I still don't quite understand the difference between capacity & competence. Are they really just the same thing other than the fact that capacity is determined by the physician and competence by a judge? ...And how does a judge get involved in any of this?

morrislegendary Its beyond the scope of the Step exam, and even most physicians use the terms interchangeably not realizing there is technically a difference. Really the only people who would stress the difference is lawyers and people who are in the Medical Ethics field so I wouldn't worry about it too much. Judges aren't usually involved, but it is occasionally necessary. For example, if you want to keep somebody in the hospital against their wishes (AKA "Baker Act" them) you may need a judge to get involved to show that they don't have the capability to make decisions for themselves.

+Muhammad Saeed My guess is cancer is reportable, because it has public health risk factors that may be able to be altered if identified early. For example if there is some sort of environmental toxins causing cancer in a certain area then healthcare organizations need to know so they can fix it. Alternatively if viral hepatitis is causing liver cancer or smoking is causing lung cancer statistics need to be collected so that public health officials can respond.

I think being pregnant or having children doesn't automatically make a minor emancipated. However, being married does make a minor emancipated.
