I can’t imagine a person going through this wc system without an attorney. I wouldn’t . I have one and she’s very good . If possible ask around read reviews . Try to hire a trial lawyer. The defense hates trial lawyers due to them having more persuasion and knows the system that much more .

Never ever settle to close your worker's comp case aka a section 32 in New York state, if your doctor/surgeon says you need surgery and has filed the MG-2, trust me some attorneys will tell you to settle and your private health insurance will pay for your treatment and surgery, as per ObamaCare as what was said to me. I called my private health insurance and they stated, work related injury, worker's comp insurance though that few $100000 to settle is an ideal thing to do, I say no your health and well being comes first, do your research talk with your attorney, if your attorney is just looking to get their cut right now this is not an attorney for you. Keep treating with your doctor ask all questions related to your medical care.

I have been on Worker’s comp for over a year , can I apply for state disability after I settle

You should apply for Edd disability absolutely. Wc will continue to deny your claim in most cases and you should get on that Edd benefit . It’s good for one year keep going until it’s exhausted . Wc insurance will reimburse Edd / the state benefit.
