Marcus this has just saved my Law Degree! Thank you so much! I have been off uni ill and missed so much and was panicking about cramming for my Law exam tomorrow and you have just explained this all so clearly and helped me to be ready for EU Law exam on prelim rulings tomorrow so thank you! However you do need to address the fact that you refer to the CJEU for preliminary rulings as a whole and the CJEU is made up of 2 courts and it is only the ECJ that deals with preliminary rulings and the other court of the CJEU is a general court. This could confuse those watching your videos.

Marcus - a popular exam question for me is outlining the four situations that a national court need not, or should not make a preliminary reference. Finding this one difficult. There is obviously - where the reference is not necessary to decide the case (no question of EU law, acte clair and acte eclaire but what is the fourth??

I have read a few blogs suggesting that preliminary ruling procedure should be individualized following the Van Gend en Loos precedent as this would further the EU objectives. Any idea what does that mean in practice? How would it be different from the principle of direct effect?

Can you explain what the member states "common constitutional traditions are"? I'm in my first year of law school and having such a hard time understanding what it is and where to find information about it.

Well it can vary a little bit from country to country but it is generally the essential principles that underpin a constitution in any given member state. As these tend to be based on Western values they generally cover things like multiculturalism, human dignity, rights of the accused etc. There is an interesting Austrian example that refers to not putting up barriers to international trade.

Hi, was wondering what the case of 'Foglia v Novello' establishes in respect of Article 267? Also Factortame?

+The Man Foglia says that there has to be a genuine dispute between the parties in order to ask a question. Factortame allows a national court to grant interim relief (eg injunctions).
