UCC would provide for one law for the entire country applicable to all religious communities in their personal matters such as marriage, divorce, inheritance, adoption etc. Currently Indian personal laws is fairly complex with each religious adhering to its own specific laws. Eg:- Hindu personal law in special marriage Act 1954, Hindu marriage Act 1955, Muslim personal law in kazi Act 1882, Muslim marriage Act 1930. Moreover there is diversity even within communities all Hindus of country are not governed by one Law, nor all are Muslim or all Christian. Let's take a note on historical perspective of ucc:- 1. British rule:- there was lack of uniformity in civil matters as personal laws based on religious customs and traditions 2. Nehruvian vision:- Jawaharlal Nehru invisioned a modern and progressive India and the UCC as an essential element of nation building. 3. Hindu code bill:- it was seen as a step forward a ucc as it admit to bring uniformity in personal laws within the community. 4. Shah Bano case:- the supreme court judgement in this case sparked debate on need for a ucc ensure gender justice and equal right for women across religious communities 5. Directive principle of State policy of Indian constitution states that the state shall endeavour to secure for all its situation a uniform civil code throughout the territory of India. Some points in favour of ucc- 1. It will integrate India under one National civil code of conduct. 2. it will help in reducing vote bank politics. 3. personal laws are a loophole still operates on thousands of year old value 4. Ucc will also help in improving the condition of women. 5. Ucc is a sign of progressive and modern Nation, it is step forward towards goal of developed nation. 6. All Indian should be treated same in marriage inheritance adoption, it promotes real secularism means every person treated the same. So why there is opposition for UCC:- 1. Diversity cannot be compromised for uniformity because from north to south and from east to west its state in India has different culture and different Outlook towards life. 2. Violation of fundamental rights state in when intervention would be the violation of fundamental rights article 25 ,26 ,29. 3. Constitution recognises the customary law and procedures prevailing in North East States Hence there would be practical difficulties in formulation as well as implementation of UCC. 4. India is very religious community and Karl Marx said that religion is opeum for the masses. Hence No one wants to give up their religious practice. 5. 21st law commission 2018 :- UCC is neither feasible nor desirable Universal civil code after Shah Bano case become the ground of politics forcing then government to nullify the verdict. The demand for UCC come from the people hence we need to follow bottom up approach for this debate, public discussion, started among the communities and civil society to educate and aware about the UCC that it would help to speedy recovery on trial, justice, ease of law making and integrate the nation.
