering the cut throat PR campaign.

Honestly, I am of the opinion that this is ongoing PR for the movie/their careers because while Colleen Hoover has become popular, she is hated in equal measure and this move *really* highlighted that and did a lot to distract from the movie and careers of the performers. People who won't spend the money on the movie/streaming for the story will spend it for the tea.

Actor here. Sometimes really obnoxious actors who think they know better than the director will just change the lines in the middle of a scene and then claim they were just “so in the moment”. It’s obnoxious, it wastes everyone’s time, and it’s disrespectful to the writers. It sounds like that’s what she was (allegedly) doing. Or perhaps having long arguments about wanting to change her lines, which is also obnoxious and wastes everyone’s time. If she was constantly doing this… I completely understand why everyone would get frustrated. It makes sense… she also insisted on using her own wardrobe, which I believe is true because she brags about it in interviews! “Those were my Loubotins, those were Ryan’s shirts, this is my dress…” Couldn’t let the costumer do her job. obnoxious. 🤷🏼‍♀️

​@jackielehman8945 Agreed. However it's looking like several of those claims are falling apart. She claims she was shown pornography. Turns out what she was actually shown was a video relating to child birth which had to do with a scene. Massive difference between the two.

Tone is everything. I’ve personally had miscommunications because I haven’t included Emoji’s. I’ve also had online communications with emojis that have been misunderstood and I could go back and make clear the context by pointing out the tone of the emoji. Emojis are highly important in our new language. It cannot be discounted in language now because like it or not: it is A PART of modern day language!

Emojis are important however, I am not so sure that particular edit was purposeful because of what we have seen in previous cases. Based on the formatting, it looks like the texts are extracts, which can exclude emojis depending on the tool and carrier. Noteably we don’t see emojis in any of the other texts which supports that theory. So while the emoji can add context and tone, I don’t think this was deliberate, omitting the “it doesn’t matter if it’s not true” is a much stronger argument for deception

Intimacy coordinators did not become members of SAG/AFTRA until 2024 so they were not members during this filming period and they could have been involved in coordinating scenes during the strike. HOWEVER the job of an IC requires they be ONSET DURING ALL SEXUAL OR INTIMATE SCENES to work together an advocate, a liaison between actors and production, and a movement coach and/or choreographer in regards to nudity and simulated sex and other intimate and hyper-exposed scenes. They cannot do that if they are not on set. They IC would be highly unprofessional and biased towards production if they were not on set.

Thank you for clarifying that. I’d like to hear from this coordinator. Baldoni’s suit says the IC decided that his character would not climax, and then he had to discuss that and other love scene topics in private with Blake. That is a script/director decision, not an IC decision, right? I think this IC is going to have lots of info to share when she’s deposed!

I tried to watch the live but fell asleep (sick in bed), but if you review the exhibits attached in BL’s complaint, the agreement to return to work was signed by both BL and JH, dated November 2023. This agreement only included the 17-point list JB’s lawsuit to the NYTimes refers to. The 30-point list derives from the explosive meeting on 4 Jan 2024 which BL claims was a formal meeting with her husband as her representative, whereas JB claims this meeting was at RR’s penthouse suite in NYC, not meant to be such a meeting (if memory serves me right), the night before filming was scheduled to be resumed. However, contractually, JB’s lawsuit is arguing that the 30-point list can’t have been said to have been incorporated into the Nov 2023 agreement, by default (and I tend to agree): Point 17 of the Nov 2023 agreement states there will be an all hands on deck meeting at BL’s discretion, where the parties will “confirm and approve a plan for implementation” which is the legal issue here-there is legal ambiguity. BL is saying that 30 point list was confirmed and approved, i.e. agreed to as per Point 17 of the Nov 2023 agreement, but JB’s camp is saying they never received it or agreed to it or anything else in writing. I believe for her breach of contract claim to succeed (as per her lawsuit), BL will need to prove that the 30-point list, as she has now produced it in writing, was accepted and thereby agreed to as a separate agreement (which is legally binding in its own right). I agree that it isn’t incorporated into the Nov 2023 meeting, based on the wording (but that’s just my opinion, a judge will need to decide). There are no dates or signatures from either party nor any witnesses on it. That said, playing devil’s advocate, perhaps point 17 implies the subsequent agreement doesn’t need to be writing for it to be “agreed” to, so there may be leeway for BL to argue in her favour but it all comes down to what was intended by “to confirm and approve”. I suspect BL will claim verbal confirmation is sufficient but JB’s will argue in opposition, demanding it to be in writing for it to have any merit. I tend to agree to the latter, as BL already produced a written document with the demands, and given the commercial nature of the entire discussion, it would be expected for it to be executed in writing. If believing BL’s version of 4 Jan 2024, that was a negotiation (or very informal mediation) where parties would be expected to produce a record of summary after the event in which all parties would need to “confirm and approve”. That’s just basic ADR principles. There’s no date or anything on it, so I need more context as to what everyone thought that meeting was for and what was intended to occur at said meeting. For now, it’s all hearsay as far as I am concerned, and both parties are going to need witnesses from that meeting to explain what happened and what that list (if discussed) was for and what was “agreed” to, if anything, at all. I do LOVE a good contract dispute!! That said, I did find it a bit sneaky that BL’s complaint made the 17-point list and 30-point list sound like they were one and the same or connected, when they’re from two separate events on two separate days (and years)!

honestly i never interpreted these two lists to be the same and made the assumption that they had to meet on the issues described at least twice, but that comes from my experience in this field. anyone familiar with these types of complaints would or at least should have had enough common sense to understand this and would have asked her to differentiate these conversations that were had

Jennifer Abel’s behavior is toxic. She speaks poorly about everyone, including her own client, Justin Baldoni. Justin was bullied by Blake and still managed to serve as the director, actor, and producer of a film he just completed, even though Blake sidelined him and excluded him from the cast. What’s so unreasonable and “pompous” about taking a well-deserved break with friends? I really think Justin needs separate attorneys than Jennifer Abel. She and Melissa Nathan are bad news

I dont find it surprising that Emily didn’t know she had ADHD. Like everything damn thing, we know and are taught what ADHD looks like in boys and not girls. It typically looks extremely different. As an educator, the way female children present was never discussed as being anything other than just describing some kids as “spacey, chatty, bubbly, moves slowly/quickly, easily overwhelmed, messy…. “ but it was never tied to ADHD.

Must say that it appears that NYT had already decided on the slant that they were going with. Kjersti Flaa reached out to them saying that she wasn't involved and the correction that NYT made regarding that made it sound like they didn't believe her but included it because she reached out. If they had of actually wanted to know and try to work it out they wouldn't have included that Kjersti and Nikki were a part of the hate campaign. Poor Nikki found out that she was included in the NYT article when her TikToks suddenly had a whole lot of hate comments on them and she was getting media requests for a statement. Turns out Nikki's crime was that she went to Baldoni's preview of the movie and said that she had a positive experience while she was there. No other content related to the whole thing.

@@darkydoom there are over thousands of homes burned and so many people evacuated. Winds are calmer tonight, but still 25mph. There’s different fires, but one is moving toward West Hollywood. There’s also one in Pasadena, near a ton of homes and shops. It’s heartbreaking to watch the news right now

I thought that part of the issue was that the times gave Baldoni 14 hours or so to respond before it was published and they didn’t even wait 14 hours to publish, therefore not giving him a chance to provide his side of the story.

The strangest thing to me is the completely different tone of Baldoni, Able and Nathan when you compare text messaging; angry, vengeful and plotting in Lively's lawsuit v resigned, compliant and letting Lively take it over in the Times lawsuit. I really hope this doesn't settle before we can find out what really happened here.

The author Colleen Hoover wrote It Ends with Us in 2016. Baldoni, through Wayfarer, bought the rights in 2019. However, the novel's popularity caught on after that. I remember hearing that Hoover lamented that she would get so much more for the rights had she waited. Wayfarer also has the rights for the sequel. I suspect Lively set her sights on taking control of the movie and knowing of the author's dissatisfaction, made some side deal with her to get her backing to take control of It Ends With Us so Lively could buy the rights to the sequel to use as her own directorial debut. If that is correct and the sequel takes place a year after the first installment ends, Lively would need to act fast before she and the rest of the original cast age out. I am just waiting to hear the lawsuits will be dropped if Lively can buy the rights to the sequel from Wayfarer. Not saying Baldoni is an angel, but doubt the legal action is just on principal (or she could have stopped working with him at any time - she had a contract, but if what she claims is true, surely they were in breach of contract based on the working conditions).

A critical thing you’re missing here is the power dynamics between Lively and Baldoni, one of the rare situations where a woman has the upper hand. He was the inexperienced director, and she, Hollywood royalty, an A lister alongside her husband, whose movies have brought the industry billions. And Reynolds is a reported billionaire. Lively was literally able to remove him from his own film, which should tell you everything in terms of how much influence and control she had. Baldoni wasn’t an established director, and this was his first major studio film; and Lively was able to use that to wrestle control. So when you ask rhetorically, “couldn’t he have said no?” in reference to him and the studio acquiescing to her demands, you really have to think of it in terms of the existing power dynamics. Baldoni wasn’t in a position of power, as evidenced by him literally being cut out of the post production process after Lively went behind his back to work with Sony directly. Maybe it’s because Baldoni is male - and the power dynamics in similar situations are usually the opposite -, but you aren’t really considering it from that perspective…

@@TuningAnApple @ Steve is a business partner, yes…But, Baldoni himself is not a billionaire, doesn’t have the same level of personal wealth and resources as Lively and Reynolds, nor does he have their level of influence and power in Hollywood…Reynolds is Deadpool and Green Lantern, who has made Hollywood studios billions of dollars, and Lively herself has been involved in the industry since she was a child (her family are involved in the business). They are friends with Taylor Swift, Hugh Jackman and other high profile celebrities. That Lively was able to wrestle control away from Baldoni, by going around him and directly negotiating with Sony, is very indicative of the power dynamic. I doubt this happens to a more established director. Her producing her own cut, firing production staff and bringing on editors and composers who worked with her husband? WME (who also represents Reynolds and Lively) dropping him suddenly after the lawsuit was announced, is also pretty indicative. The industry ultimately sides with its butter. I don’t think he was in a position to say “No”. He had no leverage. They had already invested millions of dollars, 5 years into pre-production, and had investors depending on them, on top of staff who were already affected by the writer strikes and needed the income. On top of that, this movie is make or break for him as a director - His first movie with a major studio. If he says “no”, and Lively refuses promote the film, they’re forced to stop production and recast, further delaying a film already years into the making, it’s a bad look with the studio, as well as investors. (And then you have to worry about the speculation that will naturally arise.)

But let's really be real about what saying no looks like, and as a filmaker who is just starting to make films, and banking on this to be his first big film, he would have never had another opportunity to do this again. And regardless of whether he said no or not, it was NEVER going to stop her from suing him, (in fact it guarantees it), or making SH claims, especially if you dont do it her way -- so he might as well get his movie made, LET IT be successful and deal with the aftermath later. It's either that, or never get your moviebaby made, and still get torn apart publicly anyway and still get nothing out of it anyway and ruin future opportunities. He had to choose between 2 lose/lose situations. He chose the situation where he could win a little, and now possibly a lot more after she extorted him. This was clearly the bigger win of the lose/lose,

If they want firefighters to be able to fight the fires, than they better. Some people did, so some people will. Their cars getting actually bulldozed out of the way doesn't seem preferable for owners, if they're thinking selfishly, either. I honestly don't think most of them thought about it, though. They likely just panicked and did what they normally do when getting out of the car and didn't even think about it impeding firefighters.

Lively had the authority to take over because she had more money and is more popular. Mainly her husband is more popular and has more power. She would refuse to let that movie be released, which could have probably bankrupted the studio. Also, of course, the cast would support Lively because supporting her means potentially getting better deals with people like Ryan Reynolds.

Also, my last job was in HR at a company in CA, and some of the HR stuff is wild to me. I know things are different in Hollywood, but dang. The meeting between the accused and the accuser would have never been agreed to, especially with her husband being present as her chosen representative. Pumping can also be a minefield here. NY and CA both have very explicit laws regarding lactation accommodations, so the "company" had better hope they were following them if this goes to court. I don't like either of them and thought the movie was terrible so have no dog in the fight. And, now I have to go watch Empire Records, the extended version. Shock me, shock me, shock me with your deviant behavior.

the lactation thing is funny to me. there is a text where she's inviting him to come read lines while she's pumping. In my head I'm thinking, why wouldn't you just wait until you're done pumping BEFORE you invite him over. It gives credibility to his statement that she regularly pumps or breast feeds while he was there so I'm not sure why she's making this a point at all. Also if someone repeatedly enters your trailer without knocking, i might let it go the first time but my door will be locked going forward

I am confused about the directors cut. Baldoni’s texts say that they never got to finish the director’s cut and where just seeing the film for the first time at the premiere, but at the same time that Blake made an agreement to show both their versions to audiences and go with the one they liked, and didn’t hold up to the agreement when they liked his version more. But that would imply that his cut was made. So which is it?

I wonder how will this affect PR (& PR companies) in the future. I mean, a lot has changed already from PR then to now with the rise of social media & just because ppl changed. Also wondering if we'll see more PR lawsuits in the future. Celebrities would also probably be more cautious on hiring PR, changing companies/publicist as they might turn on them later on & reveal their PR strategies (and of course, going aroung, how will this affect PR, like if they can't be trusted to release it someday).

5:13:00 how screenwriter and director could be unaware that RR rewrote a scene: they filmed during the writers strike. So that’s a big reason. Also! If the texts about BL not getting the scene revisions are true (there was a screenshot about BL apologizing for not knowing there was a scene revision so they need to run new lines while she pumps), and it's been stated by both that BL was allowed to improvise on takes during filming, even if it strayed far from the scenes intention (as BL says RR gave her the new dialogue suggestions) all of that seems possible to happen on set. I would ok it as writer or director, knowing that improvs conflicting with the intention of the story will be on the cutting room floor. But if Justin and the editors were shut out of BL final cut and weren't even allowed to view the dailies for BL scenes, then I could absolutely believe a director, editors, and screenwriter could be blindsided by an improvised/unofficial rewrite of a scene making it into the final cut of a movie because we are seeing BL's final cut, not the director's final cut... IMO Screenwriters are often pushed out of their film. Even no-name directors have tried to do this to me. It is a pervasive practice in film to say fuck the writer. That’s why so many films are written and directed by the same artist. Only directors/producers of integrity keep a good writer's opinion in regard throughout the process. As film is more a director's art-- unless screenwriters are also a producer-- they don't have too much say. I've written for projects and not seen what the story became until it airs/screens because once my contract is done they can’t loop me back in unless they’re paying me.

I am curious about the phone number that Jen Abel was told that she could keep by Jonesworks, LLC, but then told no four months after she was terminated. Does that mean that Jonesworks, LLC were able to access all the messages that were sent during that time?

At 2:35:35 Emily reads " Abel's text messages were forensically extracted directly from the company phone that Abel used during her employment at Jonesworks and voluntarily returned to Jonesworks upon her termination in the presence of an employment lawyer." It wasn't 4 months after she was terminated.

If the NYT only had extractions from one person's phone but went ahead with publishing a story with those types of connotations, that is egregious and should be considered defamatory.

The Jones complaint is absurd. She was responsible for overseeing her clients Justin and Wayfarer, yet prioritized protecting her husband’s WME talent agency clients, Blake and Ryan Reynolds, at the expense of her own clients. That’s a conflict of interests and should’ve been disclosed in the beginning
