So, the lawsuit sounds absurd on th face of it, but let's think about the claim here. They put essential safety electronics, which are sensitive to moisture, directly under a conveyance designed to hold liquid. That is terrible design. This ranks right up there with "you're holding your phone wrong", with Apples bad iPhone antenna design. And this lawsuit reads like the McDonald's Coffee lawsuit. While on th surface it seems absurd to complain about coffee being hot, the truth was that this McDonald's Coffee was well over 200°F, well above what it should have been, and even higher than other McDonald's in the area. It was a terrible safety issue, that McDonald's hired a PR firm to push articles claiming the "absurdity" of Hot Coffee being Hot. So while this seems like a stupid "cup holder" lawsuit, it's still a serious safety issue about the air bag controller being susceptible to liquid damage by being placed below a cup holder.

It's not about the cup holders. It's about the air bags going off because of the cup holders --- while you're driving!

How ignorant are you? If BMW puts important safety control electronic bits in an area where one would expect (and BMW is aware) the airbags would sustain damage by liquids in a spill, say under a cup holder, BMW should be raked over the coals.

This is a reasonable lawsuit. I've noticed that manufacturers are placing traction control buttons near the cupholders more often, one mishap and you're going in for a repair. My sister actually did this with her Ford Escape, it created a short and the traction control indicator would blip on and off on its own.

If anyone should get used for cup holders it should be Volkswagen/Audi for making those useless cup holders in there older models. I used to have 2012 A4 and there was only one good cup holder the rest couldn’t fit any drinks here in states.

@@TheSchwiz I think that is part of what this lawsuit is arguing. Because it would be easy for BMW, like Apple and their "your holding it wrong" excuse, to say "these cup holders were never designed to hold open containers, they are purely for sealed beverage storage, and to meet a certain trim level criteria for the customer when shopping, not to be functional as expected", or some other stupid legalese of "the cup holder is not ACTUALLY a cup holder". By attacking the cup holder directly, it forces them to admit there is a safety design fault with the car.

Of the accusations that liquid spillage cause cause airbag deployment are true, then I don't thinknthe lawsuit is ridiculous. It's ridiculous for BMW to allow to knowingly allow the flaw...assuming this is all true.

This lawsuit looks like bs at face value, but it affects safety when liquid is spilled which is inevitable, which is a problem as an airbag could smack you in the face when you spill a drink
