One thing i understand about the difference between a "draw" and a "stalemate" is that a draw is a "3 fold repetition" while stalemate or the king cant move without being check or being checkmated.

A draw can be seen as the umbrella term that represents the game ending in a tie. You are correct in saying that a stalemate means "the king can't move without being checked or being checkmated" (i.e no legal move can be made), so a stalemate is a type of draw. Other types of draws include the threefold repetition, draw by mutual agreement, etc.
