Any crypto that is widespread promoted as an investment, leaves itself open to this. But the words of one founder is not slam dunk. But the same playback testimony could be used on Gensler when he said Ethereum was not a commodity. The problem is with Howdy (sic) is it applies to almost every collectible, airline miles, beanie babies etc. Computer code is free speech (Supreme Court). That some people value it does not mean it was sold with that promise.

The issue with ETH is that it was a security for awhile until the network was sufficiently decentralized. Therefore ETH transitioned from a security to a commodity. SEC will technically win their case, and the crypto market will get a court ruled definition/criteria for when a network becomes sufficiently Decentralized. Win-Win

What dictates a security is the Howey. It has 4 prongs. Decentralisation is not one of them. The law has not changed on that. ETH satisfies all 4 prongs of the Howey test. Hence it is a security. Decentralisation is made up bs.
