In 2013 I was the male victim of repeated domestic violence offenses which began after I informed my childs mother that I wanted to end our relationship. She was undocumented and it soon became apparent that she was behaving this way hoping that I would retaliate enabling her to receive a U-visa. Instead I called the police and filed over a dozen domestic incident reports. The police had been to our home numerous times and repeatedly warned her to stop or she would be arrested. On the final night we lived together she assaulted me and was ultimately arrested. The DA declined to prosecute her due to her immigration status and the sanctuary policies in NYC. A month later she filed a false report alleging DV on the date that SHE was arrested. I NEVER even once raised my hand to her and wtf is an "attempted" assault anyway? At trial all of the NYPD officers involved testified in my favor, video footage proved that her testimony and allegations were false, her only witness was a family member who arrived after the police were called. That family member pretended to the courts that she did not speak english despite having been born here, attending school here, living and being employed here for over 30 years. Her lie was discovered during examination on the stand and she was admonished by the judge. Upon realizing that the prosecutor had no case against me they reduced the charges to a midemeanor held a bench trial and found me guilty of misdemeanor attempted assult. The judge having a nasty disposition and bias towards men remanded me to rikers island for two weeks without bail. I lost custody of my son, was ordered to pay for and undergoe a year of anger management, parenting classes and received a year of probation. I was forced to quit my civil service employment of 10 years in order to make more money to afford the $500 weekly I paid in child support. My civil rights have even been lost; they defiled justice and wrongfully convicted an American veteran to enable a lying illegal immigrant wronfully obtain status. I immediately filed an appeal and after months of checking on the case status with the clerk I was told that there was no record of my appeal despite me having proof of filing and correspondence between the DA and the appellate courts arguing that I should not be provided a public attorney for the appeal. This was nine years ago, life moves on I remarried had another child have been an excellent father to my first child who now wants me to go to court for custody (filed over a month ago but yet to receive any response). I always pay my child support (over $100,000.00 so far), have been a business owner for 7 years, received a relief of civil disabilities from that conviction and I even found the grace to maintain a friendly relationship with the spouse that falsely accused me (we had breakfast together with the children a few days ago) but I will never stop telling my story until this injustice is reversed, reforms are made and things are set right.

Family court is not a constitutional court. It’s an unlawful legislative court . Under the spending clause conducting commerce and profiting off of the separation of children from fathers. Keep track of everything and hold them accountable. Your attorneys you’ve hired are a part of your problem. They are in on it in my opinion. I’m not an attorney do your research.

I viewed this video from a different perspective.... I imagined that you are opposing counsel and what type of defense thst I would have to deliver. I don’t have a lawyer but going into circuit court. Do I need to hire a lawyer for the discovery? There’s questions I know he will lie on and I do have the proof showing it’s a lie. For instances medical care for our children. He says he took them but records show he hasn’t in two years. Is that something I admit into evidence and then just cross examine him on? I can’t afford a lawyer. But I need this case to be heard properly and my babies deserve that.

How do you handle receiving by service of mail; a declaration to FL300 that has NOT been filed with the court? Do I even need to file a response? If so what would I be responding to as far as the court is concerned? Should I submit copies of the unfilled paper work with my response? Thank you!

What would cause the courts in and of itself not to divulge to an interested person/heir their share of an decedent's estate?

If said individual is not mentioned on the will, they do not have to divulge information to that person. There could be other reasons, though, you might want to check with whoever is handling the arrangements. Thanks for watching!

Is a joint Statement of Evidence the same as a Pre Trial Statement?

Under the 6th amendment, you and the other party have a right to know the evidence against you. That information must be available to each party, but always be sure to check with your attorney. Thanks for watching!

@@shawneseward1148 in our county all documents must be filed with the court clerk before serving them on the other party. If they don't follow the rules you can file a motion to compell or sanction or other form of court discipline against them. Maybe contact an attorney through unbundled services and get only the services you can pay for ... even if it is just instructions on how to do all the paper work steps. I am in similar situation nd am truggling to figure out what all steps I am supposed to do in preparation for trial. Courts have their rules listed on their web sites, but the rules are written in legal language so hard for me to understand.

Really?? Ok. You now need a complete stranger, a Judge, decide for you because you and the person YOU chose can't agree on how to end things properly. You'll be entering an unknown arena, and you won't understand its rules. Fortunately for you there's someone who have studied the law that YOU ARE UNCERTAIN about can protect you against yourself. Then you complain about fees? Here's an analogy: you've got a huge wrestler coming after you...of course you want to defend yourself...but you're going to need some help. Wouldn't you like it to be a seasoned wrestler who knows all of the wrestling tricks and maneuvers? Make it make wense!

The Social Security Act of 1975 Title 4D is sexual discrimination, 2 totally different sets of laws for the sexes. What health and human services need the most is to actually promote child welfare. We need family law reform. The Federal Child Support Training Manual needs to be abolished. A new plan where every cent of every dollar actually goes to the child. Judges are involved in conflicts of interest caused by performance Rewards of Federal Grant Money after reaching a percentage of support revenue Actual federal incentives to destroy families, Every single day, The Judges, lawyers, and clerks hold kangaroo courts with full judicial cognizance that they are committing multiple felonies while acting in Executive, performing ministerial duties, making judicial rulings from the bench, and making decisions reserved for a jury. Any alleged order unsigned by a clerk and not entered is void, a forgery under 28 USC sec 1691 all writs from courts must have a judicial signature, and under CPLR 5016 all money judgments must be signed and entered by a clerk. FCA 460 requires signature and entry with the clerk, therefore all orders of support are forgeries of official instruments of commerce. These Judges jump back and forth between Executive and Judicial roles during the kangaroo court. The support orders, garnishment orders, and everything involved with the forgery of those instruments is criminal activity, producing official documents requiring recording with public office, as an incomplete written instrument.
