Finally a pithy explanation without a bunch of lawyerese word vomit. Citizens need to learn what can or can't be done and why regarding their rights to defend themselves against agents of the state especially those who believe a citizen exercising their rights is somehow an affront, a personal challenge or some type of hostility. This is why I watch your channel and others. It's good citizen training.

Good video. This is the type of topic that can create situations in the field with those who think they know the law but don't. It gives officers a solid response to such inquiries/rebuttals.

What if the cop lies to the business owner. I saw a video of a private detective staking out someone at a church for some kind of insurance fraud investigation. The PI was parked in a business next door. It was a win dixie. The church next door saw the guy and thought he was taking pics of the children so he called the cops. Nothing wrong with that. But when the cops investigated they found out he was a PI and because he refused to talk about who he was investigating, which he was legally not allowed to disclose by law. The cops went in and solicited a trespass as they say. But the cop did it by making the guy out to be a creepy guy taking pics of children. But the cops had already verified that he was a private investigator at the time. The store manager agreed to trespass him based on misleading info that the cop told her. I would say it was an outright lie. Any logical person would know that he couldn't talk about his case. They verified his I.D. and P.I. license. The several times I have seen examples of this on KZbin, it has left a bad taste in my mouth. The examples were not of the officer looking out for the business, but officer retaliation for "contempt of cop" or not getting their way. I gather that the ability for an officer to solicit a trespass is not universal, and that some states and some departments do not permit it.

Can an officer trespass you from a property if u already left the scene and they find u somewhere else.

If the person is on private property then this is fine. It’s different if on a public sidewalk. The police cannot make you “move along” if you’re panhandling in front of a business. The Supreme Court ruled that panhandling is protected by the 1st Amendment saying that it is asking for a charitable donation. The police asking a business to trespass someone from the property is just a power move driven by ego.

Most of the time we ask the business if they want the person trespassed because the business called us for whatever reason. Usually it is after a shoplifting. After we get done with the criminal stuff we ask if they want them trespassed. It could be because they were acting creepy and nothing criminal happened. The trespass is a way to make the problem go away.
